File Note: It is intimated that the poultry farm is a small scale (as per value of plant & machinery) green category unit. The poultry farm has been established without NOC/consents of the Board. It is intimated that the CPCB has framed Environmental Guidelines for layered poultry farms in August, 2021. As per the said guidelines, the poultry farms are classified as under: 1. Small (5,000-25,000 bird) 2. Medium (above 25,000-1,00,000 birds). 3. Large (above 1,00,000 birds) Earlier, the poultry farm had applied for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981 which was refused vide CTOW/Fresh/MLK/2024/25619610 dated 25-06-2024 and CTOA/Fresh/MLK/2024/25619609 dated 25-06-2024 respectively due to following reasons:- 1. The poultry farm is located on Malerkotla-Nabha Road, Village Uppal Kheri, Tehsil & District Malerkotla. 2. There exists an old poultry farm premises of capacity approx. 4000-4500 birds. The new premises of the poultry farm has recently been constructed with the bird capacity of 10,000. Both the premises are operational under same name and style of M/s Binjoki Poultry Farm but separated by a LPG godown. The feed mill has been installed in the old poultry shed and yet no APCD has been installed on the same. 3. The village phirni/lal lakir Uppal Kheri is located at the distance of around 500 mtr from the site of the both the new and old poultry sheds. The area was checked and found that there are 13 houses within 300 mtr and 23 houses within the 500 mtr from the poultry sheds. 4. In the new shed no boundary has been provided by the poultry farm and is an only stand alone poultry shed. Hence, the distance of 10 mtr between boundary and poultry shed is not applicable. 5. Some flies and odour was observed near the new poultry shed. 6. There are 23 houses within the distance of 500 mtr of the poultry sheds. Also, the complaint has been made by the local villagers against this poultry farm before the SDM, Malerkotla. Thereafter, the poultry farm was issued notice u/s 33-A of the Water Act, 1974 and 31-A of the Air Act, 1981 with an opportunity of personal hearing before CEE (B) on 10.07.2024. The proceedings of which are awaited. Now, the poultry farm has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 without obtaining NOC of the Board for production of eggs @ 20,000 Numbers/Day & Poultry Feed (For Self Consumption) @ 2.5 T/day by using Layer Birds @ 24,000 Numbers/Day & Maize, Soya, Mustard, Sun Flower, DOC, Bazra, Lime stone & GNE @ 2.5 T/day as raw material under small scale green category. The poultry farm has submitted electricity bill in reply of clarification raised by this office, as the proof of date of commissioning, wherein date of connection is mentioned as 02.03.2019, which is consider as date of commissioning. The poultry farm had already deposited Rs. 29,000/- vide no. SBIN124120206415 dated 29.04.2024 as consent fee and Rs. 750/- vide no. SBIN124120208087 dated 29.04.2024 as penalty fee under the Water Act, 1974 and Rs. 29,000/- vide no. SBIN224121905969 dated 29.04.2024 as consent fee and Rs. 750/- vide no. SBIN124120224651 dated 29.04.2024 as penalty fee under the Air Act, 1981. The poultry farm has also deposited Rs. 2900/- vide no. SBIN124120220942 dated 29.04.2024 as NOC regularization fee. The poultry farm has submitted CA certificate dated 25.04.2024 of total fixed assets of Rs. 48.89 lakh. The fee deposited by the poultry farm is adequate upto 30.09.2026 (after deducting penalty fee under each act). The poultry farm has submitted Revenue Department report wherein it has been mentioned as under:- 1. There is no PUDA approved residential house within 500 mtr of the site. 2. There is no canal or drain etc. or water source in the area of 200 mtr. 3. There is no major drinking water reservoir on catchment side in the area of 500 mtr. 4. There is no drinking water source like well, summer storage tanks, other tanks within 100 mtr. 5. There is no poultry farm, dairy farm or any other livestock enterprises in area of 500 mtr. 6. There is no National Highway within 150-200 mtr. 7. There is no Sate Highway within 100 mtr. 8. There is no rural road or internal road within 10-15 mtr. A complaint was received in this office through the office of Sub-Divisional Magistrate, Malerkotla made by residents of village. In this regard, the poultry farm was visited by the Er. Amandeep Singh, AEE (OS) on 23.07.2024 and it was observed as under:- 1. The poultry farm is located at Nabha Road, village Uppal Kheri, Tehsil and District Malerkotla and was found in operation during visit. 2. There exists an old poultry farm premises of capacity approx. 4000-4500 birds. The new premises of the poultry farm has recently been constructed with the bird capacity of 20,000 as informed by representative of the poultry farm. Both the premises are operational under same name and style of M/s Binjoki Poultry Farm but separated by a LPG godown. The feed mill has been installed in the old poultry shed, which is now provided with cyclone as APCD. 3. There is no River, Lakes, canals and drinking water source like wells, summer storage tanks near 200 m to this poultry farm. Also no national highway and state highway in the radius of 120 m of poultry farm. Also there is no approved residential area/ 15 pucca houses within 500 meters of this poultry farm. The village phirni/lal lakir Uppal Kheri is located at the distance of around 500 mtr from the site of the both the new and old poultry sheds. The area was checked and found that there are 13 houses within 300 mtr and 23 houses within the 500 mtr from the poultry sheds. It is pertinent to mention here that Master Plan of the area has not yet notified. This office vide letter no. 3641 dated 16.07.2024 (copy enclosed) has requested concerned Tehsildar to intimate whether the houses in the vicinity of the poultry farm are approved establishments or not. In this regard, the Tehsildar vide letter dated 19.07.2024 has informed that the residential houses which are within the 500 mtr of the poultry have not been approved by any Govt. agency like PUDA, Improvement Trust etc. It is further informed that legal opinion was sought in a similar matter of M/s A.B Farms, Sangrur wherein SLO, Punjab Pollution Control Board has opined that such a report from Tehsildar cannot be considered as residential area (copy enclosed). 4. The new premises of poultry farm is a layered poultry farm and has constructed 01 no. single story shed. The poultry farm provided nipple system in the poultry shed for drinking purposes of birds. 5. The poultry farm has constructed burial pit for disposal of dead birds. 6. Bird droppings were lifted by the farmer as free of cost. 7. The poultry farm has provided septic tank for treatment of domestic effluent for further disposal onto land for plantation. 8. In the new shed no boundary has been provided by the poultry farm and is an only stand alone poultry shed. Hence, the distance of 10 mtr between boundary and poultry shed is not applicable. 9. The poultry farm has improved housekeeping as such no problem of flies and odour was observed during visit. 10. The poultry farm has now provided the holding tank for cooling water, septic tank and one burial pit for the disposal of dead birds. In view of above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the poultry farm upto 30.09.2026 subject to following conditions:- 1. The poultry farm will strictly comply with the Environmental Guidelines issued by the CPCB on regular basis. 2. The poultry farm shall ensure that no nuisance is caused with its operations at site. 3. The poultry farm shall assure that no problem of water/air pollution/flies/smell be occurred in the area. 4. The poultry farm shall abide with the Master Plan of the area as and when notified by the authority. Competency CEE
