File Note: It is intimated that the stone crusher was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 which were valid upto 30.09.2028 with conditions mentioned therein. Thereafter the stone crusher was given personal hearing before the Addl. Senior Environmental Engineer on 05.03.2024, wherein it was decided that: 1. The stone crusher shall comply with the code of practice prescribed for stone crusher within 10 days. 2. The Asstt. Environmental Engineer shall verify the contentions and visit the stone crusher after 15 days. In compliance, of the decisions of the personal hearing, the stone crusher was visited by officer of this office on 18.04.2024 and observed that the stone crusher is not complying with the code of practice prescribed for stone crushers. Accordingly, the consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 were revoked / cancelled vide no. 1092 dated 29.04.2024. Now, the stone crusher has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has already deposited Rs. 51000/- vide UTR No. SBIN123261556133 dated 22.09.2023 under Air Act, 1981 & Water Act, 1974. The fee submitted by the industry is adequate upto 30.09.2027. The stone crusher was visited by the officer of this office on 16.07.2024 and observed that : 1) The Stone crusher was not in operation during visit. 2) The stone crusher has covered the dust emitting points. 3) The stone crusher has properly provided conventional chutes at the end of conveyor belts. 4) The stone crusher needs to plant more trees around the boundary. 5) The stone crusher has provided sprinklers at movement area of the vehicles. 6) The stone crusher has installed 01 No. Submersible pump for water extraction with water meter. 8) The stone crusher is complying with the code of practice prescribed for stone crushers. 9) The stone crusher has already submitted bank guarantee of Rs. 1.00 bearing no. 342700ILG000323 dated 30.09.2023 which is valid upto 30.09.2028. May if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the stone crusher for the period upto 30.09.2025 with suitable conditions and with special condition that: 1. The stone crusher shall comply with the orders of NGT in O.A. No 57/2020 or any relevant orders of Competent Authority in related matter. 2. The stone crusher shall comply with the Punjab stone crusher policy 2022 implemented by Govt. of Punjab vide notification no. 5217/Crusher Policy dated 16/08/2022. 3. The stone crusher shall maintain the plantation cover around the periphery so as to comply with the code of practice. 4. The industry shall provide more plantations around the periphery of the stone crusher. 6. The consent is valid for the crushing / production of raw material as allowed in the consent. 7. The stone crusher shall submitted approved building from the concerned Department. 8. The stone crusher shall maintain a stock register to justify the legitimate source of Mining Material, its availability, uses and sales etc. 9. The industry shall obtaining the registration from Mining Department. 10. The industry shall comply with the code of practice prescribed by the Board. 8. The industry shall comply with the Punjab Minor Mineral (First Amendement) Rules, 2022 vide notification 29.10.2022 issued by the Department of Water Resources. 11. The stone crusher shall comply with the latest environmental guidelines for stone crushing units issued by CPCB in July, 2023 (Competency lies with EE)
