The industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, under Green Category for operation of an industrial unit for Packaged Drinking Water @ 5.6 Kilo Liters/Day and PET Bottle @ 7000 Numbers/Day as products, along with requisite document.
The industry has established its unit without obtaining Consent to establish from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has deposited Rs. 44800/- vide UTR no. P213230257232100 dated 01.08.2023 and Rs. 25600/- vide UTR no. BKIDY24185972860 dated 03.07.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 51700/- vide UTR. no. P213230257228230 dated 01.08.2023 and Rs. 25600/- vide UTR no. BKIDY24185972605 dated 03.07.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto (considering for NOC regularization fee and Penalty), which is valid upto 31.12.2027 for both the Acts against the fixed assets of Rs. 157.00 lakhs on 21.06.2024.
Suitability of Site:
The industry has submitted a copy of land use classification letter issued by DTP SAS Nagar vide letter no. 923 dated 25.06.2024, wherein, it has mentioned as under:
“ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਧਿਨ ਹਵਾਲੇ ਤਹਿਤ ਪ੍ਰਾਪਤ ਪੱਤਰ ਦੇ ਨਾਲ ਨੱਥੀ ਦਸਤਾਵੇਜ਼ਾਂ ਦੇ ਸਨਮੁਖ ਸੂਚਿਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਮੌਰ ਠਿਕਰੀ (ਹ.ਬ. 361) ਤਹਿਸੀਲ ਜ਼ੀਰਕਪੁਰ, ਜਿਲ੍ਹਾਂ ਐਸ.ਐ.ਐਸ ਨਗਰ ਵਿਖੇ ਪੈਦੇ ਖਸਰਾ ਨੰਬਰ 14//23(7-14), 24(7-12) ਅਤੇ 21//4 (3-4) ਕੁੱਲ ਰਕਬਾ 18 ਕਨਾਲ 10 ਮਰਲੇ (ਲਗਭਗ 2.31 ਏਕੜ) ਦਫਤਰੀ ਰਿਕਾਰਡ ਵਿੱਚ ਉਪਲੱਬਧ ਮਾਸਟਰ ਪਲੈਨ ਜ਼ੀਰਕਪੁਰ ਅਨੁਸਾਰ ਇੰਡਸਟ੍ਰੀਅਲ ਲੈਡ ਯੂਜ਼ ਜ਼ੋਨ ਅਧਿਨ ਪੈਂਦਾ ਹੈ। ਉਕਤ ਰਕਬਾ ਐਫ.ਈ.ਜੈੱਡ ਬਾਊਡਰੀ ਅਧਿਨ ਹੈ। ਕਿਉਜੋ ਆਪ ਦੀ ਪ੍ਰਤੀਬੇਨਤੀ ਵਿੱਚ ਇਹ ਸਪਸ਼ਟ ਨਹੀ ਹੈ, ਕਿ ਉਕਤ ਸਾਇਟ ਕਿਸ ਮੰਤਵ ਲਈ ਵਰਤੀ ਜਾਣੀ ਹੈ, ਇਸ ਲਈ ਸਾਈਟ ਦੀ ਪ੍ਰਮਿਸੀਬਿਲਟੀ ਸਬੰਧੀ ਟਿਪਣੀ ਨਹੀ ਕੀਤੀ ਜਾ ਸਕਦੀ। ਸਾਈਟ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਐਕਟੀਵੀਟੀ ਕਰਨ ਤੋ ਪਹਿਲਾ ਉਸ ਸਬੰਧੀ ਮੰਨਜੂਰੀ ਸਬੰਧਤ ਸਰਕਾਰੀ ਅਦਾਰਿਆ ਤੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਅਤੇ ਰਕਬੇ ਦੀ ਮਾਲਕੀ/ਕਬਜ਼ੇ ਸਬੰਧੀ ਵਖਰੇ ਤੌਰ ਤੇ ਮਾਲ ਵਿਭਾਗ ਪਾਸੋ ਤਸਦੀਕ ਕਰਵਾਉਣ ਦੇ ਆਪ ਪਾਬੰਦ ਹੋਵੇਗਾ। ਇਸ ਤੋਂ ਇਲਾਵਾ ਉਕਤ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਆਪ ਵੱਲੋ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜਾਂ ਦੇ ਸਨਮੁੱਖ ਜਾਰੀ ਕੀਤੀ ਗਈ ਹੈ।
ਇਸ ਪੱਤਰ ਨੂੰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸਰਟੀਫਿਕੈਂਟ ਹੀ ਸਮਝਿਆ ਜਾਵੇ। ਇਸ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਨੂੰ ਸਾਈਟ ਦੀ ਮਾਲਕੀ ਦਾ ਸਬੂਤ, ਸੀ.ਐਲ.ਯੂ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾ ਕਿਸੇ ਕਿਸਮ ਦਾ ਐਨ.ਓ.ਸੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।”
As such, as the site falls under industrial land use of Master Plan, Zirakpur, thus, site is suitable.
The industry has also submitted a copy of building plan signed by Sh. Ashok Tayal, Competent Person of Director of Factories of Punjab.
The industry has submitted partnership deed dated 01.01.2018 between Sh. Digvijay Singh s/o Sh. Shivajee Prasad Singh and Sh. Pratima Singh w/o Sh. Digvijay Singh.
The unit has submitted a copy of the sale deed dated 04.12.2017 executed between Sh. Kulbir Chauhan s/o Sh. Jagdish Singh (1st party) and Sh. Digvijay Singh s/o Sh. Shivajee Prasad Singh (2nd party) for khasra nos. 14//23 (7-14), 24 (7-12), 21//4 (3-4).
Visit:
Accordingly, the industry was visited by AEE of this office and during visit, it was observed as under:
1. The unit was in operation during the visit and was engaged in packaging Drinking Water in PET Bottles.
2. The source of freshwater is tubewell and flow meter has been installed with the same.
3. The industry generates RO reject as effluent and the same is collected in a tank. From the said tank, the industry checks the TDS of the effluent and thereafter, the same is used for flushing purpose inside its premises and rest is discharged onto land for plantation developed along the boundary wall.
4. During visit, TDS of RO reject was checked and was found to be 850 mg/ltr. thus, making its suitable for dual plumbing and plantation purpose. The industry was advised to maintain record of daily measurement of TDS, at all times.
5. The domestic effluent is discharged onto land for plantation along the boundary wall after passing through septic tank.
6. The industry has installed 01 no. DG set of capacity 230 KVA which is provided with canopy and stack of adequate height.
7. The industry has not installed any boiler or furnace or any other source of air pollution in its premises
From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, the industry may be granted ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 31.12.2027 with usual conditions & with following special conditions:
1. The industry shall not start any new process within its unit which may change its category from Green to Orange/Red category, without the prior written permission of the Board.
2. The industry obtain permission from PWRDA for abstraction of groundwater and shall comply with the guidelines issued by PWRDA from time to time.
3. The industry shall generate domestic effluent, which shall be discharged onto land for plantation within premises.
4. The industry shall maintain daily record of the TDS of RO Reject and shall use the same only for dual plumbing and for plantation purpose within its premises.
5. The industry shall not carry out any activity in its premises, which is covered under the ambit of EIA notification dated 14.09.2006.
6. The industry shall not install any boiler or furnace or any source of air pollution in its premises without prior permission of the Board.
7. The industry shall not use any fuel in its premise except HSD for operation of DG set of capacity 230 KVA.
8. The industry shall comply with the by-laws of the Master Plan, Zirakpur and stipulation of Department of Town and Country Planning, at all times.
9. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
10. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances.
11. The industry shall get its final building plan approved from Director of Factories within 02 months and shall submit a copy of the same to the Board within 15 days thereafter.
12. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received.
13. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
14. The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry.
15. The adequacy/ efficacy of the pollution control and disposal arrangements shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
16. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
17. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
