File Note: It is submitted that the industry has been granted ‘consent to operate’ for name and style M/s Poonam Drums & Containers Pvt. Ltd., and owner name Sh. Izazahemed mujibullah choudhary under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2020/13873170 dated 30/10/2020 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2020/13873110 dated 30/10/2020, having validity upto 30/06/2024 for C.R.C.A Metal Containers @ 1500 Numbers/Day as products subject to certain conditions mentioned therein. Now, the industry has applied for fresh ‘Consent to Operate’ under name and style M/s Poonam Drums & Containers Packaging Pvt. Ltd., and owner of the industry namely M/s Mohammad Daniyal Chaudhary under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, alongwith requisite documents. The industry has deposited consent fee Rs. 50900/- vide UTR no. IDIBH24177324927 dated 25.06.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 42000/- vide UTR no. IDIBH24177325083 dated 25.06.2024 under the Air (Prevention & Control of Pollution) Act, 1981, (Considering NOC regularization fee), which is adequate upto 31.12.2028 against the assets of Rs. 1.44 cr. dated 21.06.2024. While processing the application, an online clarification was raised on 09.07.2024, in reply to which the industry has submitted as under: Reference to the clarification raised on the application submitted for grant of fresh consent to operate, our point wise reply is submitted a under: 1. Reason for submission of application for grant of fresh consent to operate, it is due to change of owner and change of company name from M/s. Poonam Drums & Containers Pvt. Ltd. to M/s. Poonam Drums & Containers Packaging Pvt. Ltd. and the new company has taken the total assets up on lease. 2. We have already uploaded the compliance of earlier consent to operate granted to the company. However, we are again submitting the same. We hope you will find this in order and grant us consent to operate at the earliest. The industry has submitted a copy of lease deed dated 21.06.2024 executed between M/s Poonam Drums & Containers Pvt. Ltd., and M/s Poonam Drums & Containers Packaging Pvt. Ltd., which is valid upto 30.06.2029. Visit: Accordingly, the industry was visited by AEE of this office on 05.07.2024 and during visit, it was observed as under: 1. The industry is engaged in manufacturing of C.R.C.A Metal Containers and was in operation. The industry is using metal sheet as raw material in its process. 2. The industry is not carrying out any trade effluent generating process in its premises. 3. Source of supply is PSIEC and flow meter is installed on the same. 4. Domestic effluent is being discharged into PSIEC sewer. 5. The industry has installed one no. paint booth in its premises, which is provided with water curtain as APCD. 6. The industry has installed one no. LPG fired drying oven in its premises. 7. The industry has provided 01 no. of DG set 125 KVA, which are equipped with canopy and stack of adequate height. From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In view of above, if may approved, the industry may be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 30.09.2028 with usual conditions & with following special conditions: 1. The industry shall not carry out any activity in its premises which can change the category of unit from Orange to Red. 2. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, within 07 days. 3. The industry shall not generate and discharge any kind of trade effluent from its premises. The industry shall generate only domestic effluent, which shall be discharged into PSIEC sewer. 4. The industry shall not carry out any metal surface finishing process in its premises. 5. The industry shall not carry out any activity in its premises, which is covered under the ambit of EIA notification dated 14.09.2006. 6. The industry shall not install any boiler or furnace in its premises without prior permission of the Board. 7. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received. 8. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 9. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances. 10. The industry obtain permission from PWRDA for abstraction of groundwater (if required) and shall comply with the guidelines issued by PWRDA from time to time. 11. The industry shall get its final building plan approved from Director of Factories within 02 months and shall submit a copy of the same to the Board within 15 days thereafter. 12. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received. 13. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 14. The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry. 15. The adequacy/ efficacy of the pollution control and disposal arrangements shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 16. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 17. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
