The project proponent was granted consent to establish (NOC) under the Water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/FZL/2019/11116715 dated 20.09.2019 expired on 19.09.2020 for establishment of function hall of capacity 400 person. However, the marriage palace has failed to apply for extension of validity of CTE / obtain CTO from the Board.
Thereafter, the marriage palace was visited by then AEE on 16.05.2024 and it was observed as under:-
1) The marriage palace has not provided oil & grease trap for treatment of domestic wastewater.
2) The marriage palace has constructed an underground storage tank for storage of wastewater.
3) The marriage palace has not developed any plantation area for disposal of wastewater. As per representative of the marriage palace, they are discharging wastewater generated from the palace through mobile tanker to unknown place.
4) The marriage palace has not constructed compost pit for the management of the wet solid. Solid waste was found stored in a vacant area of the premises in an unscientific manner. The representative of the marriage palace has informed that the same is being lifted by the municipal authorities.
Accordingly, the project proponent was issued show cause notice with an opportunity of personal hearing before the Senior Environmental Engineer on 04.07.2024, wherein it was decided as under:-
1. The marriage palace shall submit a bank guarantee of Rs. 50,000/-, within 07 days to the Regional Office, Faridkot of the Board as an assurance to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and Board's order dated 02.02.2021, in true letter & spirit...............
2. The marriage palace shall provide oil & grease chamber for pre-treatment of the effluent generated from the kitchen section & shall also provide adequate disposal arrangements for the treated wastewater, within 10 days...............
3. The marriage palace shall construct the compost pits of adequate capacity for management of wet solid waste in compliance to the Solid Waste Management Rules, 2016, within 07 days.............
4. The marriage palace shall apply for obtaining consents to operate of the Board under the provisions of the Water Act, 1974 & Air Act, 1981 immediately after 10 days...............
5. The marriage palace shall ensure to comply with guidelines for control of pollution & enforcement of environmental norms issued by the Board vide its office order no. SEE(HQ-2)/2021/64 dated 02.02.2021 in true letter & spirit..............
6. Environmental Engineer, Regional Office, Faridkot shall visit the marriage palace after 10 days, verify the compliance at site and process the consent applications to be applied by the marriage palace under Water Act, 1974 & Air Act, 1981, on merits.................
In compliance to the decisions of personal hearing, the marriage palace has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 for same capacity. Details of the case are as under:-
1) The PP has submitted copy of electricity bill as proof of date of commissioning. As per which, the date of connection of the unit as 29.07.2022.
2) The PP has submitted CA certificate, showing value of gross fixed assets of Rs. 471.33 Lakhs. Accordingly, it has deposited Rs. 21,595 vide UTR/Ref No. SBIN124191983224dated 09.07.2024 under the Water Act 1974 and Rs. Rs. 21,595 vide UTR/Ref No. SBIN124191981341dated 09.07.2024 under the Air Act, 1981. The project proponent has also deposited Rs. 86,395/- vide UTR/Ref No. SBIN124191981469 dated 09.07.2024 as balance CTOs fee, which is adequate for a period upto 30.06.2026 after adjusting penalty and balance consent fee under the Water Act, 1974 & the Air Act, 1981.
3) In compliance to the hearing decisions, PP has submitted Bank Guarantee amounting to Rs. 50,000/- bearing no. 0275/ILG000324 dated 19.07.2024.
To check the compliance, the marriage palace was visited by undersigned (AEE) on 24.07.2024 and it was observed as under:
1. During visit no function was being carried out in the palace. The marriage palace has provided hall of capacity @ 400 persons.
2. The marriage palace has now provided Oil & grease trap followed by septic tank and the treated water outlet was lead to plantation area / lawn area in an about 4 kanals within the premises. The plantation area provided is adequate.
3. The palace has now constructed 02 no. compost pits for the in-situ management of wet waste generated after the function.
4. The palace has installed suction hood in the kitchen section.
5. The marriage palace has provided warning sign board near the stage or main gate as per Supreme Court orders for non operation of DJ sound after 10:00 PM
6. The marriage palace has provided one DG set of capacity 40 KVA with canopy & stack of adequate height.
In view of the above, the marriage palace is complying with the provisions of the Water Act, 1974 and the Air Act, 1981 and the guidelines issued by the Board vide order no.(HQ-2)/2021/64 dated 02.02.2021. It is therefore recommended that fresh consent to operate under the Water Act, 1974 & the Air Act, 1981 may be granted for operation of marriage palace for a period upto 30.06.2026, subject to suitable terms & conditions and specific as under:
1. The marriage palace will always comply with guidelines issued by the Board vide no. HQ-2/2021/64 dated 02.02.2021.
2. The marriage palace will ensure that in-situ management of wet waste generated during the function is being carried out.
3. The marriage palace shall make ensure to utilize treated water for plantation purpose.
4. The marriage palace will comply with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and subsequent amendments, if any.
