It is submitted that the industry is a small scale orange category rice sheller and earlier, it was granted consent to establish/NOC from the Board under the Water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/MLK/2023/22854882 dated 01/08/2023 valid upto 31/07/2024 for manufacturing of Sorted Raw rice with dryer @ 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material under orange category with certain conditions mentioned therein.
Now, the industry has applied for obtaining fresh consents under the Water Act, 1974 for same production i.e. manufacturing of Sorted Raw rice with dryer @ 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material.
The rice sheller has deposited Rs. 42,000/- as consent fee vide no. N093242964631641 dated 02.04.2024 & Rs. 8400/- as penalty fee vide no. AXSK241860012746 dated 04.07.2024 under the Water Act, 1974. The industry has submitted the CA certificate for the value of fixed assets Rs. 122.74 Lacs as on 28.06.2024. Thus, the fee deposited by the industry is adequate upto 30.09.2028 (after deducting penalty fee from 30.09.2023) under the Water Act, 1974.
The industry has submitted compliance report of previous consent conditions earlier granted to it for setting up a rice sheller unit.
The industry has submitted approved building plan duly approved by Competent Person approved by Director of Factories, Punjab.
To verify the compliance of consent conditions earlier granted to the rice sheller & the code of practice, the rice sheller was visited by undersigned on 15/07/2024 and it was observed as under : -
1. The industry was not in operation due to off season, during visit.
2. The industry has covered all the processing sheds.
3. The rice sheller has no source of trade effluent generation. The domestic effluent generated from the industry is being discharged onto land for plantation after passing through septic tank.
4. The industry has planted sapling of trees along the boundary wall.
It is pertinent to mentioned here that the application of the industry for obtaining consent to operate under the Air Act, 1981 has been returned as the penalty CTO fee was not deposited by the applicant. The industry has been guided to resubmit the application along the submission of penalty fee and the industry is in the process of re-submitting the same. The field observations relating provisions of the Air Act, 1981 will be submitted therein.
In view of above, it is recommended that consent to operate granted under the Water Act, 1974 may be granted upto 30/09/2028 (upto adequacy of fee) for manufacturing of Sorted Raw rice with dryer @ 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material under orange category, with suitable conditions.
