File Note: It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/LDH2/2020/12608034 dated 18/06/2020 valid upto 30/06/2025 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH2/2020/12607983 dated 18/06/2020 both valid upto 30/06/2025 for the manufacturing of Rounds, bars, Flats and Squares @ 187 MTD. Further, the industry has obtained ‘consent to establish'/ (NOC modernization) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Mod/LDH2/2020/12625350 dated 16/06/2020 valid upto 13/06/2021 for use of additional fuel i.e. coal @ 20 TPD alongwith existing fuel i.e. F.O. @ 12.6 KLD with suitable conditions and additional conditions that the industry shall submit completion certificate from the PSCST, Chandigarh for APCD to be installed for the coal fired re-heating furnace at the time of consent to operate. It is pertinent to mention here that the industry has never implemented NOC modernization i.e. it has never used coal as fuel and is operating its reheating furnace only on Furnace oil as fuel. However, the industry has increased its fixed assets from Rs. 847.03 Lacs to Rs. 1190.07 Lacs and submitted complete detail of said inrease, so, it has applied for obtaining varied 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. There is no increase in the pollution load as well as production capacity due to increase in fixed assets. Now, the subject cited industry has applied for obtaining varied consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 1190.07 Lacs as on 31/03/2024 as per CA Certificate dated 21/06/2024, which is adequate upto 30/09/2029 under Water Act, 1974 and Air Act, 1981, as per Board's Office Order dated 29/10/2018 after deducting NOC regularization fee. The industry was visited by undersigned on 26.07.2024 and it was observed as under: 1. The industry was in operation during visit. 2. The industry has installed re-heating furnace of capacity 10 TPH. 3. The industry has installed wet scrubber as APCD for control of emissions generated by using Furnace oil as fuel. 4. APCD was in operation during visit and stack was almost clear. 5. Stack sample was collected from the port hole of the stack by the Board on 16.10.2023 and as per analysis report SPM is reported as 57 mg/Nm3 against the prescribed standard of 150 Mg/Nm3. 6. There is no generation of trade effluent and cooling water is being recirculated. 7. The industry has provided separate energy meter to note down APCD operation & its reading was 93321.8 kwh. 8. Domestic effluent is being discharged into sewer. 9. The site of the industry falls in industrial zone as per Master Plan, Ludhiana. In the subject cited case, the industry has mentioned ground water extraction @ 25 KLD. Considering 25 working days per month, ground water extraction will be 625 KL/month, which is more than 300 KL/month. The industry has obtained permission for ground water extraction from PWRDA vide no. GW/PWRDA/06/2024/L1/194 dated 12.06.2024 valid upto 11.06.2027. It is pertinent to mention here that MoEF/CC vide notification no. SO 2215 (E) dated 07.06.2024 has exempted stand-alone rolling or re-rolling mills from obtaining Environmental Clearance under EIA Notification, 2006. It is therefore recommended that 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/09/2029 with suitable conditions as per policy of the Board.
