It is submitted that the unit is small scale green category unit was granted consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. R16FGSCTOW3679340 dated 29/02/2016 and R16FGSCTOA3679342 dated 29/02/2016 both are valid upto 30/06/2020 for the manufacturing of MS Round & Square @ 06 MTD.
Now, the industry has applied for varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with requisite documents. The industry has using only PNG as fuel.
The industry has deposited of Rs. 39900/- vide receipt no. 10/5476 dated 28/01/2022 under the both acts and now the industry has deposited of Rs. 6300/- vide no. 854590437 dated 19/06/2024 as water consent fee and Rs. 6300/- vide no. 875676529 dated 19/06/2024 as air consent fee against the fixed assets of Rs. 32.36 Lakhs as on 31/03/2024 as per CA certificate dated 06/06/2024 after deducting the 400% penalty (Rs. 8800/- under both acts) which is adequate upto 31/12/2027 as per order dated 29/10/2018. The industry has deposited NOC Regularization fee of Rs. 1400/- which is adequate.
Further, it is intimated that now the industry has not required to be obtained EC/TORs as the Govt. of India, MoEF & CC issued notification dated 07.06.2024 for exemption of such type of industry for obtaining Environment Clearance under EIA notification dated 14/09/2006.
To verify the contents, the industry was visited by the AEE of this office on 09/07/2024 During the visit, it was observed as under:
1. The industry was in operation during the visit.
2. The industry has installed 01 no. of reverberatory furnace and using PNG as fuel.
3. The industry has engaging in the manufacturing of MS Round & Square @ 08 MTD by using Ship Breaking Materials & Other Reroll-able Materials etc. @ 09 MTD.
4. There is no coal pulverizer available at site.
5. The industry has not installed any DG set.
6. No generation of trade effluent as whole of the water used for the cooling purposes is being re-circulated.
7. There is only generation of domestic effluent which is being discharged onto land for plantation after septic tank.
Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:
"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."
PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the industry has mentioned ground water extraction @ 09 KLD. Considering 25 working days per month, ground water extraction will be 225 KL/month, which is less than 300 KL/month. The industry has no need for obtained permission from PWRDA.
In view of above, if approved it is recommended that the varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of MS Round & Square @ 08 MTD may be granted upto 31/12/2027 with suitable conditions and special conditions as under:
1. The industry shall obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA) if need be.
2. The industry shall not use any other fuel except PNG without prior permission of the Board.
3. The industry shall not install any new machinery in the additional land without obtaining NOC from the Board.
4. The industry shall obtain NOC of the Board, if it changes any of its product/capacity of the plant.
5. The project proponent ensures that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocal or any other non-biodegradable material in the premises.
6. 7. The project proponent properly handles and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
