Sir, it is submitted that:-
1. The industry is operational with name and style of a single identity i.e M/s Binjoki Poluty farm having single electric connection and single entry /exit.
2. The master plan of the area has not been notified as such there is no zoning regulation including residential. Moreover, concerned tehsildar vide report dated 19.07.24 in reply to Boards letter no.3641 dated 16.07.24 has informed that houses in the vicinity of poultry farm are not approved by any Gov agency like PUDA, Improvement Trust etc. Further, legal opinion was sought in a similar matter of M/s AB Farm, Bhawanigarh wherein SLO has opinioned that in such cases establishments can't be considered as residential area. A Copy of legal opinion in the matter is enclosed.
3. The new shed of poultry farm has been provided boundary wall such clause of maintaining distance is not applicable and hence there is no problem of cross ventilation. Further in a separate legal opinion sought from SLO, PPCB in M/s Mark Poultries, Barnala it was opinionated that the siting criteria framed by the Central Pollution Control Board in 2022 mention the work 'Preferably' in the guidelines which mean that the CPCB has not restrained the setting up of poultry farms but has framed the guidelines in the manner that the proposed site with the guidelines shall be preferably meeting with the same so that the objective of the guidelines for the prevention and Control of Pollution is achieved.
Accordingly, re- submitted as proposed earlier vide undersigned note dated 23.07.2024. |
