It is submitted that the industry is a small scale green category unit. Earlier a telephonic complaint was received in this office from Sh. Sukhdev Singh, resident of New Shakti Nagar, Gali no. 08, Ludhiana against the noise pollution generated by the industry running in the residential area. Accordingly the industry M/s Sudarshan Textile, New Shakti Nagar, Gali No. 08, Ludhiana was visited by officer of this office on 28.02.2024 and it was observed that the industry is situated adjacent to the house of the complainant and the same is engaged in the manufacturing of shawls. The industry has installed power loom machines. The noise of the machines were observed in the house of the complainant. The industry used to operate the machines in night also, which cause the noise pollution in night hours also. Thereafter the industry was asked vide this office letter no. 596 dated 20.03.2024 to make arrangements to control the noise level and to submit area classification certificate from the Concerned Department. The industry had failed to submit any reply till date. Further multiple complaints were again receiving against the noise pollution from the industry due to its operation. Accordingly, the industry was again visited on 10.04.2024 and it has been observed that the industry was in operation and noise monitoring was carried out in most effected room of the complainant's house and the contribution of noise was recorded as under:-

Moreover the industry was operating without obtaining consent to operate of the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Accordingly, notice to issue directions u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with the opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 16.05.2024. After hearing the competent Authority of the Board was decided as under:-
1. Environmental Engineer, Regional Office - 3, Ludhiana to re-monitor the noise and submit the report along with recommendations, within 15 days.
2. The industry shall provide arrangements to control the noise level, within 15 days.
3. The industry shall not operate its industry in night hours i.e. 10:00 PM to 6:00 AM.
4. It was made clear to the industry that if the industry is found violating in future, then strict action including closure may be taken against the industry, without any further notice/opportunity of hearing.
In compliance of above said decisions the industry was again visited on 08.07.2024 and it was observed that industry has now provided thick glass layer on all its windows and has also provided sound proof layer at its wall adjoining to the complainant's house. Noise monitoring was carried out in most effected room of the complainant's house and the contribution of noise was recorded as under:-

The above results reveals that the contribution of noise is now within the prescribed limits and arrangements made by the project proponent are effective to control the noise level.
Now, the industry was applied for fresh of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of shawls @ 700 Num/day with discharge of domestic effluent @ 1.0 KLD into sewer. The industry has deposited Rs. 26,400/- vide UTR. no. BARBQ24136503674 dated 15.05.2024 under Water Act, 1974, Rs. 5000/- vide UTR no. BARBQ24136504052 dated 15.05.2024 under VDS scheme & Rs. 4200/- vide UTR No. BARBQ24136532640 dated 15.05.2024 as NOC fee and Rs. 26,400/- vide UTR.no. BARBQ24136525578 dated 15.05.2024 under Air Act, 1981 and Rs. 5000/- vide UTR No. BARBQ24136529469 dated 15.05.2024 under VDS Scheme. The fee deposited by the industry is adequate upto 31.12.2024 after deducting late fee penalty.
The industry has submitted copy of area classification certificate obtained from ATP, Ludhiana vide no. 5402/ATP/B/D dated 08.05.2024 mentioning that the site of the falls in mix land industrial Zone as per Master Plan Ludhiana.
The industry has submitted copy of approved building plan from the competent person under Factory Act.
The industry has submitted the record of land i.e. registries etc.
The industry was visited by AEE of this office on 08.07.2024 and observed that:-
1. The industry was in operation and is engaged in the process of manufacturing of shawls.
2. The industry has installed 10 no. shutter less power loom machines inside the premises. The industry has now removed conventional/old noise creating power loom machines from the premises.
3. The machines are installed at distance of about 8-9 feet away from the wall adjoining to the wall of complainant's house.
4. The industry has now provided thick glass layer on all its windows and has also provided sound proof layer at its wall adjoining to the complainant's house. The noise monitoring was also carried out during visit and contribution of noise was found within the limits prescribed by the Board.
5. The industry is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of above, it is recommended that consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry upto 31.12.2024 with usual terms and conditions and special condition that the industry shall comply with the decision of the hearing dated 16.05.2024 and shall not operate its industry in night hours i.e. 10:00 PM to 6:00 AM.
