File Note: It is submitted that the HCF had obtained authorization vide no. BMW/Renewal/LDHKH/2024/24584195 dated 03/01/2024, which was valid upto 31/03/2028 under BMW Rules, 2016 for generation, segregation and storage of bio-medical waste for 09 no. of beds subject to the suitable conditions and additional conditions mentioned therein. Now, the HCF has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for 09 no. beds along with the following documents submitted by it: 1. BMW manifests. 2. Location & site plan. 3. The HCF has submitted an agreement for 09 no. of beds executed with the Common Bio Medical Waste Treatment Facility namely M/s s Medicare Environmental Management Pvt.Ltd., Opps. Central Jail, Tajpur Road, Ludhiana for collection, transportation, treatment and disposal of bio-medical waste generated by it. The agreement is valid upto 31/12/2028. 4. The HCF has not installed any ETP. However, the HCF falls within the MC limit and it is connected to terminal STP of Khanna. It has submitted monthly fee charges receipt vide no. 06/2023-24/675 dated 05/06/2023 issued by Municipal Council, Khanna as documentary evidence The HCF has deposited Rs. 11,000/- vide UTR No. N180243116287351 dated 28.06.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 11,000/- vide UTR No. N180243116228741 dated 28.06.2024 under the Air (Prevention & Control of Pollution) Act, 1981. As such, according to Board's order no. EPA/2017/No. 2235-59 dated 07/07/2017, the fee deposited by the HCF is adequate upto 31.03.2028 under both the Acts. The Board vide office order no. 329 dated 14/09/2023 has decided to facilitate the entrepreneur with “Auto generation of renewal of consent to establish/operate/authorization of any category of small-scale industries/Project/ Health Care Facilities (upto 50 beds) and Hazardous waste generating industries” on the basis self-deceleration by these of entrepreneur and shall be without any inspection/physical verification of the officers of the Punjab Pollution Control Board. As per PPCB office order no. 379 dated 23.10.2023, it has been decided that HCFs up to 30 bed capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plants (STPs) have been installed, shall be granted consents to operate under the Water Act, 1974 and the Air Act, 1981 as well as authorization by Punjab Pollution Control Board (PPCB) without installation of individual ETPs, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio-medical Waste Management Rules, 2016 as amended up to date and subsequent amendments, if any. Further, the Board vide letter no. 1955-57 dated 18/01/2023 has informed that department of Water Resources (RD and GR), Central Ground Water Authority, Ministry of Jal Shakti Govt. of India, New Delhi under Section 5 of the Environment (Protection) Act, 1986 has issued directions vide order dated 6/4/2022 that “It shall be mandatory for the project proponent abstracting ground water to obtain No objection Certificate from Central Ground Water Authority or the concerned State/UT Ground Water Authority as the case may be in the compliance conditions in consent to operate and consent to establish issued by the State pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions. PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month. In the subject cited case, the Hospital has mentioned ground water extraction @ 3.5 KLD. Considering 30 working days in a month during season, so ground water extraction will be 105 KL/month, which will less than 300 KL/month. As such the unit has not required permission from PWRDA. In view of the facts mentioned above, it is recommended that fresh Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for 09 no. beds may be granted to the HCF upto 31.03.2027 subject to the suitable conditions and following additional conditions: 1. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same. 2. The HCF shall ensure to comply with the effluent standards as notified under Bio Medical Waste Management Rules, 2016 amended upto date and subsequent amendments, if any. 3. The HCF will apply for fresh consent to operate/ authorization if it increases its bed capacity. 4. The HCF shall form a bio-medical waste committee immediately. 5. There is no claim of continuation of HCF in present premises on the basis of this consent. The HCF has to comply with the zoning regulation of master plan & to be shifted from the site as and when asked by the Govt./PPCB/ or any concerned Govt. agency. 6. The HCF shall obtain other statutory approvals required from other departments, if any. 7. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 31st December every year.
