It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/LDH1/2021/16084650 dated 28/09/2021 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH1/2021/16084336 dated 02/10/2021 both valid upto 30/06/2024 for the manufacturing of ARM Brake @ 4.5 T/day, Side Plate @ 1 TPD, Brake Pedal, Side Stand, Gear Change Lever & Cover Plate Etc. @ 3.5 TPD, Clutch Plate @ 3.5 TPD & Zinc Plating @ 7 TPD.
Now, the subject cited industry has applied for obtaining varied consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 1490.17 Lacs as on 31/05/2024 as per CA Certificate dated 04/06/2024, which is adequate upto 30/06/2029 under Water Act, 1974 and Air Act, 1981, as per Board's Office Order dated 29/10/2018 after deducting penalty charges 10 % and NOC regularization fee.
The industry was visited by the undersigned on 09.07.2024 and it was observed as under:
1. The industry was in operation during visit.
2. The industry has made agreement with M/s JBR Technologies Pvt. Ltd., Ludhiana (CETP) for lifting its trade effluent @ 50000 Ltr/month.
3. The industry has installed water meter in process area & its reading was noted as 1428.7 KL.
4. The industry is maintaining record w.r.t. fresh water consumption for the wet process & effluent lifted to M/s JBR Technologies Pvt. Ltd., Ludhiana. The record of last 6 months is attached as PDF.
As per the record the quantity of water consumed for wet process is in consonance with the quantity of effluent lifted to JBR Tech. Pvt. Ltd.
5. The domestic effluent of the industry is being discharged into sewer.
6. The industry has provided fume collection over the pickling section followed by alkali scrubber with caustic dozing as APCD with adequate stack height. APCD was in operation during visit.
7. The industry has installed 3 no. DG set of capacity 320 KVA, 200 KVA & 180 KVA with canopy and adequate stack height.
8. The industry is located in the Industrial Focal Point of Ludhiana city.
9. The industry has changed its scale from small to medium and it has increased domestic effluent from 20 KLD to 32 KLD due to increase of employees. So, it has applied varied 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981
In the subject cited case, the industry has mentioned ground water extraction @ 37 KLD. Considering 25 working days per month, ground water extraction will be 925 KL/month, which is more than 300 KL/month. The industry has obtained permission vide no. PWRDA/I/03/2024/L1/294 dated 12.03.2024 valid upto 11.03.2027 for ground water extraction from PWRDA.
It is therefore recommended that 'consent to operate' under the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/06/2029 with suitable conditions as per policy of the Board.
