It is submitted that the industry is an existing rice sheller unit in an area of 21 kanals 4 marlas bearing khasra no. 61//5/2(2-2) 6/1(2-9) 6/2(5-11) 15min(5-11) 60//11min(5-11), in the revenue estate of Vill. Bhinder Kalan, Tehsil Dharmkot, Distt. Moga. The industry has valid consent to operate under the Water Act, 1974 and the Air Act, 1981 valid for a period upto 30.09.2026 for manufacturing of raw rice @ 3 TPH with dryer alongwith sortex machine of capacity 3 TPH, subject to the conditions mentioned therein. …………
Now, the industry has applied for consent to establish (NOC for expansion) under the Water Act, 1974 and the Air Act, 1981 for increase in production capacity to manufacture raw rice with dryer @ 5 TPH as well as expansion in the land area of 11 kanal 02 kanal. Details of the case under:- …………….
• In reference to this office letter no. 2452 dated 21.06.2023, the DTP Moga vide letter memo no. 652 DTP(Moga)/RS-1 dated 05/07/2024 has issued report regarding siting criteria for increase of land area of existing rice sheller unit in an area of 11 kanals 2 marlas, bearing khasra nos. 61//4(7-1) 5/3(3-2) & 7/1 min(0-19), in revenue of village Bhinder Kalan (H.B. No. 292), Tehsil & District Moga, which is reproduced as under:-
1. ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਕਿਸੇ ਵੀ ਫੋਕਲ ਪੁਆਇੰਟ ਅਤੇ ਡੈਜੀਗਨੇਟਡ ਇੰਡਸਟਰੀਅਲ ਜੋਨ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀ ਹੈ।
2. ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ, ਧਰਮਕੋਟ ਵਿੱਚ ਪੈਂਦੀ ਹੈ । ਜਿਸ ਨੂੰ ਕੋਰੀਜੰਡਮ ਹਿੱਤ ਭੇਜਿਆ ਗਿਆ ਹੈ ਅਤੇ ਮਾਸਟਰ ਪਲੈਨ ਹਾਲ ਦੀ ਘੜੀ ਨੋਟੀਫਾਈਡ ਨਹੀਂ ਹੈ। ਸਾਈਟ ਕਿਸੇ ਵੀ ਨਾਨ-ਸਟੈਚੂਰੀ ਮਾਸਟਰ ਪਲੈਨ ਦਾ ਹਿੱਸਾ ਨਹੀਂ ਹੈ । ਸਾਈਟ ਕਿਸੇ ਵੀ ਪ੍ਰਵਾਨਤ ਮਾਸਟਰ ਪਲੈਨ ਦੀ Urbanisable Limit ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਨਹੀਂ ਪੈਂਦੀ । ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦੇ 2 ਕਿਲੋਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕਿਸੇ ਸ਼ਹਿਰ ਦੀ Local Body Limit ਨਹੀਂ ਪੈਂਦੀ ਹੈ।
3. ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕੋਈ ਬਾਈਪਾਸ / ਨੈਸ਼ਨਲ ਹਾਈਵੇ / ਸਟੇਟ ਹਾਈਵੇ ਅਤੇ ਸ਼ਡਿਊਲਡ ਰੋਡ ਨਹੀਂ ਪੈਂਦੀ ਹੈ । ..................
• In reference to this office letter no. 2453 dated 21.06.2023, the revenue department has report regarding siting criteria, countersigned by the Tehsildar Dharamkot, which is reproduced as under:-
“ਬੇਨਤੀ ਹੈ ਕਿ ਪੱਤਰ ਨਾਲ ਸਬੰਧਿਤ ਵਾਕਿਆ ਰਕਬਾ ਪਿੰਡ ਭਿੰਡਰ ਕਲਾਂ ਤਹਿ: ਧਰਮਕੋਟ, ਜਿਲ੍ਹਾ ਮੋਗਾ ਜਮਾਬੰਦੀ ਸਾਲ 2021-22 ਦੀ ਅਰਾਜੀ ਨੰਬਰਾਨ ਖਸਰਾ 61//4(7-1) 5/2(2-2) 5/3 ਮਿਨ (1-0) 7/1(0-19) ਕੁੱਲ ਰਕਬਾ 11 ਕ -2 ਮ (ਗਿਆਰਾ ਕਨਾਲ 2 ਮਰਲੇ) ਜਿਸ ਦੀ ਮੁਸ਼ਤਰਕਾ ਮਾਲਕਾਨ ਵਿੱਚ ਮਾਲਕੀ ਫਰਮ ਮੈਸ: ਸ੍ਰੀ ਗਣੇਸ਼ ਐਗਰੋ ਫੂਡਜ਼ ਭਿੰਡਰ ਕਲਾਂ ਤਹਿ: ਧਰਮਕੋਟ ਜਿਲ੍ਹਾ ਮੋਗਾ ਦੀ ਹਸਬ ਹਿੱਸਾ ਹੈ ਜੋ ਕਿ ਪਿੰਡ ਦੀ ਫਿਰਨੀ / ਲਾਲ ਲਕੀਰ ਤੋਂ 500 ਮੀਟਰ ਬਾਹਰ ਹੈ ਅਤੇ ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਘੇਰੇ ਵਿੱਚ ਚਿੜੀਆਘਰ, ਮੰਜੂਰਸ਼ੁਦਾ ਰਿਹਾਇਸ਼ ਏਰੀਆ, ਧਾਰਮਿਕ ਇਤਹਾਸਿਕ ਸਥਾਨ, ਵਿਦਿਅਕ ਅਦਾਰਾ, ਜੰਗਲੀ ਜੀਵਾਂ ਦੇ ਰੱਖ ਰਖਾਵ, ਪ੍ਰੋਟੈਕਟ ਮੋਨੋਮੇਨਟ ਸਥਾਨ ਆਦਿ ਨਹੀਂ ਆਉਂਦਾ ਹੈ ”………..
• The industry has submitted project report showing expansion value of the proposal as Rs. 21.50 Lakhs. Accordingly, the industry has deposited Rs. 1800/- vide online R. No. 903101556 dated 15.07.2024, which is adequate for a period of one year. ………
• The industry has submitted copy of registered sale deed for the additional land to its name………..
• The industry has submitted feasibility report regarding proposed air pollution control device to be provided with the paddy pre cleaner section. As per which, the industry has proposed to install cyclone separator as APCD, which is adequate to achieve the prescribed standards. …………….
• The industry has submitted aks sijra showing the existing and additional land area………..
To process the application, the industry was visited by undersigned (AEE) of this office on 19.07.2024 and it was observed as under:-…………….
1. The industry was not in operation during the visit due to non-availability of paddy. The site is located adjacent to the existing premises of the industry. …
2. The industry has constructed boundary wall. ….
3. The industry has proposed to install cyclone separator as APCD for additional paddy cleaner of dryer section. In this regard, the industry shall also submitted feasibility report.
4. The industry does not propose to use any water in the process, thus no trade effluent will be generated from the process. …..
5. No Electric wire is passing over the site. …….
6. The industry has submitted copy of project report, feasibility report, partnership deed, sale deed of land, verification report issued by DTP, Tehsildar report, aks sijra and latha…………………
From the above, it is clear that the industry is meeting with the specific siting guidelines prescribed by the Board for the expansion of a rice sheller unit, as per Deptt of Science Technology & Environment Govt. of Punjab Order No. 10/48/2004/STE(4)/932 dated 15.10.2013. The competency for grant of NOC to Rice sheller with or without dryer and saila plants lies with the Environmental Engineer of Regional office, as per Board circular no. 23539-76 dated 03.06.2013……….
Keeping in view of above, if approved, the consent to establish (NOC) for expansion in the existing Rice sheller unit for addition in land area of 11 kanals 2 marlas, bearing khasra nos. 61//4(7-1) 5/3(3-2) & 7/1 min(0-19), in revenue of village Bhinder Kalan (H.B. No. 292), Tehsil & District Moga to manufacture raw rice with dryer @ 5 TPH alongwith sortex machine of capacity 3 TPH of sorted rice may be granted to the industry for one year with suitable conditions as per policy of the Board and following special conditions:-
1. The industry shall comply with the terms and conditions mentioned in the DTP letter issued vide no. 652 DTP(Moga)/RS-1 dated 05/07/2024.
