File Note: • The industry is a small scale green category unit. • Earlier the industry was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 Vide No. 289 dated 25.11.2002 under green category and under Air (Prevention and Control of Pollution) Act, 1981 Vide No. 291 dated 25.11.2002 under green category. • The industry was granted registration under Plastic Waste Management Rules, 2016 expired on 31.03.2021. • Thereafter, the industry was issued notices by Regional Office, Jalandhar vide letter no. 4657 dated 25/11/2021 to apply for consents and registration under orange category, as the industry falls under orange category as per new categorization of industries. • The industry was visited by AEE of the Board on 23/12/2021 and observed that the industry was in operation and is engaged in manufacturing of industrial packaging bags by using virgin granules (LDPE & PP) as raw material. The industry has installed 02 no. extruders tubular, 4 no. cuttings / sealing machine, 1 no. printing machines. There is not source of generation of trade effluent and disposal of domestic effluent is into sewer. The entire cooling water is being re-circulated. • The industry was issued show cause notice for violations of the provisions of the Water Act 1974 & Air Act, 1981 before Senior Environmental Engineer, Jalandhar on 19/05/2022, 15/06/2022, but no attended the hearings and re-hearing fixed on 01/08/2022. During hearing it was decided that:- 1. The industry shall apply for obtaining consent to operate under the Water Act, 1974 & Air Act, 1981 of the Board through online system within 07-days. 2. Environmental Engineer, Regional Office-1, Jalandhar shall re-visit the industry within 10- days to verify the contentions of the industry & process the consent application on merit. • The industry was again visited by officer of the Board on 22.12.2022 and the representative of the industry was also again guide the apply for consents under the Water Act, 1974 & Air Act, 1981 alongwith registration under Plastic Waste (Management) Rules, 2016 of the Board, however, till date the industry has not applied for obtaining consents of the Board & registration under Plastic Waste (Management) Rules, 2016. • The industry was issued show cause notice for violation of the Water (Prevention & Control of Pollution) Act 1974 & Air (Prevention & Control of Pollution) Act 1981 with an opportunity reply within 15- days but no reply received from the industry. The industry was again visited by AEE of Regional Office, on 16.09.2023 and observed that the industry was in operation during visit and is engaged in manufacturing of industrial packing bags by using virgin granules (LDPE & PP) as raw material. The industry has installed 2 no. extruders tubular, 4 no. cutting/sealing machine, 1 no. printing machine. There is no source of generation of trade effluent and domestic effluent is being discharge into sewer. Entire cooling water is being re-circulation. The industry is violating various provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and Plastic Waste Management Rules, 2016, as operating the unit without valid consents and registration of the Board. • The industry was given personal hearing given on 07.12.2023 before Chairman of the Board w.r.t show cause issued for violations of provisions of Plastic Waste management Rules, 2016, wherein it was decided as under:- 1. The industry shall apply for obtaining registration under the provisions of Plastic Waste management Rules, 2016 on the centralised EPR portal development by the CPCB, without any further delay. 2. The industry shall deposit Environmental Compensation amounting to Rs. 1,77,500/- due to the violations made under the provisions of Plastic Waste management Rules, 2016 as amended from time to time within 10 days. 3. The industry shall apply for renewal of consent to operate under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 immediately. 4. Environmental Engineer, Regional Office, Jalandhar-1 shall ensure the compliance of the above decisions and submit its latest status report within 15 days. • Thereafter, the amendment in proceedings of personal hearing given on 07.12.2023 before the Chairman of the Board w.r.t show cause issued for violation of the provisions of Plastic Waste Management Rules 2016 in reference to the request made by the industry to waive off the environmental consumption imposed during hearing on 07.12.2023 was issued by SEE(PWM) vide letter No. 3220 dated 16.07.2024 and decided to waive off the Environmental compensation imposed during hearing given to the industry on 07.12.2023subject to the condition that the industry sh all ensure the compliance of Guidelines on extended producer responsibility (EPR) for plastic packing notified vide MoEF&CC notification dated 16.02.2022 as well as various provisions of Plastic Waste Management Rules 2016 as amended from time to time. This is for your information and compliance at all times failing which the industry shall attract appropriate action under the provisions of the Environment (Protection) Act, 1986. • Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 through OCMMS of the Board for manufacturing of Industrial Plastic Bags @ 200 Kgs/day by using Plastic Granuals @ 200 Kgs/day as raw material under orange category and detail of the same as under: - 1. The industry has deposited Rs. 9800/- vide UTR No. N335232761714023 dated 01.12.2023 under Water Act, 1974 and Rs. 9800/- vide UTR No. N335232761696210 dated 01.12.2023 under Air Act, 1981 against the fixed assets of Rs. 3.52 Lacs, which are adequate upto 30.09.2026 including 500% penalty. 2. The industry has submitted approved building plan from director of factories act, Punjab. 3. The industry has submitted registry of the land, partnership deed with the application. • The industry was already visited by AEE of this office on 26.07.2024 and observed that the industry was in operation and is engaged in manufacturing of industrial packing bags by using virgin granules (LDPE & PP) as raw material. • The industry has installed 2 no. extruders tubular, 4 no. cutting / sealing machine, 1 no. printing machine. • There is no source of trade effluent generation and domestic effluent is discharged into sewer. • The industry is not engaged in manufacturing of banned plastic carry bags/ Single use plastic items at site. • The industry is complying with the conditions of granted consent to operate under Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981. Recommendation:- Keeping in view of above, it is recommended that the consent to operate under Water (Prevention & Control of Pollution) Act 1974 and under Air (Prevention and Control of Pollution) Act, 1981 may be granted to the industry upto 30.09.2026 with suitable conditions as per policy of the Board with suitable conditions as per policy of the Board and with special condition that:- 1. The industry shall obtain EPR registration within 07 day. 2. The industry will not manufacture any activity related to plastic carry bags/ Single use plastic items.
