The industry is a small scale red category dyeing unit and was earlier granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/LDH3/2022/17432407 dated 11.01.2022 for Washing of Polyester Fabric Cloth @ 4200 Kgs/day with discharge of trade effluent @ 9.6 KLD onto land for plantation after treated ETP and domestic effluent @ 1.5 KLD onto land for plantation after septic tank, which are valid upto 30.09.2025………………………….
Thereafter, the industry was visited by officer of the Board on 27.04.2023 and the industry was found discharging its trade effluent into conveyance system of CETP without obtaining varied consent to operate of the Board for change in mode of its disposal and industry was also found discharging blow down of its boiler into the old defunct sewer line and the overflow of that plugged/ defunct sewer line was going into planation area of the industry………………………….
The effluent samples from the plantation area were collected on 07.11.2023 and the same were sent to the Board's lab for analysis. As per the results received from the lab, concentration of various parameters were found as pH = 7.9, TSS = 20 mg/l, TDS = 665 mg/l, COD= 16 mg/l, BOD= BDL, Oil & Grease = BDL, Sulphide= BDL, Phenolic compound = BDL, Ammonical Nitrogen = 2.5 & Total Chromium = BDL. The results were within the limits prescribed by the Board…………………………..
Due to above mentioned violations, notice u/s 33-A of the Water Act, 1974 as amended in 1988 alongwith show cause notice for revocation of consent to operate under the Water Act, 1974 was issued to the industry with opportunity of personal hearing before the CEE on 15.11.2023. During hearing Competent Authority of the Board was decided as under:…………………………..
1. The industry shall apply for obtaining varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 for discharge of wastewater into the CETP of 50 MLD capacity along with following documents within 7 days:
a) The industry shall submit data regarding abstraction of ground water / fresh water supply for the last three months. It shall provide EMFs on all sources of fresh water if not provided earlier.
b) The industry shall earmark on map the location of all active / closed submersible pumps / fresh water sources.
c) Details of dyeing machinery / other water consuming machinery along with specifications including production capacities specifying liquor ratio, number of lots, water consumption per lot, thus calculating the total fresh consumption (with duly authenticated).
d) Numbers of shares held by the industry (duly certified by the SP) along with NOC from PDA / SPV regarding proposed discharge into common sewer of CETP.
e) The industry shall get its shares DEMAT and submit the documentary evidence in this regard. By the time, the DEMAT process is completed, the industry shall submit a certificate from Company Secretary of the PDA for the shares that have been recommended to the ROC for DEMAT.
f) Record of discharge during the last three months as per SCADA. g) NOC from the PDA allowing quantum of discharge into the common conveyance system of CETP of 50 MLD capacity.
2. The industry shall submit a Bank Guarantee of Rs. 1 Lac as an assurance to comply with the provisions of Environmental laws, in future at all times.
3. Environmental Engineer, Regional Office-3, Ludhiana shall visit the industry to verify the contentions of the industry and shall process the consent application of the industry on merits.
4. It was made clear to the industry that in case it is again found violating the provisions of the Environmental laws, strict action may be taken which may include closure without any further notice/ opportunity of personal hearing…………………………..
Regional Office has reported that in compliance of the decision mentioned at S.no- 1, industry has submitted all necessary documents and in compliance of decision mentioned at S.no-2, industry has submitted bank guarantee of Rs. 1 lakh in the Regional Office…………………………..
Now the industry has applied for varied of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 for dyeing of polyester fabric cloth @ 8400 kgs/day with discharge of trade effluent @ 158 KLD and domestic effluent @ 2.0 KLD into CETP 50 MLD…………………………..
The industry has deposited consent fee, which is adequate upto 30.09.2030 as verified by the Regional Office…………………………...
Regional Office has reported that the industry has submitted the area classification certificate from the STP, Ludhiana vide no. 3398/STP-(L)/TW/2A dated 21.08.2018 stating that the site is situated in the Industrial Land Use Zone…………………………...
The industry has also submitted certificate from Company Secretaries stating that 160 KL shares has been DEMAT…………………………...
The industry was visited by the AEE of Regional Office-3, Ludhiana on 16.07.2024 and observed that:
1. The industry was in operation during visit and was engaged in the process of dyeing of polyester fabric.
2. The industry has installed 03 soft flow machines of capacity (2 X 450 Kgs) and (1X 300 kgs) inside the premises. Total installed chambers are 8.
3. As per audit carried out by Guru Nanak Dev Engineering College (GNE) generation of effluent from 8 chambers is 160 KLD considering generation of effluent @ 20 KLD from 01 chamber, which is within the quantum of shares @ 160 KLD.
4. The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its trade & domestic effluent. The industry has provided the flow meter at its final outlet leading to CETP.
5. The industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974…………………………...
Further, it is pertinent to mention here that it was decided as under in the e-noting no. 19582356 (copy attached herewith): …………………………………
“It shall be ensured that no further CTE/CTO for any new/expansion of dyeing units shall be given without the permission from Head office.” …………………………………
Thus, the competency to decide the case falls with Worthy Chairman of the Board. ………………………………
In view of above, it is recommended that varied Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry for dyeing of polyester fabric cloth @ 8400 kgs/day with discharge of trade effluent @ 158 KLD and domestic effluent @ 2.0 KLD into CETP 50 MLD upto 30.06.2029 with usual conditions and special conditions that:
a) The industry should either take measures to control its inlet parameters by good practices and selection of good chemicals for processing or shall operate and maintain its existing effluent treatment plant (ETP), regularly and efficiently, so as to achieve the inlet effluent standards of CETP as per DPR.
b) The industry shall stop discharging its effluent in case due to any reason the CETP is not operational or dedicated conveyance system is overflowing.
c) The industry shall maintain the record of flow meter installed at outlet leading to CETP.
d) The industry shall not generate/discharge trade & domestic effluent more than 160 KLD.
e) The industry shall not install any new dyeing/ water polluting machinery without permission of the Board.
f) The industry shall discharge the whole consented effluent into dedicate sewer line leading to CETP for final treatment in accordance to the shares allotted to the unit.
g) The industry will also dismantle any other connection available for discharge of effluent either into public sewer or PDA conveyance system.
h) The industry shall make adequate arrangements to minimize the consumption of fresh water………………………………….
