It is submitted that the project proponent has proposed to set up a Commercial Colony in the name and style of "Connaught Place Developers" comprising of 407 plots to be developed by M/s Connaught Place Developers), Near Udham Singh Chowk, Patiala/Sanour, Devigarh Road, vill. Arain Majra, Patiala and has applied for obtaining fresh Consent to Establish (NOC) under the Water Act, 1974 and Air Act, 1981 under orange category. As per the application the site falls within MC limits of Patiala.
The project proponent has submitted requisite supporting documents i.e. application form, feasibility report, project report, copy of LOI issued byO/o The Competent Authority Cum-Commissioner, Municipal Corporation, Patiala, land documents; location plan, proposed plan, partnership deed etc.
Project Report:
As per the project report submitted by the project proponent, the project is to be established land measuring 13.22 acre situated at near Udham Singh Chowk, Devigarh Road, vill. Arain Majra Patiala, Punjab. As per the project report the total proposed cost of the project is 2086.22 lakh.
Land Documents:
The project proponent has submitted copy of land registries of 32kanal and letter of consent of rest of the land according to which the land on which the colony has to be developed is given to M/s Connaught Place Developers through its partner Sh. Inderpal Chadha S/o Sh. Makhan Singh, Sh. Harkaran Singh Chadha S/o Inderpal Chadha, Sh. Akash Jain S/o Sh. Atul Jain, Sh. Rohit Goel S/o Sh. Bhushan Lal Goel, Sh. Preetinder Singh S/o Sh. Manjit Singh. The copy of land registries and letter of consent is attached.
License to develop:
License to develop a colony has been obtained from the Competent Authority Cum-Commissioner, Municipal Corporation, Patiala vide License no. 962 dated 20.06.2024 to M/s Connaught Place Developers, has obtained transfer of LOI and issue of Letter of Setting up of a commercial project in the name of " Connaught Place Developers " in an area of 13.22 Acres(105 Kanal, 15.5 Marla) situated at Near Udham Singh Chowk, Patiala/Sanour, Devigarh Road, vill. Arain Majra, Patiala, Punjabas per Layout plan drawing No. PTA/COM/23/RE/03 dated 12.03.2024 received on E- Naksha Portal vide file No. CTP(S.S)-2024/1006 dated 01.04.2024 at E- Naksha Portal .
Tehsildar Report:
The industry has submitted copy of Tehsildar report (copy attached)
NOC fee
The project proponent has deposited Rs. 28800/- vide online UTR no. N193243147416501 dated 11.07.2024fee against the project cost of 2086.22 lakh as per the project report, under orange category, which is adequate for one year.
Requirement of EIA, 2006
The land areais about 53499.44 sqm (as per application) andtotal built up area is 50790.46 (as per application). As per the site plan submitted the total plotted area is 27663.36 sqr yards or 23130.09 sqm. Considering FAR to be 2.1, the total built up area is46260.18 sqm, which is less than 1.5 lakh sqm. Therefore, the project not covered under EIA notification dated 14.09.2006.
Feasibility Report
The project proponent has submitted feasibility report prepared by EVAPO TECH Technical Services and Consultants, Patiala. The details of wastewater consumption and generation is given as under:

The project proponent has proposed to install MBBR based STP of 40 KLD capacity which is adequate to take load of domestic effluent.
The project proponent has proposed to discharge treated waste water @ 36m3/day to be discharged onto land for plantation and shall reuse 25 m3/day for flushing.

Industry will be recycling the treated wastewater for flushing purposes. Hence reducing their fresh water requirement to 20KL per day. The rest 11 KLD shall be discharge onto land for plantation in its premises.
The project site was visited by the undersigned on 23.07.2024 and contacted Sh. Mehul, representative at site. During visit, it was observed as under
1. The proposed site falls on the location as shown in the site plan and as shown by the representative of the project.
2. The project proponent has not constructed boundary wall.
3. No construction activity pertaining to the project has been started. There is no air polluting industry within a radius of 100 m from the boundary of the project site and there is no MAH industry within a radius of 250 m radius from the boundary of the proposed site.
Therefore, the site of the project is conforming to the sitting guidelines laid down by the Govt. of Punjab, Department of Science, Technology and Environment vide order dated 25/7 / 2008 as amended on 30/10 / 2009.
In a clarification vide Board letter no. 4426-49 dated 05.02.2009, in which it was mentioned that the prescribed distance are to be maintain or not from the various category of above mentioned industries (i.e. rice shellers/saila plant/stone crushers/brick kilns/cement plants/cement grinding units/hot mix plants) for establishments of residential colonies/commercial establishments, was discussed in a meeting held under the chairmanship of Chief Secretary, Punjab on 13.01.2009 and it was decided as under:
a) The distance of 500m and 300m as prescribed in the above mentioned notification for establishment of rice shellers/saila plants/stone crusher and brick kilns/cement plants/cement grinding units/hot mix plants, respectively, would be maintained by the new residential colonies to be established outside the local planning area(LPA) i.e. these notifications would be deemed to be operative vice-versa also.
b) The residential/commercial establishments shall be allowed within the Local Planning area as per the land use prescribed in the master plan/draft master plan of the area irrespective of their distance from the rice shellers/saila plants/stone crushers/ brick kilns/ cement plants/ cement grinding units/ hot mix plants. However, minimum buffer of 15m green belt of broadleaf trees should be provided by the colonizer towards the air polluting industries, boundary of which are located within 100m from the boundary of such projects.
The site falls within MC limits of Patialaand no Rice shellers / saila plants/stone crusher and brick kilns/cement plants/cement grinding units/hot mix plants is located within 100 mtr of the project site.
In this case, the project proponent has obtained Letter of Intent (LOI)/Lay Out Plan for setting up a Commercial Colony and no air polluting industry is located within 100 mtr of the said site. The site is suitable for establishment of the project.
In view of above, if approved, SEE, ZO-1, Patiala may be recommended that consent to establish/NOC be granted to the project proponent for one yearwith the suitable conditions.
1. The project proponent shall obtain prior Environment Clearance, as per EIA notification 14.09.2006, (if applicable), amended from time to time before start of construction activities.
2. The project proponent shall develop the project in the Khasra no. mentioned Directorate, Local Government, Punjab, Punjab Municipal Bhawan, Plot no. 3, Sector-35-A, Chandigarh vide letter no. CTP(SS)-2024/1006 dated 01.04.2024.
3. The Board’s shall not be party to any revenue dispute between the original land owner and the project proponent in any court of law and the complete financial liability shall be on the project proponent.
4. The project proponent shall install STP as proposed in the application submitted by it.
5. The project proponent shall not discharge any treated/untreated wastewater into any drain/inland surface water and shall make arrangements for utilization of maximum treated wastewater onto land for plantation/irrigation. The project proponent shall provide adequate plantation area for disposal of treated domestic effluent.
6. The project proponent shall ensure that a storm water drain does not get mixed with untreated / treated sewage line.
7. The project proponent shall obtain permission from competent authorities / MC, Patiala for disposal of treated domestic effluent before commissioning of the project.
8. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated Into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter to produce compost, which will be disposed of/reused in an environmentally sound manner and the non- biodegradable solid waste shall also be disposed of in an environmentally sound manner.
9. The project proponent shall comply with the provisions of E-Waste Management Rules, 2022 in true letter and spirit.
10. The project proponent shall comply with the provisions of Plastic Waste Management Rules, 2016 in true letter and spirit.
11. The project proponent shall ensure that it any microbrewery/restaurant or eatery is set up within the project then the respective joint shall provide there own water treatment facilities and the project proponent shall comply with discharge standards as notified by MoEF&CC.
