It is intimated that the industry is a small scale red category unit and was earlier granted consent to operate Under Water Act, 1974 vide no. CTOW/Renewal/LDH2/2023/23281068 dated 04/10/2023 expired on 03/04/2024 for manufacturing of products Metal Parts @ 2 T/day by using Plating Chemical @ 1 TPD as raw material.
It is submitted that PSPCL Authorities was requested to disconnect the electric connection available to the industry/premises (which was temporarily restored for six months i.e. upto 03.04.2024) immediately and to send the copy of TDCO to this office vide letter no 1485-89 dated 05.07.2024. In compliance, PSPCL authorities has disconnected the electric supply vide TDCO no. 1814 dated 02/07/2024.
Now, the industry has applied for varied consent to operate under Water Act, 1974 alongwith requisite document after increasing production i.e. manufacturing of product Metal Parts @ 4 T/day by using Plating Chemical @ 2 TPD as raw material. Accordingly, it has increased agreement for lifting of effluent from 2000 ltr/month to 5000 ltr/month.
The industry has already deposited consent fee against the un-depreciated fixed assets of Rs. 50.90 Lacs as per CA Certificate dated 11/07/2024, which is adequate upto 31/03/2026 under Water Act, 1974, as per Board's Office Order dated 29/10/2018 after deducting penalty charges 25 %.
The industry was visited by undersigned on 29.07.2024 and it was observed as under:
1. The industry was not in operation during the visit due to disconnection of electric supply.
2. The industry has made an MOU with JBR Technology Pvt. Ltd. for lifting its trade effluent generated from the electroplating process @ 5000 litre per month.
3. The industry has installed water meter on fresh water pipe line and reading of the same noted during visit was 38.880 KL. The industry had maintained proper record regarding water consumption and effluent lifting whenever the industry comes into operation.
4. The industry has lastly lifted waste water @ 2000 Ltr. to M/s JBR Technologies Ltd. vide manifest no. 515570 dated 25/06/2024.
5. The industry has provided red tiles on the floor to prevent spillage and has also provided direct disposal line to the storage tank.
6. The industry is complying with the provisions of Water Act, 1974.
In the subject cited case, the industry has mentioned ground water extraction @ 0.6 KLD. Considering 25 working days per month, ground water extraction will be 15 KL/month, which is less than 300 KL/month
Keeping in view of above, it is recommended that varied 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 may be granted for short period of six months and PSPCL authorities may be directed to restore the electric connection temporarily for six months with suitable conditions as per policy of the Board.
