It is submitted that earlier, the industry was a Large Scale, Red category dyeing unit and the industry was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH2/2019/9718111 dated 26.09.2019 and the under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH2/2019/9717882 dated 09.10.2019 both were valid upto 31.03.2020 for the manufacturing of all using All Type of Waste @ 800 kg using all Type of Blended yarn Dyed @ 3200 Kgs/day and all Type Of Grey Yarn @ 4800 Kgs/day.
Thereafter, the industry was visited by the officer of the Board on 17.01.2023 and various violations were observed during visit. Hence, the industry was issued notice U/S 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 alongwith notice for imposition of Environmental Compensation (EC) with an opportunity of personal hearing before Worthy Chairman of the Board on 15.06.2023 in which following decisions were taken:-
1. The industry shall not operate the water polluting processes without prior permission of the Board and shall obtain consents to operate for the present processes being carried out by the industry.
2. The industry shall comply with all the violations stated as above, immediately.
3. The industry shall deposit a Bank Guarantee of Rs. 10 lakhs as assurance for the compliance of the Pollution control laws and out of Rs. 10 lakhs, Rs. 05 lakhs shall be en-cashed.
4. The Environmental Engineer, Regional Office-2, Ludhiana shall visit the industry after 15 days, verify the submission made by the industry and shall submit further recommendations in the matter.
To verify the compliance of the decisions of personal hearing, the industry was visited by the EE/AEE of this office and JSO of Zonal Lab on 22.02.2024 and industry was found violating of the provision of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Hence, the directions u/s 33-A of the Water (Prevention & Control of Pollution) act, 1974, u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 were confirmed vide Board’s letter no. 3071-72 dated 24.05.2024 and u/s 5 of the Environment (Protection) Act, 1986 vide Board’s letter no. 3066-67 dated 24.05.2024. The PSPCL authorities were directed to disconnect the supply of electricity available to the subject cited industry/Premises with immediate effect vide Board’s letter no. 3060-63 dated 24.05.2024. This office requested the PSCPL Authorities to comply with the directions issued u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974, u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 and u/s 5 of the Environmental (Protection) Act, 1986 and to send copy of TDCO to this office immediately vide this office letter no. 1312-16 dated 03.06.2024, 1368-72 dated 12.06.2024 and through e-mail dated 09.07.2024 but, no compliance has been received from the PSPCL Authorities.
Now, the industry has applied varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 alongwith requisite document and fee for manufacturing of Acrylic Polyester Blended Yarn @ 5 MTD and Polyester Blended Yarn @ 4 MTD using Acrylic Fiber, Polyster Fiber, Man made fiber @ 10 MTD under large scale orange category as industry has closed its dyeing process.
To verify the compliance of the directions as well as the facts at site the industry was visited by the AEE of this office on 24.07.2024 and observed as under:-
1. During visit, it was observed that industry was in operation and electric connection of the industry was intact. This office requested the PSCPL Authorities to comply with the directions issued u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974, u/s 31-A for the Air (Prevention & Control of Pollution) Act, 1981 and u/s 5 of the Environmental (Protection) Act, 1986 and to send copy of TDCO to this office immediately vide this office letter no. 1312-16 dated 03.06.2024, 1368-72 dated 12.06.2024 and through e-mail dated 09.07.2024 but, no compliance has been received from the PSPCL Authorities.
2. The industry is engaged in process of manufacturing Acrylic Polyester Blended Yarn and Polyester Blended Yarn using Acrylic
Fiber, Polyster Fiber, Man made fiber as raw material.
3. The manufacturing of the industry involves: Raw material Dyed fibre Spinning Coning Packaging.
4. The industry is having 01 no. of tubewell and 01 no. of submersible pump as source of fresh water. Water meter has been provided with its submersible Pump and the reading of the same 343443 m3.
5. It has stopped dyeing process and dismantled its dyeing machinery and its ETP. As such, fresh water is used for domestic, boiler feed, cooling tower and miscellaneous purpose only.
6. The DM plant is installed for boiler feed water and water meter has been provided on it and reading of the same was 2531.82 M3 and industry is maintaining the record.
7. Now, the industry has provided water meter with its cooling tower provided with the 2 no. D.G. sets of capacity 1010 KVA each and reading of the same was 00061 M3.
8. The wastewater generated from DM plant and cooling tower is discharged onto land for planation after treating through STP.
9. It has installed the STP to treat the domestic effluent. Earlier, the sample from the outlet of STP was collected and the concentration of various parameters were found pH – 7.5, TSS – 23 mg/l, TDS – 420 mg/l, COD – 60 mg/l, BOD – 16 mg/l, O&G – BDL which were within the limits prescribed by the Board.
10. It has installed the discharge meter on the final outlet of STP and same was in operation during visit, but no discharge observed at the outlet of STP. It has installed the discharge meter at the outlet of STP and reading of the same was 266288 M3 during visit. Now, the industry is maintaining the record of operation of STP. As per record-maintained industry is discharging the treated domestic effluent appox. 5-6 KL/Day. Now, it has also provided the Sub Energy meter with its STP and reading of the same 26687 kWh.
11. About 1.7 acres of land is developed for plantation for utilization of treated wastewater.
12. It has installed a boiler of 2 TPH in which pet coke is used as fuel. During visit boiler was in operation.
13. It has installed Twin cyclone followed by 2 stage wet scrubber as APCD. Now, it has provided the new stack with its Boiler with sampling arrangements.
14. Now, it has provided the Sub Energy meter with its APCD and its reading was 158.1 kWh.
15. Now, the industry is using crushed pet coke as fuel in its boiler and SO2 meter was also in operation.
16. Now, industry has started maintaining the record of operation of APCD.
17. As informed by the rep. of the industry, now, the boiler ash is dumped into low lying area.
18. The industry has installed 2 no. D.G. sets of capacity 1010 KVA each and are installed in an acoustic room. The stack with these DG sets is provided about 30 feet ARL.
19. The spinning sections’ emissions (fines) are passed through simple hanging filter clothes for collection of waste fibres. Effective emission control / monitoring system yet to be provided with the spinning sections.
20. The industry has submitted its request to waive off the Bank Guarantee of RS. 10.0 Lacs on the following grounds:-
“1. That the industry has closed it's Dyeing Water pollution generating process permanently & has dismantled the machinery, so there will be no Water pollution in future.
2. The industry has now provided 100 ft new stack on its existing Boiler, now there will be no Air pollution, port hole with ladder to collect sample is also provided.
3. The industry has got lifted leftover HW which was lying near the ETP & in the components of E.T.P was removed, dried & got it lifted by approved agency as per agreement. Now there is no HW left under category 35.3, 5.1 & 33.1 is at the site.
4. The industry has also provided new Danger board & Environmental Data board as advised.
5. The industry has maintained all records of installed meters.
6. The industry is also going under recession & financial crisis.
7. Since the industry has complied with all discrepancies under which the EC/BG was imposed
8. It is also submitted that now the industry got sick due to financial reasons and is not in a position to pay the imposed BG and has also complied with the discrepancies it is requested to waive the BG. We will be highly obliged.”
21. The industry has not deposited a Bank Guarantee of Rs. 10 lakhs as assurance for the compliance of the Pollution control laws and out of Rs. 10 lakhs, Rs. 05 lakhs could not be en-cashed, as it has not deposited the Bank Gurantee of Rs. 10 Lakhs. It has submitted its request that due to sick unit and financial constraints it is unable to submit the Bank Guarantee.
22. No burning of solid waste observed in its premises.
23. The industry has submitted the letter issued by DTP, Ludhiana vide no. 404 dated 14.02.2013 vide which the site of the industry falls in industrial zone as per Master Plan, Ludhiana (2007-31).
24. It has provided hazardous waste storage room with door facility.
25. It has produced the record of generation of hazardous waste and lifted to CTSDF, Nimbua as under:-
a. 15.215 kg vide manifest no. 43918 dated 16.06.2023.
b. 18335 kg vide manifest no. 49868 dated 03.07.2024.
26. It has provided the display board at the main gate of the industry and danger sign outside the hazardous waste storage room.
27. It has provided the bins for storage of dry/wet solid waste in its premises.
28. As per CA certificate submitted by the industry the value of total fixed assets is Rs. 2221.53 Lacs as on 31.10.2023.
29. The industry has deposited consent fee observed as under:-
A) Water Act, 1974:-

30. The consent fee deposited by the industry is adequate upto 30.09.2025.
Keeping in view of the above, it is recommended that considering the request of the industry Consent to operate under Water (Prevention and Control of Pollution) Act, 1974 may be considered for grant six months and Electric connection of the industry may not be disconnected / (may be restored) for six months.
