• The industry was granted NOC on 07.08.2023 (valid upto 06.08.2024) for establishment of WMM plant @ 300 TPH in an area of 34 kanal 07 marlas bearing khasra no. 103//24/1(2-7), 109//4(8-0), 7/1(5-0), 7/2(2-0), 7/3(1-0), 14(8-0), 17/1(5-4), 17(2-16) in the revenue estate of Village Rajiana, Hadbast no. 110, Tehsil Baghapurana, District Moga……………………..
• The industry thereafter applied for obtaining NOC 07.08.2023 (valid upto 06.08.2024) for installation of RMC plant @ 112.5 TPH in the same land area of 34 kanal 07 marlas.Thereafter, the project proponent obtained CTOs for operation of RMC plant under the Water Act, 1974 & Air Act, 1981 on 24.08.2023 (valid upto 31.07.2025) under green category………………..
• Thereafter application applied for obtaining 'consent to establish' (NOC) for establishment of hot mix plant in the same land area of 34 kanal 07 marlas which was refused by the Board as the National Highway was located at a distance of 300 meter from the proposed site of the project and the site was not complying with the siting guidelines prescribed by the Board vide notification dated 26.04.1999………………..
• Now the application has been applied for NOC expansion for establishment of hot mix plant in the same land area of 34 kanals 07 Marlas land bearing khasra nos. 103//24/1(2-7), 109//4(8-0), 7/1(5-0), 7/2(2-0), 7/3(1-0), 14(8-0), 17/1(5-4), 17(2-16) in the revenue estate of Village Rajiana, Hadbast no. 110, Tehsil Baghapurana, District Moga. ………………
• The project proponent has submitted copy of registry of land area of 34 kanals 7 marlas in the name of the Directors of the industry. ………….
• The DTP vide its report dated 12.01.2023 has intimated that the establishment of the hot mix plant is permitted in the 34 kanal 07 marlas land area of Village Rajiana, Tehsil Baghapurana, District Moga. The industry has submitted the report of DTP, Moga issued vide his letter no. 41/DTP/Moga dated 12.01.2023, wherein it has been reported that as per the notified master plan of Moga, the first 200 meter distance of site falls in the Mix land use zone and remaining area of site falls in the agriculture zone, which is suitable for establishment of hot mix plant. ……………
• The project proponent has submitted the copy of report issued by the SDM, Baghapura on 01.06.2023, wherein it has been intimated that MC limit at a distance of 5.5 km, class A-town & city at a distance of 5 km, other town & cities at a distance of 1.5 km, village lal dhora/phirni at a distance of 550 meter, no wild life sanctuatory, NH at a distance of 300 meter, stage highway/scheduled road at a distance of 550 meter, residential are (15 pucca houses) at a distance of 500 meter, educational institute/historical religious place/protected monuments at a distance of 700 meter. Further the SDM, Baghapura has intimated vide his office letter dated 21.05.2024 that the hot mix plant has been established in one of the land area bearing khasra no. 103//24/1, 109//4,7/1, 7/2, 7/3, 14, 17/1 and 17/2 and land area of . 103//24/1 is adjoining to the state highway and the said plant is located at a distance of more than 340 meter from the state highway……………..
• The industry has submitted letter dated 31.12.2021 issued by the NHAI, wherein the project has been allotted for development of four lane Dhillon Nagar (Moga) to Bajakhana (Lambwali) Section of NH-105 B (Greenfield Alignment) for design chainage km 0.000 to 43.319 under the Bharatmala Pariyojana in the State of Punjab on Hybrid Annuity Mode. ………………
• The visiting officer has reported that the proposed site is located along Moga- Kotkapura State Highway Road and location of HMP is located more than 300 meters from the Road. . No National Highway is located within 300 meter from HMP site. Moreover, the Project Proponent is doing work for construction of New NH-105B from Dhillon Nagar (Moga) to Bajakhana (Lambwali), as per work order issued by NHAI vide letter dated 31.12.2021. Moreover, as per guidelines of Board, the HMP is allowed at distance 200 meters from under construction National Highway, to whom work has been alloted. 3. No Village phirni / lal lakir, wide life sanctuary / zoo, national highway / scheduled road, education institute, historical religious place, protect monuments, residential area (cluster of 15 pacca houses) within the 500 mtrs radius from the site………………….
• A clarification was raised to the Regional Office be requested to specific the exact khasra no. where the hot mix plant is proposed to be established, and its suitability in compliance to the notification dated 26.04.1999 specifically w.r.t. the State Highway, Scheduled Road & National Highway. Also, an undertaking is required to be submitted by the project proponent that the hot mix plant will be located in the specific khasra nos. only…………………
• The Regional office vide note dated 27.07.2024 has intimated that Sh. Bal Mukand Nautiyal, project manager of the hot mix plant has submitted an undertaking dated 25.07.2024 that the hot mix plant will be installed in khasra no. 17/1 to maintain its distance more than 300 meters from National Highway, State Highway and Scheduled Road.. The site was visited by then AEE on 24.06.2024 and it was observed that site of proposed hot mix plant located more than 300 meters from National Highway as well as State Highway and 500 meters away from Scheduled Road. Same was reported by him vide visit point no. 1, 2 & 3 as per note dated 11.07.2024. Also, SDM Baghapurana vide letter no. 84 dated 21.05.2024 has reported that proposed site of hot mix plant is 340 meters i.e. more than 300 meters from the State Highway. Keeping in the view of report by SDM vide dated 21.05.2024 and visit note dated 11.07.2024, the site of hot mix plant is suitable for establishment of hot mix plant in compliance to the notification dated 26.04.1999. …………
• In the core committee meeting held on 11.05.2018, it was decided vide item no. 1 that hot mix plant be allowed to setup at a minimum distance of 200 meter and more from National Highway for execution of National Highway project for a period of one year extendable upto one & half year for the reasons to be recorded in writing. The other siting criteria will remain the same as mentioned in notification dated 26.04.1999………………….
• In view of above, if approved, consent to establish (NOC) for expansion may be granted to the HMP for its establishment in a land area of 34 kanals 07 Marlas land bearing khasra nos. 103//24/1(2-7), 109//4(8-0), 7/1(5-0), 7/2(2-0), 7/3(1-0), 14(8-0), 17/1(5-4), 17(2-16) in the revenue estate of Village Rajiana, Hadbast no. 110, Tehsil Baghapurana, District Moga. for production of premix @ 180 TPH, subject to the following special conditions that:-
1. The 'consent to establish' is granted to the industry for its establishment in the land area of 34 kanals 07 Marlas land bearing khasra nos. 103//24/1(2-7), 109//4(8-0), 7/1(5-0), 7/2(2-0), 7/3(1-0), 14(8-0), 17/1(5-4), 17(2-16) in the revenue estate of Village Rajiana, Hadbast no. 110, Tehsil Baghapurana, District Moga as per the proposal submitted by it and in case any of the documents submitted by the PP are found wrong/incorrect, the consent to establish granted to the project would be deemed to have been canelled and the Board would not be responsible for the cost incurred by the project proponent in the matter. ………………
2. The industry will install the machinery related to the hot mix plant/pollution casuing sources in khasra no. 109//17/1 only falling in the revenue estate of Village Rajiana, Hadbast no. 110, Tehsil Baghapurana, District Moga as per the proposal submitted by it. ……………
3. This 'consent to esablish' is issued from pollution angle for the development for laying four laning of new national highway from Dhillon Nagar (Moga) to Bajakhana (Lambwali) section of NH-105B (Greenfield Alignment) only and it does not absolve from obtaining necessary permissions/clearances from other authorities/ statutes as applicable……………..
4. The industry will comply with the code of practice as prescribed by the Board vide notification no. Admn./SA2/F.No.178/99/03 dt. 26.04.99 for hot mix plant………………
5. The industry shall apply for obtaining consents to operate under the Water Act, 1974 & Air Act, 1981 before commissioning of hot mix plant………………..
