Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 25.07.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s P.L. Bright Bar Industries, B-29-II, Near Yuvraj Overseas, Kanganwal, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit. The industry has applied for fresh of consent to operate under Water Act, 1974 & Air Act, 1981.
The application of the industry has been perused and following observations has been made:-
1. The industry is red category unit and has been established without NOC of the Board.
2. The industry has submitted the copy of electric connection released on 31.08.2021 and made an agreement with M/s Keshav Chemical Pvt. Ltd., on 26.03.2024. The industry is discharging effluent into sewer from 31.08.2021 to 26.03.2024.
3. The industry is newly established unit and has not submitted the certificate from Competent Authority regarding land use pattern of the area.
4. The industry has not submitted month wise details w.r.t. water consumption and effluent generation from process from date of agreement with re-processor.
5. The industry has not submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC).
The industry is not complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Thus, violating provisions of said Acts.
The industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 03.07.2024. But, no one from industry attended the hearing and not submitted any written repl.
In view of the above, the industry was show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 25.07.2024.
Sh. Munish Goyal, Proprietor of the industry attended the hearing and submitted that the industry is a small scale pickling unit and made agreement with M/s Keshav Chemical Pvt. Ltd., on 26.03.2024. The industry was getting the effluent lifted to M/s Charanjit Singh & Co. Technology from 31.08.2021 to 26.03.2024, the record of which will be submitted within 02 days. The industry was not aware of NOC of the Board and has now submitted point wise compliance to the NOC conditions which would have been imposed if the industry earlier had obtaining 'Consent to Establish' (NOC). They will submit land use pattern of the area, immediately.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall get lifted the untreated effluent to re-processor regularly and maintain the record of water consumption and effluent lifting to re-processor.
2. The industry shall submit the record of water consumptions and effluent lifting to M/s Keshav Chemical Pvt. Ltd in annotated form, within 03 days.
3. The industry shall submit the record of water consumptions and effluent lifting to M/s Charanjit Singh & Co. Technology during period from 31.08.2021 to 26.03.2024, within 03 days.
4. The industry shall submit the certificate from Competent Authority regarding land use pattern of the area, within 03 days.
5. The Environmental Engineer, Regional Office, Ludhiana shall verify the submission made by industry and submit further recommendations in the matter.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
