Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 25.07.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 to M/s Bhogals Cycles, 1104, G.T. Road, Dhandari Kalan, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is small scale red category unit. The industry was earlier granted consent to operate under Water Act, 1974 vide no. CTOW/Renewal/LDH2/2022/ 19320183 dated 22.8.2022 expired on 30/06/2024 and under Air Act, 1981 vide no. CTOA/Renewal/LDH2/2022/19320166 dated 28/08/2022 expired on 30/06/2024 for manufacturing of Cycle Cart @11000 Nmber/Year and Kik Cycle/Cycle @110000Nmber/Year.
The industry has applied for varied consent to operate under Water Act, 1974 & Air Act, 1981 alongwith requisite documents for decrease in production capacity i.e Cycle Cart @10000 Nmber/Year and Kik Cycle/Cycle @100000 Nmber/Year.
The application of the industry has been perused and it has been observed as under:-
1. The industry has not submitted copy of agreement with M/s JBR Technologies Ltd, Ludhiana for lifting of trade effluent generated from process and not clarified whether there is change in quantity of agreement due to decrease in production.
2. The industry has not intimated mode of lifting of trade effluent.
3. The value of plant and machinery during previous consent was 1.02 Cr and now value of plant and machinery is 1.03 Cr. The industry has not submitted details of machinery added due to which value of Plant & machinery Increased.
4. The industry has not submitted the certificate from Competent Authority regarding land use pattern of the area.
5. The industry has not submitted analysis report of air emissions of APCD installed by it.
6. The industry has not submitted point wise compliance to the previous consent conditions verified by visiting officer.
In view of the above, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 25.07.2024.
Sh. Harjyot Singh Bhogal, Partner of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry is engaged in manufacturing of Cycle Cart and Kik Cycle/Cycle. They are disposing off their effluent into common collection tanker in its sister concern i.e. M/s Bhogals Pvt. Ltd., B-XXIX/1104, with common agreement with M/s JBR Technologies Ltd. @ 20000 Ltr/month for lifting of trade effluent. They have submitted detail of machinery added due to which value of plant and machinery increased. The industry falls in approved industrial zone of Dhandari Kalan. They are running one number Powder coating on LPG fuel and have provided adequate height. The industry has not any auto black furnace. They have submitted compliance report of previous consent.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall get its trade effluent lifted to CETP operator regularly and maintain the record of water consumption and lifting.
2. The Environmental Engineer, Regional Office shall verify submissions made by the industry and submit recommendations, accordingly.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
