1. It is intimated that the industry is a small scale Orange category rice sheller unit.
2. Earlier, the consent to operate was granted to the industry (Applicant Sh. Sukhwinder Singh, (Partenr) S/o Sh. Pargan Singh) under Water (Prevention & Control of Pollution) Act, 1974 vide No. CTOW/Renewal/JAL/2019/10433351 & Under Air (Prevention & Control of Pollution) Act, 1981 Vide No. CTOA/Renewal/JAL/2019/10433266 dated 01.07.2019 valid upto 30.09.2023 for the production of Raw Rice @ 64.0 T/day, Rice Husk @ 23.0 Kl/Year, Rice Bran @ 6 T/day with using of Paddy @ 3 TPH as raw material with suitable conditions mentioned therein.
3. Now the applicant Sh. Jasbir Singh Ghuman S/o Husin Singh Ghuman has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act 1974 & Air (Prevention & Control of Pollution) Act, 1981 due to change in ownership as it has now converted into partnership deed & the partners are Sh. Jasbir Singh Ghuman S/o Husin Singh Ghuman, Sh. Harjit Singh S/o Husin Singh Ghuman & Sh. Husin Singh Ghuman S/o Mehnga Singh.
4. The industry has deposited fee Rs. 42000/- Vide UTR/Reference No. KKBKH23229749202 dated 17.08.2023 Under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 42000/- vide UTR/Reference No. KKBKH23229737570 dated 17.08.2023 under Air (Prevention & Control of Pollution) Act, 1981 along with Rs. 500/- as application form fee The industry has deposited NOC Regulation fee of Rs. 3600/- vide Receipt No. 622702065 dated 25.08.2023 which is adequate upto 30.09.2028.
5. The industry has submitted undertaking that earlier Sh. Sukhwinder Singh S/o Sh. Pargan Singh was partner and now he has taken retirement. Sh. Jasbir Singh Ghuman has given Undertaking in which it is mentioned that the increase in fixed assets occurs due to change in ownership as we have purchased the Sheller in 130.26 Lakhs as the price of land & Building value is Rs. 60,05,000/- The registered deed for the same has been attached in consent case. we have also deposited the NOC regularization fee.
6. The industry was visited by officer of this office on 18.07.2024 & observed that:-
• The Sheller was not in operation due to off season.
• The industry has installed one drier and one shelling section along with Cyclone Separator with each separately as APCD.
• The industry has provided stabilized movement area and developed plantation area along the boundary wall. The representative was guided to provide more plants in its premises.
• The domestic effluent is being discharged onto land for plantation after passing through septic tank.
• The industry has provided Sheets in front of rice husk discharge area.
Recommendation: - Keeping in view of above, it is recommended that fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.09.2028 with suitable conditions and special conditions that: -
1. The industry will comply with code of practice prescribed by secretary to Government of Punjab, Department of Science Technology and Environment issued by no. 1532 dated 15.10.2013.
2. The rice sheller will obtain necessary permission from Central Ground Water Authority for extraction of ground water.
3. The industry will be bound to comply with the zoning regulation of the master plan in force and the grant of consent by the Board will not vest any right on the industry w.r.t. other stipulations by any authority or the zoning regulations of the master plan.
4. The industry is bound to comply with the zoning regularizations of Master Plan as and when notified and Board will not be liable for any loss incurred in case site falls under non-conforming zone.
5. The industry shall not made any expansion/production/addition of any land & machinery without prior permission from the Board.
6. The rice sheller shall submit sample analysis report of shelling and dryer section from Board’s Lab.
7. The industry shall install or upgrade the air pollution control device to achieve the amended emission standards, if any amendment made.
