It is intimated the industry is a small scale orange category washing unit and was earlier granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/LDH3/2023/20851390 dated 14.02.2023 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH3/2023/20851474 dated 14.02.2023 for Washing of Knitted Cloth @ 1T/day with discharge of trade effluent @ 5.8 KLD and domestic effluent @ 0.2 KLD into CETP 50 MLD, which were expired on 13.08.2023.
Thereafter the industry had applied for renewal consent to operate under Water Act, 1974 & Air Act, 1981, while processing the CTO the industry was issued SCN for refusal of consent to operate under Water Act, 1974 & Air Act, 1981 with an opportunity to submit reply within 07 days. The industry failed to submit any reply therefore the consent applications were refused. Thereafter, notice u/s 33-A of the Water Act, 1974 as amended in 1988 and u/s 31-A of the Air Act, 1981 as amended in 1987 was issued to the industry with opportunity of personal hearing before the CEE on 28.02.2024. But no one from the industry attended the hearing.
Accordingly, direction u/s 33-A of Water Act, 1974 & 31-A of Air Act, 1981 were issued to the PSPCL authorities to disconnect the electric connection of the industry vide no. 2512 dated 19.04.2024.
In compliance of above said directions PSPCL had disconnected the electric connection of the industry vide TDCO no. 274/52 dated 20.05.2024.
Now the industry has applied for varied of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for washing of Knitted Cloth @ 1T/day with discharge of trade effluent @ 3.8 KLD and domestic effluent @ 0.2 KLD into CETP 50 MLD. The industry had already deposited Rs. 15900/- (7,700/- Water + 6600/- penalty +1100/- NOC + 500/- Form Fee) vide UTR no. SBIN222274545006 dated 01.10.2022under the Water (Prevention & Control of Pollution) Act, 1974 & Rs. 7700/- vide UTR no. SBIN222274540988 dated 01.10.2022 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 31.05.2029 under both acts.
The industry has submitted the requisite documents as required for obtaining consent to operate of the Board. The details are as under:-
A) The industry has submitted the area classification certificate from the DTP, Ludhiana vide no. 2396/DTP-(L)/M2A dated 29.09.2022 stating that the site is situated in the Industrial Land Use Zone.
B) The industry has submitted certificate from Company Secretaries stating that 4 KL shares has been DEMAT.
C) The industry has earmarked the location of its submersible pumps on map.
The industry was visited by the AEE of this office on 19.07.2024 and observed that:-
1. The industry was not in operation during visit as the electric connection was not intact.
2. The industry has installed one winch machine for washing process, one hydro and two pole dryer only.
3. The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its trade & domestic effluent. The industry has provided the flow meter at its final outlet leading to CETP.
4. The industry has installed one wood based baby boiler with adequate stack height. The industry has made an agreement for disposal of its boiler ash in low lying area.
5. The industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of above, it is recommended that:
1. Varied Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry temporarily for the period of six months.
2. Directions be issued u/s 33-A of the Water Act, 1974 & 31-A of the Air Act, 1981 maybe issued to the PSPCL Authorities to restore the electric connection of the industry for the period of six months.
