It is submitted that the industry is a small scale orange category rice sheller and was granted consent to establish/NOC from the Board under the Water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/MLK/2023/22495091 dated 03/07/2023 valid upto 02/07/2024 for manufacturing of Sorted Raw Rice with Dryer @ 4.0 TPH by processing of Paddy @ 6.0 TPH, as raw material under orange category with certain conditions mentioned therein and special conditions as under:-
1. The industry shall be bound to construct the building of unit after shifting 11 KVA high tension electric line as per the guidelines of the PSPCL authorities, failing which, action as deemed fit shall be initiated against the industry.
Earlier, the industry was given personal hearing before EE, RO, Sangrur on 15.02.2024 w.r.t. show cause notice issued for violating the provisions of the Water Act, 1974 and the Air Act, 1981, observed during visit on 05.02.2024. The proceedings of the same have been conveyed to the rice sheller vide letter no. 598 dated 21.02.2024 and the decisions of the hearing are as under:-
1. The industry shall submit Bank Guarantee of Rs. 50,000/- as an assurance to comply with provision of Water (Prevention and Control of Pollution) Act 1974, Air (Prevention and Control of Pollution) Act 1981 and code of practice prescribed for rice sheller units vide Government of Punjab, Department of Science, Technology and Environment notification no. 10/48/2004/STE(4)/932 dated 15.10.2013.
2. The industry shall apply for consent to operate under the Water Act, 1974 and the Air Act, 1981 within 07 days after OCMMS portal of the Board gets operational, failing which further action u/s 31-A of the Air Act, 1981 will be recommended to higher authorities of the Board.
3. Assistant Environmental Engineer-I, Regional Office, Sangrur shall visit the industry after a week to verify contentions made by the industry during hearing, collect air emission samples and submit fresh report in the matter including comments regarding shifting of HT wire.
Further, in compliance to the decision no. 3 of personal hearing, the rice sheller was visited by the undersigned along with your good self on 08.05.2024 and it was observed as under:-
1. The rice sheller has now provided the bag house as APCD with shelling section but it yet has not provided any APCD with dryer section.
2. The brick road yet has not provided for the movement of vehicles and no work in this regard started at site.
3. No adequate plantation has been developed along the boundary wall.
4. The rice sheller was not in operation during visit, hence sampling could not be carried out.
The rice sheller has neither applied for consent to operate under the Water Act, 1974 and the Air Act, 1981 nor deposited bank guarantee of Rs. 50,000/- as per the decisions of personal hearing given before the EE, RO, Sangrur on 15.02.2024.
Now, the industry has applied for obtaining fresh consents under the Water Act, 1974 and under the Air Act, 1981 for same production i.e. manufacturing of Sorted Raw Rice with Dryer @ 4.0 TPH by processing of Paddy @ 6.0 TPH, as raw material.
The rice sheller has deposited Rs. 16,700/- (Rs. 10,800/- as consent fee + Rs. 5400/- as penalty fee + Rs. 500/- as application fee) vide no. 356957448 dated 06.06.2024 under the Water Act, 1974 and Rs. 19,100/- (Rs. 10,800/- as consent fee + Rs. 5400/- as penalty fee + Rs. 2400/- NOC regularization fee + Rs. 500/- as application fee) vide no. 385682575 dated 06.06.2024 under the Air Act, 1981. The industry has submitted the CA certificate for the value of fixed assets Rs. 243.16 Lacs as on 25.04.2024. The fee deposited by the industry is adequate upto 30.09.2024 under the Water Act, 1974 and the Air Act, 1981.
The industry has now submitted bank guarantee amounting Rs. 50,000/- bearing BG No. 034GT02241760004 dated 24.06.2024 valid upto 23.06.2025.
The industry has submitted an undertaking regarding the APCDs installed by the industry. The industry has installed Common Bag filter for the control of process emissions from Shelling and Dryer Section. The industry has also submitted compliance report of previous consent conditions earlier granted to it for setting up a rice sheller unit.
The industry has submitted approved building plan duly approved by Competent Person approved by Director of Factories, Punjab.
The industry has submitted its stack emission sampling report as per which results are within prescribed limit.
To verify the compliance of decisions of personal hearing & the code of practice, the rice sheller was visited by AEE (O) on 25/07/2024 and it was observed as under : -
1. The rice sheller was not in operation during visit, hence sampling could not be carried out.
2. The industry has covered all the processing sheds.
3. The rice sheller has now provided common bag house filter as APCD with shelling section and dryer section.
4. The industry has provided brick wall of 10 feet height in front of the discharge point of rice husk area and the length of aforesaid brick wall is 35' on each side of the rice husk discharge point. The industry has provided Jali of height 5 ft above this wall.
5. The industry has no source of trade effluent generation.
6. The industry has constructed septic tank for treatment of domestic effluent of the toilet section and disposal onto land for plantation.
7. Plantation has been developed along the boundary wall.
8. The rice sheller has bought bricks at site for stabilizing movement area. The representative of the industry informed that the work regarding stabilizing movement area will be started after monsoon season.
9. The industry has now removed High Tension 11 KV wire from its premises.
In view of above, it is recommended that consent to operate granted under the Water Act, 1974 & the Air Act, 1981 may be granted for a short period i.e. 30/09/2024 for manufacturing of Sorted Raw Rice with Dryer @ 4.0 TPH by processing of Paddy @ 6.0 TPH, as raw material under orange category, with suitable conditions and special condition that the industry shall got analyzed its stack emission samples from Board’s lab as soon as it comes into operation in upcoming paddy season and shall provide paved road on movement area of vehicles within two month and shall submit the report of the same in this office.
