It is a large scale red category group housing construction project located at Village Jaspal Bangar and Sangowal in critically polluted area Ludhiana………………………... Earlier the project proponent has obtained Environment Clearance issued by MOEF vide no. SEIAA/2017/354 dated 24.04.2017 under EIA notification dated 14.09.2006 for establishment of group housing project & commercial namely “Umbera Green” at Village Jaspal Bangar & Sangowal, District Ludhiana, Punjab by M/s Umbera Group…………………………. The total plot area of the project was 35249 sqm and the total built up area was 119655 sqm. The project consists construction of 19 towers (G+13/14 storey buildings) having total 1091 flats, roads, community building, commercial buildings, school, green park area etc with suitable conditions along with specific conditions for pre-construction phase(IV) provision shall be made for the housing of construction labour within the site will all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, disposal of waste water & solid waste in an environmentally sound manner, safe drinking water, medical health care, creche etc. The housing may be in the form of temporary structures to be removed after the completion of the project………………………... The total water requirement for the project was 864 KLD which includes fresh water requirement 574 KLD. The fresh water requirement will be met through own tube-well. The total wastewater generation from the project was 594 KLD including wet weather flow, which will be treated in a STP of capacity 610 KLD to be installed within the project premises…………….…………….. In summer season, the project proponent has proposed to utilize 251 KLD of treated wastewater for flushing purpose, 39 KLD for horticulture purposes and 304 KLD for plantation purposes through Karnal technology…………………………. In winter season, 251 KLD of treated wastewater for flushing purpose, 14 KLD for horticulture purposes and 329 KLD for plantation purposes through Karnal technology will be utilized…………………….. In rainy season, 251 KLD of treated wastewater for flushing purpose, 11 KLD for horticulture purposes and 332 KLD for plantation purposes through Karnal technology will be utilized……………………... The project proponent has proposed to develop 8.95 acre land as per Karnal technology and 7060 sqm green area to utilize treated waste water, till the public sewer connection is not available…………. The project proponent was earlier granted consent to establish (NOC) through Invest Punjab vide no. PBIP/PPCB/2019/CTE-301 dated 25.04.2019, valid upto 31.03.2020 for constructing residential group housing having 19 towers consisting of 1091 dwelling units over an area of 8.71 acre and built-up area 119655 sqm. The STP @ 700 KLD capacity which will be installed by the promoter in phased manner i.e. 250 KLD, 250 KLD and 200 KLD. The treated waste water will be utilized for following purposes: 1. 251 KLD for flushing purposes. 2. 39 KLD for horticulture purpose in summer. 3. 14 KLD for horticulture purpose in winter. 4. 11 KLD for horticulture purpose in rainy. 5. Rest (maximum of 332 KLD in rainy summer) onto land for plantation as per Karnal Technology in an area of 8.95 acres till sewer connection is not available. Earlier, the site of the project was visited by AEE of RO on 29.05.2020 and it was observed that the waste water of labour section was being discharged into soakage pit without any treatment. The project proponent had not developed any plantation area for discharging of waste water. The project proponent had not provided mobile toilets, mobile STP at site. The project proponent had not provided any arrangement for handling of solid waste in an environmentally sound manner, same was disposed adjoining area……………….. Thereafter, notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 was issued to the project proponent with an opportunity of personal hearing before worthy Chairman of the Board on 11.08.2020, wherein it was decided that: 1. The project proponent shall apply for obtaining consent to establish (NOC) of the Board under Water Act, 1974 and Air Act, 1981, within 07 days. 2. The project proponent shall remove all the discrepancies pointed out by the officials of the Board within 15 days. 3. The project proponent shall comply with all the terms and conditions of Environmental Clearance granted to it and shall submit the compliance in annotated form to Regional Office-4, Ludhiana. 4. The project proponent shall install fixed/ permanent sewage treatment facility in the project premises on the designated area as demarcated in the approved layout plan of the project. 5. Environmental Engineer, Regional Office-4 shall visit the project site within 15 days, verify the compliance made by the project proponent to the observations and to the terms and conditions of the Environment Clearance and shall submit report along with recommendations within 15 days. In compliance of hearing, the industry was visited by the AEE of RO on 27.05.2023 and it was observed as under:- 1. The project proponent has constructed 570 flats (02 BHK + 03 BHK). 2. The project proponent has not shown the approved building plan from the Competent Authority during the visit. 3. The project proponent has provided STP for the treatment of waste water generated from the project. The project proponent has not provided any provision at the outlet of STP for the collection of effluent samples. Further leakage has also been observed near the filter section of STP. Further the conditions of STP reveals that it is not being operated properly. 4. No record regarding the operation of STP and energy meter readings was produced during the visit. The project proponent has not provided proper pipe network for utilization of treated waste water onto land for plantation. 5. During visit, the project proponent has not shown the fully developed area of 8.95 acre which is to be specifically developed for plantation purpose as per Karnal Technology. The project proponent has failed to show the dual plumbing system which is to be developed for utilizing of treated waste water for flushing. 6. No color coding of different pipelines carrying water/ waste water/ treated waste water has been provided by the project proponent. 7. The project proponent has not installed the compost pits/ vermin composting/ bio- composter for managing solid waste. 8. The project proponent has not shown the rain water harvesting pits for ground water recharging. 9. The project proponent is running without consent to operate under the Water Act, 1974 and under the Air Act, 1981. The project proponent had failed to comply with the decisions of personal hearing dated 11.08.2020 and thus violating the provisions of Water Act, 1974 and Air Act, 1981 as well as conditions of Environment Clearance and NOC granted to the project proponent……………… Further, notice u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 was issued to the project proponent with an opportunity of personal hearing before worthy Chairman of the Board on 30.10.2023 and wherein it was decided that: 1. Environmental Compensation (EC) be imposed on the project for degrading the environment. 2. Environmental Engineer, Regional Office-4, Ludhiana shall calculate the amount of Environmental Compensation (EC) to be imposed to the project from the date of violation to till date and get is verified by the EC verification committee, within 15 days. 3. The project proponent shall apply for NOC/Consent operate under the Water Act, 1974 and Air Act, 1981, within 07 days. 4. Environmental Engineer, Regional Office-4, Ludhiana shall re-visit various compliance and submit comprehensive report/ recommendations, within 15 days. 5. Further action in the matter will be taken after receiving receipt the report from Regional Office. In compliance of hearing, the project was visited by the AEE of RO on 24.01.2024 and it was observed as under: - 1. The project proponent has constructed 570 flats (2 BHK + 3BHK). 2. The project proponent has provided STP for the treatment of waste water generated from the project. During visit the effluent sample has been collected from the outlet of the STP and as per analysis results the concentration of various parameters are found to be pH @ 7.6, TSS @ 15, TDS @ 2080, COD @ 32, BOD @ 7 and oil & grease @ BDL, which are within permissible limit as prescribed by the Board. 3. The treated waste water is utilized onto land for plantation which has been developed as per karnal technology. 4. The PP failed to show the record regarding the operation of STP and energy meter readings. 5. The project proponent has not installed the compost pits/vermi composting/bio-composter for managing solid waste. 6. The project proponent is running without Consent to Operate Water Act, 1974 and Air Act, 1981. Further, notice to issue directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 was issued to the project proponent with an opportunity of personal hearing before Chairman of the Board on 14.06.2024. However, no one from the project attend the hearing and wherein it was decided that: 1. The project proponent shall stop the construction activities at the site with immediate effect and stop forthwith discharging any effluent/ wastewater into sewer/ inland surface water/ onto land or through any other mode. 2. The project proponent shall not allow any new occupancy and shall not allow any new possession in the premises of the project, with immediate effect. 3. The Revenue Authorities shall not register any sale deed related to any plot/ flat/ house/ shop/ any other component of this project with immediate effect. 4. The PSPCL authorities shall not release any electric connection for this project or any of its components, with immediate effect. 5. GLADA/ concerned authorities be directed not to issue/ cancel the license/ LoI and not to approve the building/ layout plans for the development of the project. It shall take necessary action to stop the further construction activities related to the project, till the project proponent obtains consent to establish (NOC)/ consents from the Board under the Water (Prevention & Control of Pollution) Act, 1974, with immediate effect. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 has been issued to GLADA vide Board letter no. 4215 dated 02.07.2024 to complying with following directions:- "That the authorities concerned shall not issue/ cancel the license/ Lol and not to approve the building/ layout plans for the development of the project. It shall take necessary action to stop the further construction activities related to the project, till the project proponent obtains consent to establish (NOC)/ consents from the Board under the Water (Prevention & Control of Pollution) Act, 1974 with immediate effect.” Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 has been issued to the Sub-Registrar-Cum-Tehsildar (West), Ludhiana vide Board letter no. 4218 dated 02.07.2024 to complying with following directions:- “That the authorities concerned shall not allow any sale deed related to any plot/ flat/house/ shop/ any other component of this project with immediate effect." Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 has been issued to the PSPCL authorities vide Board letter no. 4221-22 dated 02.07.2024 to complying with following directions:- "That the authorities concerned shall not release electric connection /expansion / extension of connection to any plot/ flat/ house/ shop/ any other component of this project with immediate effect." The compliance of said directions has already been conveyed to the GLADA, Sub-Registrar-Cum-Tehsildar (West), Ludhiana and PSPCL authorities by the Board and compliance of same is yet to be received……………………….. The project proponent has now applied Consent to Establish (NOC) under the Water Act, 1974 and under the Air Act, 1981 and also partial consent to operate under the Water Act, 1974 and under the Air Act, 1981 through OCMMS which is being dealt separately………………………….. The project proponent has now obtained revised Environment Clearance issued by MOEF vide no. SEIAA/MS/2022/5006 dated 19.01.2022 under EIA notification dated 14.09.2006 for establishment of Group Housing & Commercial Project namely “Umbera Green” at Village Jaspal Bangar & Sangowal, District Ludhiana, Punjab to M/s Umbera Group (SIA/PB/223530/2021). The total plot area of the project is 35249 sqm and the total built up area is 117406 sqm. The project consists construction of flats @ 1042 Numbers, Shops @ 16 Numbers. After completion, the total domestic water requirement for the project will be 788 KLD. The project proponent has proposed to utilize 234 KLD of treated wastewater for flushing purpose and final discharge will be 294 KLD. The total municipal solid waste generation proposed is 2184 Kg/day and green area 7076 sqm with following conditions: 1. The project proponent shall obtain separate permission from Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water for meeting the total water requirements of the project. 2. As proposed, project proponent shall spend an additional amount of Rs.10 lacs (Total Rs.15 Lacs) on CER activities like tree plantation in the nearby Schools and other surrounding areas of the project and improving the health care and education facilities in villages within 1 year under the Environmental Management Plan (EMP) of the proposed project. Regional Office reported that as per directions of the competent authority, the Environmental Compensation has been calculated through e-office no. 216211 dated 19.02.2024, which is under process………………….. The project proponent has applied for partial consent to operate under the Air Act, 1981 and under the Water Act, 1974 through OCMMS on 10.07.2024 & 25.07.2024 respectively for 570 flats & commercial and for discharge of domestic effluent @ 180 KLD onto land for irrigation after treatment of STP (167 KLD treated effluent reuse for flushing purpose @ 128 KLD and for green area @ 39 KLD).……………………….. The project proponent has deposited consent fee, which is adequate upto 31.03.2025…………… The project proponent has obtained CLU issued by STP, Ludhiana vide PBIP/STP/2016/725 dated 29.11.2016 as per which the proposal site has total area of 8.71 acres for setting up of Residential Group Housing Project namely Umbera Group located at Village Jaspal Bangar and Sangowal, Ludhiana…………………… The project proponent has submitted layout plan approved by STP, Ludhiana vide no. 1949 dated 28.08.2020, as per which the proposal site has total area of 8.71 acres for setting up of Residential Group Housing Project namely Umbera Group located at Village Jaspal Bangar and Sangowal, Ludhiana…………………………. The project proponent has also submitted dimensional drawing of STP and it has proposed following components screen chamber, oil& grease, collection tank, MBBR-1, MBBR-2, tube settler, filtration tank, filters……………………… The project proponent has been raised clarification to submit compliance of the directions issued by the Board. In reply to it, the project proponent has submitted that No construction activity is under progress and they have made compliance w.r.t. environmental laws and Board directions issued to it and it has further requested to defer the directions issued to the other authorities……………. The project was visited by the AEE of RO on 26.07.2024 and it was observed as under:- 1. The project proponent has constructed 570 flats (2 BHK + 3BHK). 2. The project proponent has provided STP for the treatment of waste water generated from the project. The effluent samples has been lastly collected from the outlet of the STP on 24.01.2024 and as per analysis results the concentration of various parameters are found to be pH @ 7.6, TSS @ 15, TDS @ 2080, COD @ 32, BOD @ 7 and oil & grease @ BDL, which are within permissible limit as prescribed by the Board. 3. The treated waste water is utilized onto land for plantation which has been developed as per karnal technology. 4. The project proponent has installed mechanical composter of capacity 500 Kg. 5. The project proponent has also applied for partial consent to operate under the Water Act, 1974 and under the Air Act, 1981 through OCMMS which is being dealt separately. 6. The project proponent has requested that they have complied with directions issued by the Board as such its directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be deferred. As discussed with Regional Office telephonically, now Regional Office has reported through e-mail dqated 29.07.2024 that the project namely M/s Umbera Green Group Housing Project, Village Jaspal Bangar and Sangowal, Ludhiana is an existing project and the status of various key entities from 500 m radius of the this site: 6. No rice sheller/ stone crusher/ hot mix plant/ cement grinding unit/ brick kiln exist within 500 meters from the proposed site. 7. There is no jaggery, existing within 100 meters of the site. 8. There is Sidwan Canal passing adjoining the site. 9. There is no common bio-medical treatment facility within 500 meters. 10. There is no MAH industry existing within 250 meters. The proposed site is complying with the sitting guidelines framed by the Government of Punjab for such a project…………………………… As proposed by Regional Office, may, if approved: 1. Partial consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 be granted upto 31.03.2025 for 570 flats & commercial subject to suitable conditions and special conditions as under: i. The project proponent shall be liable to pay the Environmental Compensation as determined by the competent authority of the Board for its past violations and Board's competent authority reserves the right to take decision in this regard. ii. The project proponent shall submit compliance w.r.t following condition imposed in its Environmental Clearance. "The project proponent shall obtain separate permission from Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water for meeting the total water requirements of the project." iii. The project proponent shall submit compliance w.r.t following condition imposed in its Environmental Clearance. "As proposed, project proponent shall spend an additional amount of Rs.10 lacs (Total Rs.15 Lacs) on CER activities like tree plantation in the nearby Schools and other surrounding areas of the project and improving the health care and education facilities in villages within 1 year under the Environmental Management Plan (EMP) of the proposed project." iv. The project proponent shall develop adequate green area for utilization of treated effluent as per the Karnal Technology. v. The project proponent shall comply with the provisions of Solid waste management Rules, 2016. vi. The project proponent shall comply with the provisions of the Noise Pollution (Regulation & Control) Rules 2000. vii. The project proponent shall ensure compliance to the comprehensive guidelines for the regulation of noise/ sound pollution caused by use of loud speakers, public address system etc. issued by Punjab Government, Deptt. of Science, Technology & Environment vide notification no. 3/100/2013-STP(4)/145 dated 26.02.2014. viii. The industry shall obtain permission from the concerned Department(s) and shall comply with the conditions of relevant permissions obtained by it from other related Departments (if any). ix. The Consent to establish is being issued to the project proponent based upon the undertakings/documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/ project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. x. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the promoter. xi. The project proponent shall ensure compliance with all conditions of Environment Clearance granted to it. 2. EE, RO -4 be requested to visit the site and marked plantation area reserved for plantation area as mentioned in EC granted to the project proponent. Competency: Worthy Chairman of the Board
