• The industry was granted consents to operate under Air Act, 1981 & Water Act, 1974 vide nos. CTOW/Fresh/BTI/2023/21432454 & CTOA/Fresh/BTI/2023/21428126 dt. 05.05.2023 valid upto 30.06.2027 for operation of rice sheller unit of capacity 2 TPH of Raw rice/sorted rice with dryer, subject to the conditions mentioned therein, in the name of Sh. Parshotam Dass, (Partner).
• Now, the industry has applied for renewal of consent to operate under the Water Act, 1974 & Air Act, 1981 through OCMMS for operation of rice sheller unit to produce 2 TPH of Raw rice/sorted rice with dryer under orange category, in the name of Sh. Kunal Goyal, (Partner). The details of the case is as under:
• Earlier, the industry had submitted a CA certificate of Rs. 137.81 and deposited the consent fee, which is adequate upto 30.06.2027. Now, the industry has deposited the consent fee of Rs. 8400/- through online vide no. 242181529 & 540224009 dated 19.07.2024 against the fixed assets of Rs. 137.81 to make it adequate upto 30.06.2028.
• The industry has submitted Resolution cum new partnership deed and as per deed Sh. Parshotam Dass is no longer the partner of the firm and there is only 3 partners in the firm.
• The industry was lastly visited by AEE of this office on 20.04.2023 and it was observed that the industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013.
• It is submitted that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry.
• It is submitted that the industry is complying with the emission standards of 750 mg/NM3 as notified vide notification dated 15.10.2013 and no complaint or show cause notice is pending as per the record file, so, the industry will be visited during the routine visit in the area and compliance will be submitted accordingly.
• Keeping in view of above, it is recommended that the validity of consents to operate granted to the industry under the Water Act, 1974 & Air Act, 1981 may be extended to the industry for operation of rice sheller unit of capacity 2 TPH of Raw rice / sorted rice with dryer for a period upto 30.06.2028, on the name of Sh. Kunal Goyal, (Partner), subject to the suitable conditions and specific condition that the industry will submit its air emission sample report of its shelling section as well as paddy cleaner of dryer section in upcoming paddy season.
