It is submitted that the industry was granted/renewal consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide No. CTOW/Renewal/FGS/2023/23348738 & CTOA/Renewal/FGS/2023/23348739 dated 08.09.2023 which are valid upto 30.09.2028 for production Raw rice @ 01TPH capacity by using Paddy @ 1.5 TPH without mechanical drier with special condition that the industry shall not install mechanical drier without prior permission of the Bord.
The industry has change its management i.e Proprietor to Partnership firm and Sh. Sham Lal Proprietor of the firm has given special power of Attorney to his sons (1) Sh. Ajay Kumar and (2) Sh. Ashwani Kumar as partners of the firm.
Now, the industry has applied for varied consent to operate for change its Proprietorship firm to Partnership firm with requisite documents and consent fee.
To verify the contents of the application, the industry was visited by undersigned on 26.07.2024 and found that the industry was not in operation due to off season, but the industry has installed mechanical drier and as per previous record of this office, the site of the industry falls within limits of Municipal Council and within limits, drier cannot allow. But with the help of some documents, the partner of the industry claims that part of property is out of MC limit, where the machinery has been set up including drier.
Keeping in view of above, if approved, the applications of the industry for CTO under both Water & Air Act may be returned to the industry with the request that before re-apply for consent to operate, the industry shall obtained a report from the concerned Tehsildar regarding which part of the property outside of the MC limit.
