File Note: The project proponent was granted fresh ‘Consent to Establish’ (NOC) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/LDH3/2022/20424332 dated 26.12.2022 valid upto 20.11.2023 for establishment of new Residential Township consisting of 396 residential plots, 5.234-acre area under EWS and 7.398-acre area under commercial & institutional plots, having total area of project as 105.23 acres alongwith generation of treated domestic effluent @ 876 KLD [377 KLD shall be reused for flushing purpose by providing dual plumbing system and remaining treated domestic effluent @ 499 KLD shall be utilized in the reserved plantation area (7.9 acres as per Karnal Technology) & horticulture area (in 6 parks of area 32802 square yard & 11 green pockets of area 8020 square yard)]. The project proponent has now applied for obtaining fresh ‘Consent to Establish’ (Fresh NOC) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 (as there is change in planning and approved layout plan of the colony) for establishment of Residential Township consisting of 430 residential plots and 7.398 acre area under commercial & institutional plots, having total area of 105.23 acres alongwith generation of trade effluent @ 686 KLD [treated domestic effluent @ 290 KLD shall be reused for flushing purpose by providing dual plumbing system in the project and remaining treated domestic effluent @ 396 KLD shall be utilized in the reserved plantation area (7.9 acres as per Karnal Technology) & horticulture area (in 6 parks of area 32802 square yard & 11 green pockets of area 8020 square yard). The reason for decrease in discharge is due to conversion of 5.234 acres high human density EWS site into plotted area. The project proponent has deposited NOC fee of Rs. 3,16,800/- vide UTR. No. 460382707dated 24.07.2024 as NOC regularization fee, which is adequate for 05 years for project cost of Rs. 81.56 Crore. The proposed site was visited on 27.07.2024 by undersignd and it was observed as under:- 1. The proposed site is located in the revenue estate of Village Ayali Kalan along Ayali Kalan-Jhammat Road, Ludhiana. 2. The project proponent has not started any construction work at site and presently land is lying vacant. 3. The project proponent has obtained Change of Land Use for “Residential Plotted Colony” from the Chief Town Planner, Department of Town & Country Planning, Punjab for an area of 105.23 acres (99.27 acres vide no. 83 CTP(Pb)SP-432-L dated 06.01.2022 & 5.96 acres vide no. 3332CTP(Pb)SP-432-L dated 28.07.2022) 4. The project proponent has submitted copy of revised approved layout plan duly approved by the Chief Town Planner, Punjab vide no. 654CTP(L)/LA-23 dated 09.05.2024. As per this layout plan, the project proponent has proposed to develop 430 plots having an area 254886.95 sq. yards (53.13 % of total project area), 07 shops (commercial) having an area of area of 630 sq. yards (0.14% of total project area). The project proponent has proposed to develop Sr. Sec. School (at 2 sites) having an area of 19449.34 sq. yards (4.28% of total site area). The project proponent has also proposed 2 nursery schools having an area of 2583.54 sq. yards (0.57% of total site area). The project proponent has proposed to develop 06 parks having an area of 32802.77 sq. yards (7.22% of total project area). There is 4390.21 sq. yards area (0.86% of total project area), which is not taken into scheme by the project proponent. Further, there are 11 pockets of green area having total area of about 8620 sq. yards (1.70% of total project area). The remaining area will be covered under roads, commercial parking, public toilets & drinking water, solid waste treatment site, STP area, Water works, Electric Grid, Health Centre, temple and community center. 5. The project proponent has submitted feasibility report regarding treatment and disposal of waste water to be generated from proposed residential colony. Estimated population in residential plots will be 6450 persons and the total water requirement of residential colony will be 874 KLD, out of which 584 KLD ground water will be extracted from the borewell and remaining 290 KLD will be treated water from STP, which will be mainly used for flushing purpose. 6. Estimated waste water generation will be around 700 KLD and the same will be treated in STP of capacity 1250 KLD based on MBBR technology. The STP will consist of bar screen chamber, oil & Grease chamber, collection cum equalization tank, settling chamber, Grit chamber, MBBR I & II, secondary tube settler, sump, sand filter, carbon filter, outlet for irrigation, reuse for flushing & construction work. 7. Treated effluent generation will be 686 KLD, out of which 290 KLD will be re-used for flushing and remaining 396 KLD treated water will be discharged onto land for plantation. The project proponent has proposed to develop 7.22% of total area under plantation, 1.70% of total area as greenbelt and 0.86% of total area as area not under scheme. Thus, total available area for discharge of 396 KLD treated water is 10.29 acres (9.78% of total project area). Thus, the residential colony has sufficient land to handle its 396 KLD treated water. 8. The project proponent has submitted letter stating that 06 parks of area 32802 square yard & 11 green pockets of area 8020 square yard will be developed like parks 20 KLD treated water will be used in horticulture. 4390 square yard area which is not in scheme will be developed as per karnal technology and there is about 07 acres land owned by M/s Home Life Buildcon Private Limited in the revenue estate of village Bains, Tehsil Ludhiana West, adjacent to proposed project which will be developed as per karnal technology. Total 7.9 acres developed as karnal technology will handle 396 KLD of treated water. At present, entire 07 acre, 03 kanals land is under the possession of M/s Homelife Buildcon Pvt. Ltd. 9. As per feasibility report submitted by the project proponent, total solid waste generation will be 2728 Kg/day. The project proponent has reserved 692.65 sq. yards area for solid waste treatment facility. About 1228 kg/day bio-degradable municipal solid waste will be generated and the same will be converted into manure through composter. Remaining non-bio-degradable municipal solid waste will be lifted by authorized agency. At present M/s A2V Waste Management Pvt. Ltd. is collecting solid waste of this area. 10. There is no MAH industry within a radius of 250 meter from the proposed site of colony. Also there is no air polluting industry within a radius of 100 meter from the proposed site of colony. There is no air polluting industries such as rice sheller/ saila plant / brick kiln/ stone crushing/ screening cum washing unit/ hot mix plant/ cement plant etc within a radius of 500 meter from the proposed site. The site is suitable for establishment of residential colony as per Government of Punjab’s Notification no: 3/6/07/STE(4)2274 dated 25.07.2008, as amended on 30.10.2009. 11. The project is covered under category 8(b) of the EIA notification dated 14.09.2006. The project proponent has applied for obtaining Environmental Clearance under EIA Notification dated 14.09.2006 vide proposal no: SIA/PB/INFRA2/412786/2023. Thus, the site is suitable for establishment of residential plotted colony and the project proponent has proposed adequate measures to control its water pollution and to handle its municipal solid waste. Keeping the above in view, it is recommended that ‘Consent to Establish’ (NOC) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent for 05 years to develop residential colony in an area of 105.23 acres in the revenue estate of village Ayali Kalan, Tehsil Ludhiana West, District Ludhiana subject to suitable conditions along with following special conditions:- 1. This CTE has been issued for development of residential township project consisting of 430 residential plots and 7.398-acre area under commercial & institutional plots as components, in total area of 105.23 acres for which CLU had been granted by the competent authority (99.27 acres vide no. 83 CTP(Pb)SP-432-L dated 06.01.2022 & 5.96 acres vide no. 3332CTP(Pb)SP-432-L dated 28.07.2022) falling under the following Khasra Nos mentioned therein, only. 2. The project proponent shall not carry out any o construction activity without obtaining Environmental Clearance under the EIA notification 14.09.2006. 3. The Project Proponent will comply with all the conditions imposed by the Chief Town Planner, Department of Town & Country Planning Punjab in the CLU issued vide no. 83 CTP(Pb)SP-432-L dated 06.01.2022 & vide no. 3332CTP(Pb)SP-432-L dated 28.07.2022. 4. The project proponent shall comply with the bye laws/ zoning guidelines, as prescribed by the Department of Town & Country Planning, Punjab / GLADA. 5. The project proponent shall utilize 290 KLD of treated wastewater for flushing purpose by providing dual plumbing system in its premises. 6. The project proponent shall utilise 396 KLD of treated wastewater in plantation area to be developed within its premises and shall not use fresh water for the same. 7. The project proponent will develop 4390.21 sq. yards area (0.86% of total project area), which is not taken into scheme as green belt. 8. The project proponent shall comply with the provisions of the Solid Waste Management Rules, 2016 and shall carry out onsite treatment of biodegradable solid waste, as per the provisions of the Solid Waste Management Rules, 2016. 9. The project proponent shall obtain permission from PWRDA for abstraction of groundwater and shall comply with the guidelines issued by it from time to time. 10. The promoter company shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 11. The project proponent shall obtain permission(s) from all the concerned department(s), as required. 12. This NOC is being issued to the project proponent based upon the undertakings/documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
