Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 25.07.2024 w.r.t. Show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s Bhogals Pvt. Ltd., B-XXIX/1104, G.T. Road, Dhandari Kalan, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was earlier granted consent to operate under Water Act, 1974 vide no. CTOW/Renewal/LDH2/2022/19315273 dated 22.8.2022 expired on 30/06/2024 and under Air Act, 1981 vide no. CTOA/Renewal/LDH2/2022/19315253 dated 18/08/2022 expired on 30/06/2024 for manufacturing of B.B Axle @60000Nmber/Year, B.B Cup @95000Nmber/Year, B.B Ring @50000Nmber/Year, Agriculture Equipments @ 1530Nmber/Year, Machined Auto Parts @200000 Number/Year.
The industry has now applied for varied consent to operate under Water Act, 1974 & Air Act, 1981 for change in production capacity.
The application of the industry has been perused and it has been observed as under:-
1. The industry has not submitted copy of agreement with M/s JBR Technologies Ltd, Ludhiana for lifting of trade effluent generated from process and not clarified whether there is change in quantity of agreement due to decrease in production.
2. The value of plant and machinery during previous consent was 5.75 Cr and now value of plant and machinery is 5.01 Cr. The industry has not submitted details of machinery removed due to which value of Plant & machinery decreased.
3. The industry has not submitted the certificate from Competent Authority regarding land use pattern of the area.
4. The industry has not intimated pollution control measures provided with Auto black furnace.
5. The industry has not submitted point wise compliance to the previous consent conditions verified by visiting officer.
In view of the above, the industry was show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 25.07.2024.
Sh. Manjeev Singh Bhogal, Director of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry is engaged in manufacturing of B.B Axle, B.B Cup, B.B Ring, Agriculture Equipments and Machined Auto Parts. They are submitting copy of agreement with M/s JBR Technologies Ltd. @ 20000 Ltr/month for lifting of trade effluent generated from process. Earlier, they have agreement with M/s JBR Technologies Ltd.@ 50000 Ltr/month, which has now been decreased to 20000 Ltr/month and applied for varied consent of the Board. They have attached detail of machinery removed due to which value of plant and machinery decreased. The industry falls in approved industrial zone of Dhandari Kalan. The industry has installed low temperature oil fired auto black furnace and provided stack of adequate height and there is no need of any APCD. They have submitted compliance report of previous consent.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall get its trade effluent lifted to CETP operator regularly and maintain the record of water consumption and lifting.
2. The Environmental Engineer, Regional Office shall verify submissions made by the industry and submit recommendations, accordingly.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
