File Note: It is intimated that, the industry is a small scale red category dyeing unit and was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDH3/2023/20456619 dated 09.01.2023 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/LDH3/2023/20457148 dated 09.01.2023 for dyeing for all type of fabrics (polyester) @ 3 T/day & dyeing for all type of yarn (polyester) @ 2 T/day with discharge of trade effluent @ 460 KLD and domestic effluent @ 0.5 KLD into CETP-15 MLD, which were expired on 30.06.2023. Thereafter industry got auto-renewed its consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 on dated 26.12.2023, valid upto 26.12.2024. Earlier, the industry was visited by officer of this office on 19.12.2023 to verify the complaint received from the office of Sh. Madan Lal Bagga, MLA, Ludhiana (North) regarding problem of fly ash and black emissions in the area around Bahadurke Dyeing Complex. During visit it was observed that the industry was in operation and the same was engaged in the process of dyeing of fabric. The industry has installed one boiler of capacity 6 TPH with multi cyclone separate as APCD with common stack. During visit fuel ash was found here & there all around the boiler section as well as industry premises and the fuel ash handling of the industry was very poor. The industry was found violating the provisions of Air Act, 1981. Accordingly, notice u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing given before the Chief Environmental Engineer, Ludhiana on 28.02.2024. After hearing Competent Authority of the Board was decided as under:- 1. The auto renewed consent to operate obtained by the industry be cancelled due to various violations reported as well as use of unauthorized fuel. 2. The industry shall not burn loose agro waste in its boiler without getting its APCD assessed for its adequacy from an institute of technical repute. 3. The industry shall submit, within 07 days, a Bank Guarantee of Rs. 25,000 /- as an assurance not to emit black smoke from its furnace, at any time in future. 4. The Environmental Engineer, Regional Office-3, Ludhiana shall visit the industry on surprise basis three times and recommend further action in the matter for release of Bank Guarantee accordingly. 5. It was made clear that in case the industry is found emitting black smoke, the Board shall feel constrained to confirm the proposed directions without any further notice/ opportunity. In compliance of the decision no. 1 consent to operate under Air (Prevention & Control of Pollution) Act, 1981 granted to the industry was cancelled. And in compliance of decision mentioned at S.no. 3, industry has submitted a bank guarantee of Rs. 25,000/- in this office. Now, the industry has applied for varied consent to operate under the Water Act, 1974 & Air Act, 1981 for dyeing for all type of fabrics (polyester/PC/Cotton) @ 7 T/day & dyeing for all type of yarn (Polyester/PC/Cotton) @ 5 T/day with discharge of trade effluent @ 498 KLD and domestic effluent @ 2.0 KLD into CETP-15 MLD. The industry has deposit Rs. 17,244/- vide R. No. 171967161 dated 01.08.2023 under Rs. 14,544/- as Water Act, 1974, Rs. 2200/- NOC fee & Rs. 500/- as application form fee, Rs. 79,700/- vide R. no. 22825243 dated 06.11.2023 under Rs. 79,200/- as Water Act, 1974 & Rs. 500/- as application form fee and Rs. 14,400/- vide R. No. 759930219 dated 26.12.2023 under Water Act, 1974 and Rs. 76,100/- vide R. No. 703684018 dated 07.10.2022 under Rs. 75,600/- as Air Act, 1981 & Rs. 500/- as application form fee and Rs. 14,400/- vide R. no. 36795745 dated 26.12.2023 under Air (Prevention & Control of Pollution) Act, 1981, which are adequate upto 30.06.2030 under Water Act, 1974 & 30.06.2029 under Air Act, 1981. The industry has already obtained shares @ 500 KLD from the SPV and had got DEMAT the shares. The industry has submitted the copy of approved building plan from the competent person under Factory Act. The industry was visited by officer of this office on 20.07.2024 and observed that:- 1. The industry was in operation and engaged in the process of dyeing of yarn and fabric. 2. The industry has installed 24 cabinet dyeing machines of capacity (9X60 Kg, 8X90 Kg, 4X30 Kg and 3X120 Kg and 07 soft flow machines of capacity (600 KgX1), (450 KgX3), (300 KgX2), (150 KgX1) & (50 KgX1) within its premises. Out of the 24 cabinet machines, 03 were lying sealed as the same were sealed in compliance of directions issued vide no. 123 dated 13.01.2023. 3. Trade effluent was being collected in collection tank. The entire trade effluent & domestic effluent is being discharged into dedicated sewer system leading to 15 MLD CETP. 4. The industry has installed a digital flow meter at the final outlet leading to CETP and the same was operation during the visit. The industry has also installed SCADA system with digital flow meter provided at final outlet of the industry connected with server of CETP. 5. The record from the online SCADA system was checked and it was found that the average discharge of the industry during the month of April 2024, May, 2024 and June, 2024 were found as 289 KLD, 357 KLD and 332 respectively, which are within the quantum of shares obtained and consent granted. 6. The industry has installed one boiler of capacity 6 TPH with multi cyclone separate as APCD. The industry was using rice husk as fuel. During visit industry was using fuel of good quality and emissions from the stack of the industry were almost clear as no black smoke was being emitted by the industry. 7. The industry has installed one DG set of capacity 320 KVA with canopy inside the premises. 8. The industry is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and conditions of the previously granted consents. It is therefore recommended that varied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 for dyeing for all type of fabrics (polyester/PC/Cotton) @ 7 T/day & dyeing for all type of yarn (Polyester/PC/Cotton) @ 5 T/day with discharge of trade effluent @ 498 KLD and domestic effluent @ 2.0 KLD into CETP-15 MLD may be granted to the industry upto 30.06.2029 with the suitable conditions.
