File Note: It is submitted that the HCF has applied for obtaining fresh consent to operate under the Water Act, 1974 and Air Act, 1981 along with requisite documents for 20 beds capacity. Further, the Board vide its office order no. HQ-3/EPA/2023/2799-2815 dated 19.01.2023, has notified authorization fee for HCFs. In this case, the HCF falls in the category of 11-30 beds capacity. The HCF has obtained authorization under BWM rules vide no. BMW/Fresh/SGR/2024/26153495 dated 25.07.2024 valid upto 31.12.2024. The hospital has been established and commissioned in April, 2024. The hospital has deposited Rs 3000/- vide receipt no. 323221546 dated 29.06.2024 under Air Act, 1981. The hospital has deposited Rs 3000/- vide receipt no. 310269778 dated 29.06.2024 under Water Act, 1974. The fees deposited by hospital is adequate upto 31.03.2027. The brief detail of the case applied by the healthcare facility is as under:- 1. The HCF has made an agreement with M/s Medicare Environment Management Pvt. Ltd., Ludhiana which is valid upto 15.12.2025 for 20 bed capacity. 2. The HCF has submitted copy of manifests of lifting of waste by CBWTF operators. 3. The HCF has submitted location plan/site plan. 4. The HCF has submitted Self Declaration as Annexure-1 for number of beds in hospital. Accordingly, the HCF was visited by JEE (OS) on 08.07.2024 and during visit, it was observed as under: 1) The HCF is a 20 bedded hospital and was found in operation. 2) The record of bio-medical waste lifting manifest is being maintained. 3) Needle Shredder have been provided on necessary points. 4) Color coded containers are provided for storage of bio medical waste. 5) Segregation of bio medical waste is being done properly. 6) The bio medical waste is being lifted regularly by CBWTF. 7) Non-chlorinated bags are used for storage of bio medical waste. 8) Bar code stickers are used for color coded bags. 9) The HCF has provided bio medical waste storage room for storage of biomedical waste. 10) The HCF has stored expired medicines separately in yellow bag. The HCF is found complying with the provisions of BMW Rules, 2016. As per the latest Office Order of the Board vide no. 379 dated 23/10/2023, “It has been decided that HCFs upto 30 beds capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal STPs have been installed shall be granted consents to operate and Authorization without installing individual ETPs as an interim arrangement, subject to the condition that HCF shall comply with the effluent standards prescribed by the MOEF&CC under the Bio Medial Waste Management Rules, 2016 as amended from time to time." In the present case, the HCF is located in City Lehra, where the terminal STP has already been installed and the same is in operation. As per record of this office, no action is pending against the health care facility. Keeping in view of above, if approved, the HCF may be granted consent to operate under Water Act, 1974 and Air act, 1981 upto 31.12.2024 for 20 beds under Bio-Medical Waste Management Rules, 2016 with suitable conditions and with special conditions that: 1. This consent is valid for 20 Beds only. HCF will apply for CTO/CTE if it increases its bed capacity. 2. The HCF will comply with the provisions of the BMW Rules, 2016, the Water Act, 1974 and the Air Act, 1981 in true letter & spirit. 3. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same. 4. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year. 5. The HCF will maintain proper record of generation and lifting of bio-medical waste. 6. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis. 7. The HCF shall obtain other statutory approvals required from other departments, if any. 8. The HCF shall apply for consent to operate under the Water Act, 1974 and the Air Act, 1981 within one month.
