File Note: 1. It is submitted that the subject cited project is covered under small scale red category i.e. 1063 – Building and construction projects irrespective of built up area and having waste water generation 100 KLD. 2. Now, the project proponent has applied for 'Consent to establish' (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 to develop a residential colony having residential plots @ 202 and SCO @ 13 in an area 9.852 acres. 3. The project proponent has submitted CLU issued by GLADA vide no. 407 dated 25.03.2022, as per which the proposal site having total area of 9.852 acres for setting up of affordable residential colony, plotted namely Zannat Developers. 4. The project proponent has submitted approved layout plan from STP, Ludhiana vide no. 862 STP(L)/LA-23 dated 07.07.2023 with total net planned area of 9.852 acres. 5. As per the approved layout plan, the total proposed area of project is 9.852 acres (less than 50 ha). The project is being developed in a plotting manner and after considering the FAR the gross built-up area after the completion of the construction of all residential houses, may come out to be 50084.029 sqm which is greater than 20,000 sq meter built-up area. 6. As per the schedule of the EIA notification 2006, at point 8 (b) the township and area development projects covering an area ≥ 50 ha and or built up area ≥1,50,000 sq mtrs requires Environment Clearance from the concerned authority. But as per the MoEF vide its letter no 205 dated 15.04.2019 it is clarified that the projects with a land area of less than 50 ha but a built-up area of more than 20,000 Sqm may be appraised as per provisions of Schedule 8(a) of the EIA Notification2006 as amended from time to time. The Board vide its letter no. 10949 dated 09.05.2023 has sought a clarification from the Joint Director MoEF, Chandigarh on this ambiguity and the reply of the same is awaited. 7. The project proponent has submitted brief project report with the value of project proposed as Rs. 975.00 Lacs. The industry has deposited Rs. 22,100/- vide R.No. YESIB41111793622 dated 20.04.2024 as NOC fee, which is adequate for one year. 8. As per project report, the total domestic water requirement for the project will be 413 KL/day for fresh water demand shall be met through own tube well. The project proponent has proposed total effluent/waste water generation @ 413 KLD. The domestic effluent will be treated in proposed STP having capacity 350 KLD. Treated effluent @ 158 KLD will be re-used and utilized for flushing and green area and excess 172 KLD will be discharged onto land for plantation after STP. It has proposed 1.5 acres as plantation area for disposal of treated effluent. 9. As per the project report, about 1228 Kg/day solid waste will be generated in the project. The biodegradable waste will be processed in mechanical composter. 10. The project proponent has proposed to install STP of capacity 350 KLD with component as follows; collection tank, MBBR reactors, tube settler, clear water sump and sludge drying beds in the project premises. 11. The project proponent has proposed to install one DG sets of capacity 125 KVA with canopy. 12. The site of the proposed project was visited by the AEE of this office on 17.07.2024 and it was observed as under:- a) The project is located Village Sarinh, Malerkotla Road, District Ludhiana. b) The construction of the project at site has just been started. The boundary wall has been constructed. c) There is no public sewer near the project site. d) No occupancy has been made at site. e) There is no Maximum Hazard (MAH) industry at radial distance of 250 meters from the site of the boundary of the project. f) There is no air polluting industries, rice shellers, brick kiln and stone crushers at distance of 100 meters from the boundary of the project. Keeping in view of above, it is proposed that consent to establish for project under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project upto one year with suitable conditions as per the Board's policy and subjected to the following special conditions:- 1. The project proponent must shall obtain the Environmental clearance in accordance with the EIA notification of 2006 and its any subsequent amendments, as directed by the Ministry of Environment, Forest and Climate Change (MoEFCC), in future, if Board's get the confirmation of the same from MoEFCC. 2. The project proponent shall obtain permission from CGWA for abstraction of ground water (if required) and shall comply with the guidelines issued by it from time to time. 3. The project proponent shall provide adequate capacity of bio composter for management of its wet waste and shall provide adequate arrangement such as waste segregation, compost pits, MRF shed etc for management of municipal solid waste as per Solid waste management Rules, 2016. 4. The project proponent shall fulfill its responsibility as a bulk waste generator and shall comply with the provisions of Solid waste management Rules, 2016. 5. The project proponent shall develop and reserve adequate green area and shall make maximum utilization of its treated wastewater for plantation, flushing within its premises. 6. The project proponent shall provide dual plumbing system for back flushing. 7. The project proponent shall ensure compliance to the comprehensive guidelines for the regulation of noise/ sound pollution caused by use of loud speakers, public address system etc. issued by Punjab Government, Deptt. of Science, Technology & Environment vide notification no. 3/100/2013-STP(4)/145 dated 26.02.2014. 8. The Consent is being issued to the project proponent based upon the undertakings/documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 9. The project proponent must obtain all the necessary permissions and regulatory clearances from the relevant departments and agencies of the state government, in accordance with the project's specific guidelines as per the per state government laws. 10. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the promoter.
