File Note: The note of Regional Office may kindly be perused………………………………. Earlier the industry was granted Consent to Operate under Water Act, 1974 vide no. CTOW/Renewal/LDH4/2020/12763097 dated 22.07.2020, which was valid upto 30.06.2023, Air Act, 1981 vide no. CTOA/Renewal/LDH4/2022/17776324 dated 25.03.2022, which was valid upto 24.09.2022 and authorization under HWM Rules, 2016 vide HWM/renew/LDH4/2022/17830776 dated 30.05.2022, which was valid upto 29.11.2022 with suitable and special conditions mentioned therein…………………………………… Thereafter the industry has applied for renewal of Consent to Operate under Air Act, 1981 and same has been refused vide no. CTOA/Renewal/LDH4/2023/21686818 dated 24.07.2023……………………………... Further the industry has also applied for authorization under HWM Rules, 2016, which was refused………………………………….. The industry was issued directions u/s 33-A of the Water (Prevention and Control of Pollution) Act, 1974 and 31-A of the Air (Prevention and Control of Pollution) Act, 1981 for disconnection of electric supply available to the industry vide Board’s letter no. 7914-17 dated 21.11.2023……………………….. Further, the auto renewal consent to operate obtained by the industry under the Water (Prevention and Control of Pollution) Act, 1974 has been revoked vide letter no. 3322-24 dated 15.05.2024 and Air (Prevention and Control of Pollution) Act, 1981 has been revoked vide no. 3325-27 dated 15.05.2024…………………………….. The auto renewal authorization obtained by the industry under the HWM Rules, 2016 has also been revoked by the Board vide letter no. 3632 dated 28.05.2024…………………………………. Further, the industry was issued notice to issue directions u/s 33-A of Water (Prevention and Control of Pollution) Act, 1974 1988 and Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing before the Chairman of the Board 23.04.2024, wherein it was decided as under: - 1. Environmental Compensation be imposed on the industry for degrading the Environment. 2. Environmental Engineer, Regional Office-4, Ludhiana shall calculate the amount of Environmental Compensation to be imposed for the violations and put up to the Competent Authority, immediately. 3. Regional Office – 1,2,3 and 4, Ludhiana to put up cases separately to the concerned Zonal Office of all industries which have made agreement with M/s Charanjit & Co Technology immediately 4. Environmental Engineer, Regional Office - 4, Ludhiana be file a plaint in the Competent Court of Law for violations of the provisions of Water Act, 1974 and shall immediately prepare agenda item/ draft plaint in consultation with SLO and get it approved from Competent Authority for filing the same in the Court. In compliance of the hearing decision 01 and 02, Environmental Compensation imposed on the industry has been calculated vide e-office no. 230182 and same was pending with EC Committee in HQ-1. In compliance of the hearing decision 02, the letter has been written to the concerned RO's vide letter no. 78-84 dated 23.01.2024 and 867- 70 dated 22.05.2024 to initiate action against the industries still lifting the spent acid to M/s Charanjit & Co. through concerned Zonal Office. In compliance of the hearing decision 04, the reply has been prepared by Regional Office and has been sent to SLO for vetting…………………. Now, the industry has applied for fresh Consent to Operate under Water Act, 1974 and Air Act, 1981 through OCMMS………………………….. The industry has already deposit consent fee, which is valid upto 31.12.2024…………………. Now the industry was visited by the AEE of RO on 11.07.2024 and it was observed as under: 1) The industry was not in operation during visit and the electric connection was found disconnected. 2) The industry is engaged in process ofmanufacturing of ferrous sulphate from the sulphuric acid. 3) The industry has now improved its housekeeping and has now provided tiles for the movement area of the vehicle. So, industry is making efforts to comply with the SOPs prescribed for such units. 4) The industry has provided double stage alkali scrubber with one reaction tank and same was not in operation during visit. The industry has done repairing of its APCD and adequacy of APCD will be adjudged when the industry will be in operation. 5) The industry is making efforts to improve the site conditions and APCD along with movement area. As proposed by Regional Office, may, if approved: 1. BG of Rs. 5 lac be imposed on the industry as an assurance to comply with the SOPs prescribed for such units before restoration. 2. Direction u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974and Air (Prevention & Control of Pollution) Act, 1981 be restored temporarily for six months 3. Fresh consent to operate under the Water Act, 1974 and Air Act, 1981 be granted to the industry upto six months with suitable and special condition that the industry will comply with the SOP prescribed for such units in true letter and spirit.
