It is submitted that the project proponent has obtained consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/FZL/2024/24582244 and the Air Act, 1981 vide no. CTOA/Fresh/FZL/2024/24582239 dated 23.01.2024 for operation of ready mix concrete plant...............
Thereafter, the project proponent has applied for obtaining CTE for expansion for establishment of hot mix plant, in which SDM Abohar has reported the distance of the proposed site 500 m away from the lal lakir / phirni of the village as well as 200 meter away from the National Highway, which has been considered by the Board after affording an opportunity of personal hearing to the unit before the Senior Environmental Engineer on 08.02.2024. Hence, the PP obtained consent to establish (NOC for expansion) vide no. CTE/Exp/FZL/2024/24814447 dated 14.02.2024 for addition of hot mix plant at the site of the unit, subject to the following specific conditions:-................
1. The 'consent to establish' is granted to the industry for its establishment in the land area of 99 Kanals 07 Marla's in the revenue estate of Village Dunger Khera, Tehsil Abohar, Distt. Fazilka and in case any of the documents submitted by the industry are found incorrect/forged, the consent to establish granted to the project would be deemed to have been cancelled and the Board would not be responsible for the cost incurred by the project proponent in the matter. ...
2. The industry shall operate the HMP for a shorter period only for the completion of the four laning of National Highway Authority of India (NHAI) road project from Abhor to Fazilka under Bharat Mala Pariyojna. ...
3. The industry shall ensure that the stack of Hot Mix Plant i.e. the source of air emission should be at the farthest end of the area from the National Highway and Phirni/ lal lakir of village Dungar Khera....
4. The industry will comply with the code of practice as prescribed by the Board vide notification no. Admn./SA2/F.No.178/99/03 dt. 26.04.99 for hot mix plant. .............
The Sub Divisional Magistrate, Abohar vide its letter no. 2024/ABH/NHAI/53 dated 17.05.2024 has submitted clarification w.r.t. this office letter no. 411 dated 31.01.2024, which is reproduced as under:- “ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਤੇ ਹਵਾਲਾ ਅਧੀਨ ਪੱਤਰ ਰਾਹੀਂ ਆਪ ਵੱਲੋਂ ਮੰਗ ਕੀਤੀ ਗਈ ਰਿਪੋਟਰਟ ਤਹਿਸੀਲਦਾਰ ਅਬੋਹਰ ਪਾਸੋਂ ਲਈ ਗਈ । ਤਹਿਸੀਲਦਾਰ ਅਬੋਹਰ ਵੱਲੋਂ ਰਿਪੋਰਟ ਕੀਤੀ ਗਈ ਕਿ “ਦਰਜ ਖਸਰਾ ਨੰ. 121//8 ਦੀ ਫਿਰਨੀ (ਰੋਡ) ਤੋਂ ਦੂਰੀ 500 ਮੀਟਰ ਤੋਂ ਵੱਧ ਹੈ, ਪਰ ਕਰੋਅ ਫਲਾਈ ਅਨੁਸਾਰ (ਸਿੱਧੀ) ਮਿਣਤੀ ਕੀਤੀ ਜਾਵੇ ਤਾਂ ਦੂਰੀ 500 ਮੀਟਰ ਤੋਂ ਘੱਟ ਬਣਦੀ ਹੈ“ (ਰਿਪੋਰਟ ਦੀ ਕਾਪੀ ਨੱਥੀ ਹੈ) ਇਸ ਤੋਂ ਇਲਾਵਾ ਆਪ ਨੂੰ ਲਿਖਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਆਪ ਵੱਲੋਂ ਹਵਾਲਾ ਅਧੀਨ ਪੱਤਰ ਰਾਹੀਂ ਭੇਜੀਆ ਹਦਾਇਤਾਂ ਮਿਤੀ 26.04.1999 ਵਿੱਚ ਕਿਤੇ ਵੀ ਸਿੱਧੀ ਮਿਣਤੀ ਦਾ ਜਿਕਰ ਨਾ ਹੈ । ਇਸ ਲਈ ਇਹ ਦਫਤਰ ਪੱਤਰਨੰ. 2739 ਮਿਤੀ 26.09.2023 ਰਾਹੀਂ ਜਾਰੀ NOC ਨਾਲ ਸਹਿਮਤ ਹੈ । “...............
It is further submitted that site of the industry was visited by AEE of this on 26.06.2024 and it was observed that the PP has installed machinery of the hot mix plant at the site in khasra no. 121//8 however has not commenced the same.....
Now, the industry has applied for varied consent to operate under the Water Act, 1974 and the Air Act, 1981 for operation of hot mix plant, ready mix concrete plant and wet mix mecadam plant. Detail of the case are as under:-
1) The industry has submitted CA certificate showing the value of gross fixed assets as Rs. 158.09 Lakhs. Accordingly, the industry has deposited Rs. 42,000/- vide UTR/Ref No. 142364418 dated 08.07.2024 under the Water Act 1974 and 42,000/- vide UTR/Ref No. 983800438 dated 19.07.2024 under the Air Act, 1981, this fee alongwith previous CTO fee is adequate for a period upto 30.09.2031 under both Acts…….
The site was visited by EE RO and undersigned (AEE) alongwith on 24.07.2024 and it was observed as under:-
1. The PP has installed hot mix plant, ready mix concrete and wet mix mecadam plat at the site, which was not in operation during the visit.
2. The PP has installed hot mix plant at khasra no. 121//8 i.e. at the maximum distance away from the village lal lakir.
3. The PP has installed cyclone separator followed by bag filter house as air pollution control device to contain the emissions from rotary drum as proposed at the time of obtaining NOC, which is adequate in principle.
4. The PP has installed septic tank for treatment of domestic effluent and has provided provision to discharge the same onto land for plantation.
5. The PP has planted thick fresh saplings along the boundary wall towards the village.
6. The PP has installed DG set with canopy and stack of adequate height. .............
As per the pursual of the e-note, it is pertinent to mention here that earlier the PP has installed ready mix concrete (RMC) for the construction of National Highway later on expanded its unit by obtaining NOC for establishment of hot mix plant. The PP has installed HMP for temporary purpose i.e. for the construction of National Highway only, which is a development project under Bharat Mala Pariyojna. .................
The project proponent has already submitted copy of Land Use Classification report issued by DTP, Fazilka vide no. 872 DTP(FZK)/IND-1 dated 03.11.2023 for setting up of Hot Mix, Concrete Batch Mix & Wet-Mix Plants at village Dangar Khera, Hadbast No. 131, Tehsil Abohar, District Fazilka on temporary basis for construction of four laning MHAI Road project from Abohar to Fazilka on HAM Mode in the state of Punjab under Bharatmala Pariyojana upto 31.12.2028. ...........
The PP is complying with the provisions of the Water Act, 1974 and the Air Act, 1981.

In view of above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the PP for the construction of National Highway under Bharat Mala Pariyojna for a period upto 31.12.2028 i.e. upto the permission granted by DTP, subject to the suitable conditions alongwith the following specific conditions: -
1. The PP shall get analysed air emission samples from the Board’s lab, within one month.
2. The industry shall operate the HMP for a shorter period only for the completion of the four laning of National Highway Authority of India (NHAI) road project from Abhor to Fazilka under Bharat Mala Pariyojna.
3. The industry shall always ensure that the stack of Hot Mix Plant i.e. the source of air emission should be at the farthest end of the area from the National Highway and Phirni/ lal lakir of village Dungar Khera.
4. The industry will comply with the code of practice as prescribed by the Board vide notification no. Admn./SA2/F.No.178/99/03 dt. 26.04.99 for hot mix plant.
