Subject: Proceedings of the personal hearing given to M/s Target Every One IT Private Limited, Plot no. I-9, Sector 83, Alpha IT City, SAS Nagar (Mohali) w.r.t show cause notice for refusal of consent to establish (NOC) from pollution angle before the Senior Environmental Engineer (ZP-1) of the Board on 19/7/2024

The officer of the Board brought out that the project proponent has applied for applied fresh consent to establish (NOC) from pollution angle under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air(Prevention & Control of Pollution) Act, 1981 for establishment of Commercial project in area of 10240.761 m2 alongwith requisite documents. The project proponent has submitted allotment letter for the allotment ofindustrial plot no. I-9, Sector 83 Alph, IT city , SAS Nagar for IT/ Information Technology Enabled Services (ITES) issued by PSIEC vide no. 49369 dated 22.08.2019 in the name of Target Every One IT Private Limited.
The site of the project was visited by officer of the Board on 29/5/2024 and it was observed that:
1) The construction has started and the project is in foundation stage.
2) The project proponent has started construction work of STP of this project at the site.
3) The project proponent will reuse 22.02 KLD in dual plumbing system and remaining 15.91 KLD will be disposed onto GMADA Sewer Line. But, the project proponent has not submitted any permission obtained from GMADA regarding discharge of treated wastewater into sewer. Thus, project proponent does not have adequate disposal arrangements for treated wastewater.
The project proponent does not have adequate disposal arrangements for treated wastewater. As such, the project proponent is not complying with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. It was proposed to refuse the consent to establish (NOC) applied under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause-cum-personal hearing.
Therefore, the project proponent was served show cause notice for refusal of consent to establish (NOC) from pollution angle from pollution angle under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 vide Board's letter no. 1948-49 dated 11/7/2024 alongwith an opportunity of personal hearing before the Senior Environmental Engineer (ZP-1) of the Board on 19/7/2024.
The representative of the project proponent attended the hearing and submitted written reply which was taken on record. He informed that the IT Sector is being developed by GMADA/ Govt. and the authority have issued plot to the projects with the terms and conditions that the fresh water supply and treated wastewater connection will be provided by GMADA and no separate letter has been issued by the GMADA for allotment of sewer connection/ permission. However, the representative of the project proponent assured that the project proponent shall pursue the GMADA authorities for obtaining the sewer connection permission well before the commissioning of the project.
After hearing the representative of the project proponent and officer of the Board, the Senior Environmental Engineer (ZP-1) of the Board decided that:
1) The project proponent shall get the permission for the sewer connection from the GMADA and submit the same at the time of obtaining consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 to the Board.
2) The project proponent shall not commission its unit before obtaining consent to operate of the Board as required under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.
3) The consent to establish (NOC) application applied by the project proponent shall be granted for one year subject to the conditions as per decision no. 1 and 2 above.
If approved, proceedings of the personal hearing as above may be conveyed to the project proponent and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.
