The industry is a rice sheller unit, which was granted 'consent to establish' (NOC) of the Board vide no. CTE/Fresh/SGR/2023/22464475 dated 22.06.2023, valid upto 21.06.2024 for the production of Sorted raw rice (with dryer) @ 2.0 TPH by processing of Paddy @ 3.0 TPH as raw material under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, under the orange category, subject to the conditions mentioned therein.
Now, the industry has now applied for obtaining fresh consents under the Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 for production of Sorted raw rice (with dryer) @ 2.0 TPH by processing of Paddy @ 3.0 TPH, under the orange category. The industry has deposited consent fee as mentioned at serial no. VII under both the Acts against the total fixed assets of the industry of Rs. 174.71 Lacs as on 31.03.2024 vide CA certificate dated 01.06.2024, which is adequate upto 30.09.2028 after considering the penalty fee for late applying for obtaining consents to operate under the said Acts, as the industry has start operation in previous season, which had been started since 01.10.2023.
The industry has submitted an undertaking regarding the installation of APCDs as per the pollution control laws.
The industry has also submitted copy of building plan. However, the same are not approved from Director of Factories, Punjab.
Accordingly, the industry was visited by Er. Lovepreet Singh, JEE (OS) on 15/07/2024 and during visit, it was observed as under: -
1. The industry was found in operation.
2. The industry has installed all the machinery as per the NOC obtained from the Board.
3. The industry has provided separate Cyclone Separator as APCD along with stack of adequate height to control the process emission from shelling section . However, no APCD has been provided with Dryer section.
4. The industry has provided sampling arrangement for the APCDs.
5. The industry has provided proper husk storage area and the industry was advised to cover husk area with HDPE sheets.
6. The industry has not provided brick paved road from main gate of the industry to the rice room/husk area for the movements of vehicles.
7. The industry has no source of trade effluent generation and the industry has provided septic tank for treatment of domestic effluent to be generated from toilets / washrooms. However, it has not made any plantation along boundary wall to utilize treated domestic effluent after septic tank and the treated water is being lifted through movable tankers.
8. The industry has provided the keri road inside their premises for the movement of vehicles.
9. The industry is complying to the code of practice as prescribed for the rice sheller.
Due to short-comings observed during visit as mentioned at sr. no. 3,6, & 7, vide this office letter no. 3687 dated 24.07.2024 a notice with an opportunity to show cause within 7 days was issued to the industry. In reply to the SCN, the industry has submitted reply along with photos (proof of completion of work), which is attached in agenda note.
To verify the submission made by the industry, the rice sheller is now visited on 29.07.2024 by undersigned, and it was observed as under: -
1. The industry has provided separate Cyclone Separator as APCD along with stack of adequate height to control the process emission from shelling section as well as dryer section.
2. The industry has provided outlet onto land for plantation with the septic tanks installed at office/labor sides.
3. The industry has now provided adequate plantation alongwith its boundary wall.
From the above, it is clear that the rice sheller is complying with violations made observed during visit.
In view of above, May if approved, the industry may be granted fresh 'consents to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 upto 30/09/2028 for production of Sorted raw rice (with dryer) @ 2.0 TPH by processing of Paddy @ 3.0 TPH with terms and conditions and special conditions that:-
1. This consent is valid for manufacturing of Sorted raw rice (with dryer) @ 2.0 TPH by processing of Paddy @ 3.0 TPH.
2. The industry shall get it’s air emission samples analyzed from Board’s lab within a month of start of upcoming season.
3. The industry shall obtain necessary statuary permissions/clearances from all other departments.
4. The industry shall ensure that at any time the emissions do not exceed the emission standards laid down by the Board from time to time.
5. The adequacy and efficiency of the air pollution control device will be the entire responsibility of the industry.
6. The authorized outlet and the authorized fuel being used shall not be changed without the prior written permission of the Board.
7. The industry will comply with CGWA Guidelines.
8. The industry shall not discharge any fugitive emissions. All gases shall be emitted through a stack of suitable height, as per the norms fixed by the Board from time to time.
9. The industry will comply with the following code of practice notified by the Govt.
i) All the processing sheds be covered and have minimum ventilation as per the recommendations of Director of Factories.
ii) The industry should plant thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the rice Sheller.
iii) All dust emitting points should be properly hooded and dust extracted to a common point. At this exhaust point, dust coming here will be passed through a dust control system and air will be emitted through a stack of height 3 metres above the roof of the building.
iv) The management and handling of rice husk in the rice shelling units should be done as under:-
v) All the rice shelling units shall provide paved / brick roads / cement concrete roads/ metalled roads inside their premises for movement of vehicles, so as to prevent the generation of dust.
I. The industry shall provide proper rice husk storage facilities inside the factory premises and the height of brick wall in front of the discharge point of rice husk area should be at least 10' high or 3.5' higher than the discharge point of the rice husk pipe (whichever is more) and the length of aforesaid brick wall should be at least 35' on each side of the rice husk discharge pipe.
II. The industry shall provide a layer of wind screen of mild steel or some other similar material of at least 5' height above the brick wall. The wind screen system should have a porosity of ~30% to lower the wind velocities, thus reducing the amount of airborne particulate from storage, handling and loading / unloading areas of rice husk.
III. The minimum diameter at the outlet of discharge pipe of rice husk be kept as 15'' which can be maintained by extending the existing discharge pipe with the help of a conical shaped pipe of at least 3' length.
IV. Wherever the height of rice husk is 3' or more, the industry shall cover the heap of husk with HDPE warp knitted fabric completely, except the area near the discharge pipe. The HDPE warp knitted fabric be made of 100% virgin high density polymer of at least 70 gm/m2 weight having 40-45 hole/inch2 to prevent wind blowing of stored husk.
V. During transportation of rice husk through vehicles, it shall be covered from all sides with tarpaulin to prevent blowing of husk by winds.
10. The emission standards given in the order dated 13/9/2006 will remain operative for Rice Shellers and Saila Plants. These emission standards are reproduced as under:-
Emission Standards for Rice Shellers & Saila Plants in the State of Punjab will be applicable as under:-
a) Emission standards 750* SPM (mg/Nm3)
b) Inside the building TLV of air** SPM (mg/Nm3)
NOTE: * The existing units not meeting with the prescribed siting guidelines will meet with stack emission standards of SPM 500 mg/Nm3.
11. The industry shall continue to comply with the new code of practice notified by Govt. Notification no.10/48/2004-STE (4)/932 dated. 15/10/2013 at all the times.
12. The industry shall abide by the fresh directions (if any) issued by the Hon'ble Punjab & Haryana High Court/ Govt. / Board for compliance of code of practice of rice Sheller.
13. The industry shall not cause any nuisance/traffic hazard in vicinity of the area.
14. The industry shall put up display board indicating environment data at the main entrance gate.
15. The industry shall inform the Board in writing as and when any change is occurred in the Partnership Deed / Proprietorship / Memorandum of Article of Association, especially with regard to the name and address of the Partner/ Proprietor/ Director/ Subscriber etc., and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed / Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken.
16. The industry shall meet with the emissions standards as revised by MoEF & CC/Board time to time.
17. The industry shall provide brick road inside their premises for the movement of vehicles, within 3 months failing which, the consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be revoked.
