File Note: It is intimated that the industry is a small scale red category dyeing unit and was granted "Consent to Establish" NOC extension Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Ext/LDH3/2023/20179799 dated 10.03.2023 for establishment of dyeing of pc/polyester cloth @ 8.5 Tonne/day and dyed acrylic yarn @ 720 Kg/day with discharge of trade effluent @ 342 KLD and domestic effluent @ 1.8 KLD into CETP 50 MLD, which was expired on 12.10.2023. Thereafter, the industry had applied for fresh consent to operate under Water Act, 1974 and Air Act, 1981. Accordingly SCN for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 19.07.2023. During the hearing, Competent Authority of the Board has decided as under:- 1. The industry shall submit the following data w.r.t. new unit to the Regional Office-3 of Punjab Pollution Control Board, Ludhiana, within 15 days: a) The industry shall submit data regarding abstraction of ground water / fresh water supply for the last three months. It shall provide EMFs on all sources of fresh water if not provided earlier. b) The industry shall earmark on map the location of all active / closed submersible pumps / fresh water sources. c) Details of dyeing machinery / other water consuming machinery along with specifications including production capacities specifying liquor ratio, number of lots, water consumption per lot, thus calculating the total fresh consumption (with duly authentication by the supplier of the machines). d) Numbers of shares held by the industry (duly certified by the SP) and it shall submit NOC from PDA / SPV regarding proposed discharge into common sewer of CETP. e) The industry shall get its shares demat and submit the documentary evidence in this regard. 2. Environmental Engineer, Regional Office-3, Ludhiana to authenticate the data certified by the industry and submit a conclusive report with regard to production to be allowed to the industry as well as corresponding effluent discharge, after one week of the submission of the above data by the industry. 3. In case of failure of the industry to submit the data as above, the recommendations be sent by the Environmental Engineer, Regional Office-3, Ludhiana to decide the case accordingly on merits. The industry failed to submitted compliance of above said decisions, accordingly the CTO applications under Water Act, 1974 & Air Act, 1981 were refused. It is pertinent to mention here that earlier the project proponent was operating its unit at a separate location with the same name i.e. M/s Hinglaj Processors, Jagdishpura, Tajpur Road, Ludhiana. The project proponent had applied for NOC for establishment of a 2nd unit with the same name at different location at Village Jamalpur Awana, Tajpur Road, Ludhiana and while obtaining the NOC, the project proponent had planned to operate both units with and had proposed utilized its shares in both units as per the requirement. But now project proponent has submitted an undertaking that he shall operate only one unit located at village Jamalpur Awana and he shall never operate its unit located at Jagdishpura. Now the industry has applied for fresh consent to operate under the Water Act, 1974 and Air Act, 1981 for dyeing and finishing of polyester fabric @ 15.85 T/day, or dyeing and finishing of cotton/polyester-cotton (PC) @ 6.340 T/day and dyeing and finishing of cotton/polyester cotton (PC) yarn @ 0.9 T/day with discharge of trade effluent @ 607.2 KLD and domestic effluent @ 1.8 KLD into CETP 50 MLD. The industry has deposited Rs. 14,400/- vide receipt No. 622713081 dated 27.10.2023 & Rs. 72,000/- vide R no. 364359457 dated 13.07.2024 under Water Act, 1974 and Rs. 14,400/- vide receipt No. 580827441 dated 27.10.2023 & Rs. 72,000/- vide R. no. 546521794 dated 13.07.2024 under Air Act, 1981. The consent fee deposited by the industry is adequate upto 30.06.2029 under both acts. The industry has already submitted the copy of certificate obtained from DTP, Ludhiana vide no. 2990/DTP(L)/M2A dated 12.10.2021 mentioning that the industry falls in industry Land Use Zone as per Master Plan Ludhiana (2010-2031). Hence, the industry site is suitable at its present location. The industry has also submitted certificate from Company Secretaries stating that 609 KLD shares has been DEMAT. The industry has submitted bills of PDA regarding discharge and as per these bills for the month of April 2024, May, 2024 & June, 2024 the average discharge of the industry into CETP conveyance system are 143.4, 179.29 KLD and 193.54 KLD respectively, which is well within the shares obtained as well as consent granted to it. The industry has submitted the detail regarding capacity of machines, number of lots, number of baths, liquor ratio, production and corresponding effluent generation. The industry has submitted the copy of approved building plan from the competent person under Factory Act. The industry was visited by the AEE of this office on 29.07.2024 and observed that:- 1. The industry was in operation and engaged in the process of dyeing of fabric and yarn. 2. The industry has installed 11 soft flow machines of capacities (600 kg X 1), (450 Kg X 3), (200 kg X 5), (100 kg X 2) and one sampling machine. The industry has also installed 6 no. cabinet machines of capacities 30 kg each inside the premises. The total installed chambers are 24 3. As per study carried out by Guru Nanak Dev Engineering College (GNE), the proposed generation of effluent from the 24 chambers is 480 KLD considering generation of 20 KLD from one chamber and the generation of effluent from 06 cabinet machines of 30kg each shall remain about 100.8 KLD, hence total generation of effluent shall remain about (480 + 100.8 = 580.8), which is within the quantum of shares obtained by the industry i.e. 609 KLD. 4. The industry has installed install boiler of capacity 8 TPH and thermopac of capacity 1000 U with cyclone separator as APCD. The industry was using rice husk during visit. 5. The industry has installed 02 D.G sets of capacities @ 320 KVA & 180 KVA with canopies and adequate stack height inside the premises. 6. The industry is complying with the provisions of Water Act, 1974 & Air Act, 1981. Moreover the existing unit of the project proponent situated at Jagdishpura, Tajpur Road, Ludhiana was visited at it was observed that the unit was not in operation and the physical condition of the unit was showing that the same has not been visited since long time. But still 06 soft flow dyeing machines were installed inside the premises however connections of the machines were not intact. Boiler was also installed inside the premises. The project proponent has informed that they have put the machinery on sale and they shall vacate the entire premises as soon as the machinery will be sold out. He ensure that they will not operate machinery installed in this premises. In view of above, it is recommended that:- 1. Fresh consent to operate under Air Act, 1981 may be granted to the industry for dyeing and finishing of polyester fabric @ 15.85 T/day, or dyeing and finishing of cotton/polyester-cotton (PC) @ 6.340 T/day and dyeing and finishing of cotton/polyester cotton (PC) yarn @ 0.9 T/day with discharge of trade effluent @ 607.2 KLD and domestic effluent @ 1.8 KLD into CETP 50 MLD with usual conditions upto 30.06.2029. 2. Directions u/s 33-A of Water Act, 1974 may be issued to the PSPCL authorities to disconnect the electric connection of M/s Hinglaj Processor, Jagdishpura, Tajpur Road, Ludhiana to stop the operation as well as discharge from that unit as now all the shares obtained by the project proponent have been utilized in their new unit situated at Jamalpur Awana, Tajpur Road, Ludhiana.
