It is submitted that the industry is a small scale, orange category new identified unit and is engaged in the manufacturing of Steel Forging.
The industry was issued show cause notice for violation of provisions of the Water Act, 1974 and the Air Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 03.06.2024 in which following decisions were taken:- 1. The industry shall make proper arrangements as per norms of the Board for control of noise from operation of the machinery. 2. The industry shall submit a Bank Guarantee of Rs. 1.0 lac as an assurance for the compliance of pollution Control Laws in future within 07 days. 3. The industry shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 within 15 days. 4. The Environmental Engineer, Regional Office shall verify the submission of the industry and process consent applications on merits.
Now, the industry has applied fresh consent to operate under the Water Act, 1974 and Air Act, 1981 for manufacturing of Steel Forging @ 2 MTD using Steel Rounds @ 3 MTD as raw material alongwith requisite document and fee.
The report of RO has been perused and it has been observed as under:-
1. The industry has been established without NOC of the Board.
2. The industry has not submitted noise monitoring report regarding operation of hammers (1.5 ton, 1.25 ton & 1 ton) and operation of shot blasting machine.
3. The industry has not submitted detailed drawing of re-circulation of cooling water.
4. The industry has not submitted approved building plan from the Competent Authority.
5. The industry has not mentioned the details of forging furnaces and its pollution control measures.
6. The industry has been established without NOC of the Board. The industry has not submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC).
In view of the above, it is recommended that show cause notice for refusal of Consent to Operate under the Water Act, 1974 and Air Act, 1981 may be issued to the industry with hearing at ZO level, please.
