Rai Developers Pvt. Ltd.), Village Handiaya, Barnala, District Barnala on 02/07/2024. The following were present: From the Board: Er. Lavneet Dubey, SEE, ZO-II, Patiala Er. Amit Kumar, EE, ZO-II, Patiala From the industry : Sh. Shubham Raj, Director Environmental Engineer, Zonal Office-II, Patiala brought that the project is a medium scale orange category residential colony and was earlier granted consent to establish/NOC of the Board vide no. CTE/Fresh/BAR/2021/1726529 dated 25/11/2021 valid upto 24/11/2022 for development of residential colony namely Green Avenue Phase-2 situated at Vill Handiaya B, in the revenue Sub Tehsil of Barnala, in an area of 37.35 Acre. Further, the project proponent was granted NOC (extension) vide no. CTE/Ext/BAR/2022/20134336 dated 18/11/2022 valid upto 24/11/2024 for the establishment of the same project. The project proponent has submitted a fresh application dated 09.05.2024 for obtaining Consent to Establish under the Water Act, 1974 and the Air Act, 1981 for establishment of residential colony with an amended proposal including change in location of the proposed STP for treatment of effluent generated from its premises and means of disposal. The project proponent has taken land on lease from Sh. Balwinder Kumar s/o Sh. Brij Lal on 03.04.2024 for 15 years i.e. upto 31.03.2039 for installation of STP to treat effluent generated from its premises. The said land is extended in land area measuring 17 marle bearing khata no. 242/374 khasra no. 76//2/3/0-12, 9/1/4-4, 12/2/2-9 marle kitte 3 total 7 kanal 5 marle. The site of the colony has been visited by the officer of the Board on 15/05/2024 and it was observed that the project proponent had earlier proposed to install STP inside its premises, however, proposed location of installation of STP is shifted outside the premises of project site i.e. backside of its sister concerned project namely M/s Green Avenue (Promoted and Developed by L.P Developers Pvt. Ltd., Barnala), which is about 300 mtr away from the residential colony and treated effluent is proposed to be partially reuse via dual plumbing and partially to be utilized onto land for plantation. The application under consideration was examined by the Board and found that there are certain discrepancies in the proposal submitted by the project proponent which includes unjust reason for shifting location of installation of STP, feasibility to transfer sewage 300 mtr away from its premises, proposal to treat effluent after lease term of land as mentioned in the preceding para gets over, non submission of CLU of newly proposed site of STP, feasibility of providing dual plumbing system and non submission of revised layout from concerned authorities regarding establishment of residential colony. The project proponent has failed to comply with the conditions of NOC granted to it under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Thus, violating the provisions of the said Acts. Accordingly, show-cause notice for refusal of NOC/Consent to Establish under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the project proponent before the Chief Environmental Engineer of the Board on 02/07/2024. The representative of the colony attended the personal hearing and sated that earlier granted consent to establish/NOC of the Board vide no. CTE/Fresh/BAR/2021/1726529 dated 25/11/2021 valid upto 24/11/2022 for development of residential colony namely Green Avenue Phase-2 situated at Vill Handiaya B, in the revenue Sub Tehsil of Barnala, in an area of 37.35 Acre. Further, the project proponent was granted NOC (extension) vide no. CTE/Ext/BAR/2022/20134336 dated 18/11/2022 valid upto 24/11/2024. As the project proponents have another project in the vicinity with STP installed. It was easy to operate both the STPs if they are close to each other. The project proponent shall not sell the plot over which the STP was installed, rather the plot shall be used for welfare of residents or for storage area. The no. of plots shall remain same. The new site for STP taken on lease for 15 years. He further requested to grant the NOC. After hearing the officer of the Board and representative of the industry, Chief Environmental Engineer (B) Patiala decided that : 1. The NOC applied the by project proponent be granted for one year or adequacy of fee, which ever is earlier. 2. The project proponent shall install mechanical composter for the treatment of bio-degrable waste. 3. The project proponent shall develop adequate plantation before generation of any domestic effluent in the colony. 4. The project proponent shall ensure dual plumbing be adopted by the residents of the colony, as per the proposal submitted by project proponent. If approved, the proceedings may be conveyed to the industry as well as Regional Office for ensuring compliance, please.
