File Note: It is submitted that the industry is a large scale red category unit and was granted consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2024/24599222 dated 19/03/2024 upto 31/03/2029 for manufacturing of Horlicks, Boost & their Variants @ 65000 MT/Year & Ghee @ 1825 Metric Tonne/Year by using Milk SNF Control Account @ 1462103 Kg/Year, Calcium Carbonate @ 989303 Kg/Year, Ferric Pyrophosphate @ 103301 Kg/Year, Fine Crystalline Sugar @ 8791290 Kg/Year, Potassium Bicarbonate @ 290037 Kg/Year, Sodium Chloride @ 492665 Kg/Year, Skimmed Milk Powder @ 4424847 Kg/Year, Wheat Flour (Atta) @ 18852384 Kg/Year, Malted Barley @ 11831907 Kg/Year, Milk Fat Control Account @ 695293 Kg/Year, Dark Malt (EBC-20) @ 4092298 Kg/Year, Cereal Extract-12 @ 18812653 Kg/Year, Wheat Gluten @ 1597188 Kg/Year, Potassium Iodate @ 199 Kg/Year, Isolated Soy Protein @ 329768 Kg/Year, Light Magnesium Oxide @ 23441 Kg/Year, Magnesium Chloride @ 60789 Kg/Year, Zinc Sulphate @ 26064 Kg/Year, Sodium Bicarbonate @ 83435 Kg/Year, New Oily Vitamin Pr @ 54829 Kg/Year, Sodium Selenite @ 135 Kg/Year, Copper Sulphate-IP @ 1736 Kg/Year, Whey Powder (Wet) @ 742971 Kg/Year, Ascorbic Acid @ 88600 Kg/Year, New Dry Vitamin @ 75886 Kg/Year, Whey Powder (dry) @ 1513753 Kg/Year as raw material subject to certain conditions mentioned therein. Simultaneously, the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/PTA/2024/24562869 dated 19/03/2024 for a short period i.e. upto 30/09/2024 with usual conditions and special condition that: 1. The industry shall provide system for uniform distribution of treated wastewater in ECO garden maintains outside its premises. 2. The industry shall provide more water intensive plants such as Eucalyptus in its plantation area so as to increase the utilization of treated wastewater. 3. The industry shall provide thick plantation area along the boundary wall within its premises. 4. The industry shall provide permanent sprinklers in the green area within the premises, so as to properly utilize in the treated wastewater. Now, the industry has applied for obtaining renewal of consent to operate under the Water Act, 1974 through OCMMS alongwith requisite document. The industry had already deposited Rs. 14,10,000/- vide UTR No. HSBCN24020094672 dated 20.01.2024 as air consent fee against the fixed assets of Rs. 22952 (lakhs) as on 31.03.2023 dated 11.01.2024, which is adequate upto 31.03.2029. The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith consent to establish earliest granted. Now, the industry was visited by the EE, AEE and JSO of the Board on 16.07.2024 to check the contents of application submitted by the industry and contacted Sh. S.P. Punia, (Engineering Head), at site. During visit, it was observed as under: 1. The industry is a food processing unit and was found in operation. 2. The industry has installed bio-mass fuel based boiler of capacity 20.0 TPH, which is equipped with ESP as APCD and was found in operation. 3. The industry has also installed 2 no. boilers on standby mode of capacity 10.0 TPH each, which are equipped with cyclone separator as APCD. 4. The industry has provided 4 no. tube-wells for source of fresh water. As per record, the industry has utilized 13251 KL for the period 31.01.2024 to 21.02.2024. 5. The effluent generated from washing, CIP, boiler blow down, cooling tower blow down & domestic effluent is being fed to ETP through single line. 6. The ETP installed by the industry was found in operation. 7. The treated effluent from the ETP is transfer to plantation (2 lines) & to RO plant (1 line). All the three lines are provided with separate water meter. 8. The backwash of ACF and MGF is now being feed to equalization tank. 9. The RO reject is also transferred to equalization tank and the line of same is equipped with TDS meter. 10. The industry has provided ECO plantation area in approx 8.0 acres, outside the premises for utilization of treated effluent. The industry has now provided additional 3000 Eucalyptus plants as per Karnal Technology in the plantation area and has also has also prepared a chart regarding day wise distribution of treated wastewater into the different pockets of plantation area. 11. During visit, no stagnation was observed in the plantation area. 12. The industry has also provided additional 500 neem plants in the plantation area inside the premises, which is also used for utilization of treated waste water. Moreover, the industry has also provided sprinklers in the plantation area for usage of treated waste water. As per record, file, emission and effluent sampling of the industry was recently carried out by 21.02.2024 & 30.04.2024 and the results which are tabulated below: Sr. No. Point of sample collection Parameter Results Prescribed standards 1. It is pertinent to mention here that a complaint was received from Sh. Aman Garg, resident of Nabha, Distt. Patiala through PGRS portal vide grievances ID No. 20240335355 & ID No. 20240320820 regarding the black smoke and air pollution being caused by the subject cited industry. During visit, grayish smoke was found coming momentarily from the stack of the industry, which disappeared after few minutes. Moreover, emission samples were collected from the industry and were sent to Head Office Lab for analysis purpose. The analysis results of the same are awaited. Moreover, a copy of a legal notice sent to HUL, Nabha by Sh. Sarvinder Singh Grewal, Advocate Nabha on behalf of Sh. Paramjit Singh Goraya, IPS retired has been received in this office, wherein, it has been mentioned that the house of the appellant is adjoining to the site of the ETP installed by the industry and therefore, the appellant is facing issues of smell and noise generated due to operation of the ETP. Now, HUL Nabha has submitted a copy of its reply sent to the appellant w.r.t its legal notice to the industry (copy enclosed). In order to reduce the smell issue, the industry has provided enclosure around the fat trap and is also working to provide spray system on equalization tank to reduce the odour generated from the same. The industry has already provided enclosure around the blowers of the ETP so as to reduce its noise level. Further, no action is required to be taken by this office in legal notice matter, as the Board is not made an respondent. In view of above, it is found that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974. However, the matter w.r.t complaint through PGRAMS portal is related with the air pollution only. Keeping in view of the above, may if approved, recommendations may be sent to competent authority that: 1. Renewal of consent to operate under the Water Act, 1974 may be granted to the industry upto 31.03.2029 with usual conditions as per policy of the Board. 2. The matter regarding a compliant received through PGRS portal may be dealt separately through e-note after receiving of results of the stack emission sample collected by Board's laboratory on 16.07.2024.
