Subject: Application for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981-M/s Tooleasy Ispat Udyog Private Limited, Village Wazirabad, Tehsil Amloh, Distt Fatehgarh Sahib.
It is intimated that the industry was granted consent to establish under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through vide no. CTE/Fresh/FGS/2023/24026767 dated 03/11/2023 valid upto 03/11/2024 for manufacturing of ERW Pipes @ 60 MTD.
Now, the industry has applied for fresh consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the manufacturing of ERW Pipes @ 60 MTD under green category with requisite documents.
The industry has deposited of Rs. 42000/- through vide no. 275762396 dated 23/07/2024 as water consent fee and Rs. 42000/- through vide no. 958653121 dated 23/07/2024 against the fixed assets of Rs. 488.61 Lakhs as on 23/07/2024 as per CA certificate dated 23/07/2024. Which is adequate upto 30/06/2029 as per order dated 29/10/2018.
The industry has submitted approved building plan from Er. Gurmeet Singh Competent Person of Director of Factories.
To verify the contents, the industry was visited by the AEE of this office on 25/07//2024 During the visit, it was observed as under:
1. The industry was in operation during the visit.
2. The industry has installed 03 no. of ERW pipe plant that operates on electricity and produce of ERW Pipes @ 60 MTD by using Patra @ 61 MTD.
3. The unit has not installed any air polluting machinery like boiler, furnace etc.
4. There is no generation of trade effluent and only domestic effluent is generated which is being discharged onto land for plantation after passing through septic tank.
5. The date of commissioning is 23/07/2024 as per sale bill of the industry.
Further as per notification dated May 2023, ERW pipes have been exempted from the preview of EIA notification dated 14/09/2006.
Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:
"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."
PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the industry has mentioned ground water extraction @ 2.5 KLD. Considering 25 working days per month, ground water extraction will be 62.5 KL/month, which is less than 300 KL/month. Therefore, the unit does not require to obtain permission from the PWRDA.
The said site is located in Industrial Zone as per land use classification certificate issued by Distt Town Planner, Fatehgarh Sahib vide no. 603 dated 28/02/2023. The industry is complying with the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of above, if approved it is recommended that fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of ERW Pipes @ 60 MTD may be granted upto 31/12/2028 with suitable conditions and special conditions as under:
1. The unit is advised to obtain necessary clearance for abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA), if need be.
2. The entrepreneur/industry shall obtain necessary statutory permissions /clearances from all other concerned departments.
3. The industry shall not generate and discharge any kind of trade effluent.
4. The industry shall not install boiler, furnace without prior approval of the Board.
5. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocal or any other non-biodegradable material in the premises.
6. The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
