File Note: It is submitted that the subject cited rice sheller unit was granted consent to establish (NOC) under the Water Act, 1974 & Air Act, 1981 for operation of unit to produce Raw Rice/Sorted Rice @ 3 TPH with dryer, vide no. CTE/Fresh/MKS/2023/22484874 dated 23.06.2023, valid upto 22.06.2024, with suitable conditions mentioned therein. The rice sheller was visited by undersigned on 19.04.2024 and it was observed as under: - • The rice sheller was in operation during visit. The rice sheller has installed the machinery for the production of sorted raw rice with dryer. • The rice sheller has installed separate cyclone with dryer section and shelling section, however, no stack above roof level has been provided with it. • The rice sheller has provided septic tank for the treatment of domestic effluent. However, no scientific arrangement for disposal of treated domestic effluent has been provided. • The rice sheller has stored the rice husk inside the premises with wall height of about 12’, however, no wind screen has been provided over it. Accordingly, a show cause notice for violations of the provisions of the Water Act, 1974 & Air Act, 1981 was issued to the rice sheller vide this office letter no. 1751 dt. 22.04.2024 with an opportunity of show cause to explain its position in writing within 07 days. Further, the rice sheller has failed to apply for consent to operate and not submit any reply. Accordingly, a show cause notice for violations of the provisions of the Water Act, 1974 & Air Act, 1981 was issued to the rice sheller vide this office letter no. 2201 dt. 05.06.2024. Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 & the Air Act, 1981 for same production capacity alongwith requisite documents. The details of the case as under: The industry has submitted latest CA certificate dated 24.06.2024, stating value of fixed assets of Rs. 152.58 lakhs (including plant & machinery of Rs. 44.94 lakhs) as on date. The industry has deposited consent fee of Rs. 50400/- vide UTR No. N181243120131447 dated 29.06.2024 under the Water Act, 1974 & Rs. 50400/- vide onlilne R. No. N181243120130932 dated 29.06.2024 under the Air Act, 1981, which is adequate upto 30.09.2029 as per Board's order dated 29.10.2018. The industry has submitted undertaking regarding completion of APCD’s installed, compliance of NOC conditions and principle approval from invest Punjab portal. The industry was visited by the undersigned (AEE) on 26.07.2024 and observed as under: 1. The industry was not in operation during visit. 2. The industry has installed cyclone as APCD with shelling section and paddy pre-cleaner of dryer section, separately to contain the process emissions and the same was found in line / operationable conditions with dust emitting points connected to the APCD. 3. The industry has provided stack of adequate height with the APCD and provision to facilitate emission sampling. 4. The industry has provided brick wall of adequate length with 12’ height around husk discharge 5. / storage area and further mesh wire of 3' height has been provided above the said wall in compliance to code of practice prescribed by the Govt. vide order dt. 15.10.2013. 6. The industry has provided brick paving at movement area of vehicles, within its premises. 7. The industry has provided septic tank for treatment of domestic effluent with provision to discharge onto land for irrigation. 8. The industry has provided sapling along its boundary wall. The industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013. Keeping in view of above, it is recommended that consent to operate applied by the industry under the Water Act, 1974 & the Air Act, 1981 may be granted for operation of unit to manufacture Raw Rice/Sorted Rice @ 3 TPH with dryer for a period upto 30.09.2029 to the industry with suitable conditions along with special conditions that: a. The industry will get its stack emissions samples analyzed from Board's lab within 2 months, positively. b. The industry will discharge only treated domestic effluent onto land for plantation / green belt. c. The industry shall not increase its existing land area without prior permission of the Board. d. The industry shall not increase its production capacity without the prior written permission/NOC of the Board. e. The industry shall comply with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide order dated 15.10.2013.
