It is intimated that the industry is medium scale orange category induction furnace unit was granted consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through vide no. CTOW/Varied/FGS/2023/21014077 dated 01/04/2023 and CTOA/Fresh/FGS/2023/21014032 dated 01/04/2023 both are valid upto 30/09/2024 for the manufacturing of Billets (With CCM Plant) Or Round, Square, Hexa and Flats etc. (with rolling mill without reverberatory furnace) @ 78 MT/Day.
It is further intimated that the industry was granted consent to establish (NOC) under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through vide no. CTE/Exp/FGS/2024/24998003 dated 12/03/2024 valid upto 11/03/2025. Now the industry has deposited Rs. 2400/- BKIDN24176259276 dated 24/06/2024 and BKIDN24176257879 dated 24/06/2024 as NOC fee which is adequate.
It is further intimated that the industry was granted Environmental Clearance by Ministry of Environment, Forest and Climate Change (Issued by the State Environment Impact Assessment Authority(SEIAA), PUNJAB) through EC Identification No. EC24B008PB153160 dated 04/01/2024 for install induction furnace of capacity 1 x 10 TPH and 01 no. of rolling mill for the manufacturing of Billets/ round/square/hexa/flats @ 52,500 TPA.
The industry was issued Show Cause Notice on 06/12/2023 at 11:00 AM before the Chief Environmental Engineer (B), Patiala for cancelation of consent to operate under the provision of Air (Prevention & Control of Pollution) Act, 1981 for violating the provision of Air (Prevention & Control of Pollution) Act, 1981 and the proceeding of the same is as under:
After hearing the officers of the Board and representative of the industry, Chief Environmental Engineer (B) Patiala decided that:
1. To improve the efficiency of bag house of the existing APCD, the industry shall up-grade its bag filters in the bag house in the existing APCD as per the specifications given below within one month and shall get it verified/ certified from PSCST, Chandigarh.
2. The industry shall submit the proposal regarding control of Secondary Emissions generated from the process within one month after consultation with the PSCST, Chandigarh.
3. The industry shall submit a bank guarantee amounting to Rs. 2.0 lakh within 7 days as an assurance to comply with the Environmental Laws and Environmental Engineer, Regional Office, Fatehgarh Sahib shall encash 50% of the above said bank guarantee.
4. The industry shall use good quality raw material free from dust and oil.
5. The industry shall develop the adequate green area all around the boundary wall and shall stabilize all of its movement area within the premises of the industry as well as approach around the industry, so as to minimize the dust emissions within one month.
6. A team of the officers shall be constituted by CEE(B) to surprisingly visit the industry to verify the conditions imposed in Environmental Clearance, other compliance of Environmental Laws immediately after one month and shall submit report/ recommendations, thereafter.
7. Environmental Engineer, Regional Office, Fatehgarh Sahib shall verify the compliance of the decisions of the hearing and submit the report/ recommendations after one month.
Now, the industry has applied for varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Billets (With CCM Plant) Or Round, Square, Hexa and Flats etc. (with rolling mill without reverberatory furnace) @ 150 MTD with requisite documents.
As per record of the industry, the consents fee is adequate upto 31/07/2028 and now the industry has deposited of Rs. 146400/- through vide no. BKIDN24176259276 dated 24/06/2024 as water consent fee and Rs. 146400/- through vide no. BKIDN24176257879 dated 24/06/2024 as air consent fee against the fixed assets of Rs. 2034.78 Lakhs as on 31/05/2024 as per CA certificate dated 22/06/2024 which is adequate upto 30/09/2029 and Rs. 91,200/- under the Water (Prevention & Control of Pollution) Act, 1974, and Rs. 91,200/- under the Air (Prevention & Control of Pollution) Act, 1981, are pending in the Board.
To verify the compliance of the proceeding and contents, the industry was visited by the AEE of this office on 09/07/2024 During the visit, it was observed as under:
1. The industry was in operation during the visit.
2. The industry has engaging in the manufacturing of Billets (With CCM Plant) Or Round, Square, Hexa and Flats etc. (with rolling mill without reverberatory furnace) @ 150 MTD by using MS Scrap & Ferro Alloys @ 160 MTD.
3. The industry has installed induction furnace of capacity 10 TPH and the industry has upgraded its bag filter house as APCD as per drawing as design of PSCST Chandigarh. The PSCST Chandigarh has issued completion certificate vide no. PSCST/TFD/65 dated 07/06/2024.
4. The industry has installed energy meter on its APCD and its reading was 916644.
5. The industry has submitted the quotation of ambient air quality monitor and online stack emission monitoring system (OCEMS). As per the requested submitted by the industry the industry will install the same within 1-2 months. The industry has also submitted the copy of the cheque as evidence.
6. The industry is maintaining record of SOPs framed for operation and maintenance of APCDs.
7. The industry has installed 2 no. D.G set of capacity 125 KVA & 320 KVA, which are equipped with canopy and stack of adequate height.
8. The industry has provided cooling tower for cooling of water which comes into contact with the furnace & CCM. The industry has made arrangement to recycle entire cooling water.
9. As per the decision of the Competent Authority, the bank guarantee no. 6552IPEBG240003 dated 14/02/2024, amounting to Rs. 1,00,000, was encashed by this office letter no. 3010 dated 29/02/2024 and for remaining amount the industry was submitted another the bank guarantee no. 6552IPEBG240002 dated 14/02/2024 valid upto 15/02/2025 amounting to Rs. 1,00,000 at Regional Office, Fatehgarh Sahib.
10. The industry was using good quality raw material free from dust and oil during the visit.
11. The Rep of the industry stated that they have approached PSCST Chandigarh for design of APCD for control of control of Secondary Emissions generated from the process and PSCST has conveyed that they are not having any suitable design.
12. The industry has installed water meter on its submersible pump and its reading was 18154.35 Kl.
13. A green belt shall be developed over an area of 3,806.20 Sqm, which is equal to 33% of the plant area. However, the industry has presently devolved approximately approx. 1000 Sqm of green area. The industry has submitted an undertaking stating that the remaining area will be developed during this monsoon season.
14. Gram Panchayat Chattarpura has allotted land approx. 0.5 acre for developing mini forest (Nanak Bagichi) by the industry and area of land is a type of pond which is required to be filled the same. The rep of the industry stated that it will be filed after harvesting the paddy in Oct-Nov.
Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:
"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."
PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the industry has mentioned ground water extraction @ 23.5 KLD. Considering 30 working days per month, ground water extraction will be 705 KL/month, which is more than 300 KL/month. The industry has obtained permission from Punjab Water Regulation and Development Authority (PWRDA) for 1230 KL/month through vide no. GW/PWRDA/04/2024/L1/152 dated 30/04/2024.
In view of above, if approved it is recommended that the varied consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be refused to the industry with an opportunity of personal hearing before the Competent Authority of the Board, please.
