• It is submitted that the industry was granted Consent to operate under Water Act, 1974 & Air Act, 1981 vide nos. CTOW/Renewal/BTI/2020/12732420 & CTOA/Renewal/BTI/2020/12732384 dt. 08.07.2020, which is valid upto 30.09.2024 for production of Raw Rice/Sorted Rice @ 2 TPH without dryer, subject to the conditions mentioned therein.
• Now, the industry has applied for obtaining varied consents to operate of the Board under Water Act, 1974 & Air Act, 1981 through OCMMS for production of Raw Rice / Sorted Rice with dryer @ 2 TPH.
• The details of case are as under –
• Earlier, the industry was granted Consent to Establish (NOC) for expansion under Water Act, 1974 & Air Act, 1981 through OCMMS vide no. CTE/Exp/BTI/2019/9526380 dated 09.04.2019 for production of Raw Rice / Sorted Rice with dryer @ 2 TPH.
• Now, the industry has submitted a copy of report from the department of DTP, Bathinda, which is reproduced as under-
“ਸਾਈਟ ਪਿੰਡ ਮੰਡੀ ਕਲਾਂ ਦੀ ਰੈਵੀਨਿਊ ਅਸਟੇਟ ਅੰਦਰ ਖਸਰਾ ਨੰ: 81//8/1/2(4-3), 8/2/1(12-13), 82//5/1/2(0-11), 5/2/1(17-6), ਕੁੱਲ 34 ਕਨਾਲ 13 ਮਰਲੇ ਦਾ 1/2 ਹਿੱਸਾ 17 ਕਨਾਲਾਂ 6.5 ਮਰਲੇ ਵਿੱਚ ਪੈਦੀ ਹੈ।ਇਹ ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਐਲ.ਪੀ.ਏ, ਰਾਮਪੁਰਾ ਫੂਲ ਦੀਆਂ ਹੱਦਾਂ ਦੇ ਅੰਦਰ ਪੈਂਦੀ ਹੈ, ਜਿਸ ਦਾ ਮਾਸਟਰ ਪਲੈਨ ਅਜੇ ਤਿਆਰ ਨਹੀਂ ਕੀਤਾ ਗਿਆ।ਜ਼ਿਲਾ ਉਦਯੋਗ ਕੇਂਦਰ, ਬਠਿੰਡਾ ਜੀ ਦਾ ਪੱਤਰ ਨੰ; 1833 ਮਿਤੀ 10-08-2018 ਅਨੁਸਾਰ ਦੇ ਪੱਤਰ ਨੰ; 15/51/98/5- ਆਈਬੀ5486-89 ਮਿਤੀ13-08-98 ਰਾਹੀਂ ਜਾਰੀ ਨੋਟੀਫਿਕੇਸ਼ਨ ਅਨੁਸਾਰ ਪੰਜਾਬ ਰਾਜ ਵਿੱਚ ਜੋ ਰੂਰਲ ਫੋਕਲ ਪੁਆਇੰਟ ਬਣਾਏ ਗਏ ਸਨ। ਉਹਨਾਂ ਵਿੱਚ ਰੂਰਲ ਫੋਕਲ ਪੁਆਇੰਟ ਮੰਡੀ ਕਲਾਂ, ਜ਼ਿਲ੍ਹਾ ਬਠਿੰਡਾ ਵੀ ਆਉਂਦਾ ਹੈ। ਇਸ ਵਿੱਚ ਕੋਈ ਨਵੀਂ ਤਬਦੀਲੀ ਨਹੀਂ ਹੋਈ ਅਤੇ ਫੋਕਲ ਪੁਆਇੰਟ ਅੱਜ ਵੀ ਲਾਗੂ ਹੈ। ਇਸ ਦੀ ਸਾਈਟ ਲੁਕੇਸ਼ਨ ਅਤੇ ਖਸਰਾ ਨੰਬਰਾਂ ਦੀ ਪੁਸ਼ਟੀ ਆਪ ਜੀ ਆਪਣੇ ਪੱਧਰ ਤੇ ਸਬੰਧਤ ਵਿਭਾਗ ਤੋਂ ਕਰਵਾਉਂਗੇ। ਡਰਾਫਟ ਮਾਸਟਰ ਪਲੈਨ ਰਾਮਪੁਰਾ ਫੂਲ ਅਨੁਸਾਰ ਇਸ ਜਗ੍ਹਾ ਨੂੰ ਇੰਡਸਟਰੀਅਲ ਜੋਨ ਵਿੱਚ ਰੱਖਿਆ ਗਿਆ ਹੈ। ਇੱਥੇ ਇਹ ਵੀ ਸਪਸ਼ਟ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਇਹ ਸਾਈਟ ਨਗਰ ਪੰਚਾਇਤ, ਮੰਡੀ ਕਲਾਂ ਦੇ ਅੰਦਰ ਹੋਣ ਕਰਕੇ ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ਨੋਟੀਫਿਕੇਸ਼ਨ ਨੰਬਰ 18/30/2009-ਐਸਐਚਜੀ 2/897 ਮਿਤੀ 01-03-2013 ਅਨੁਸਾਰ ਸੀ.ਐਲ.ਯੂ ਸਬੰਧੀ ਕਾਰਵਾਈ ਸਥਾਨਕ ਸਰਕਾਰ ਵਿਭਾਗ ਵੱਲੋ ਕੀਤੀ ਜਾਣੀ ਹੈ ਜੀ।”
• The industry has deposited consent fee of Rs. 30,500/- vide R.No. POD027692041 dated 09.07.2024 under Water Act, 1974 and Rs. 30,500/- vide R.No. POD027691927 dated 09.07.2024 under Air Act, 1981, which is adequate upto 30.09.2029, against fixed assets of Rs. 85.09 lacs as per the CA Certificate. The industry has also deposited the NOC regularization fee of Rs. 1800/- vide no. POD027692130 dated 09.07.2024 for the increased fixed assets.
• The site of the industry was visited on 26.07.2023 and it was observed as under:
1. The rice sheller was not in operation.
2. The rice sheller has provided a shelling section with cyclone as APCD to arrest the dust emissions from the shelling process.
3. The rice sheller has installed a drier section with paddy cleaner alongwith cyclone as APCD to arrest the dust emissions.
4. The rice sheller has provided pucca road in the movement area of the rice sheller.
5. The rice sheller has provided jalli over the 10 feet in the husk storage area.
6. The rice sheller has provided septic tank for the treatment of domestic effluent and disposed of onto the land for plantation
7. The industry has provided adequate plantation along the boundary wall of the industry.
• As such, the industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013.
• Keeping in view of above, if approved, it is recommended that varied consents to operate under the provisions of the Water Act, 1974 and Air Act, 1981 may be granted to the industry for production of Raw Rice / Sorted Rice with dryer @ 2 TPH, for a period upto 30.09.2029, subject to the suitable conditions.
