File Note:  It is submitted that the kiln was granted consent to operate under the Water Act, 1974 and Air Act, 1981 vide no. CTOW/Fresh/MNS/2020/12818707& CTOA/Renewal/MNS/2020/12818558 dated 29.06.2020, which was valid upto 30.09.2024 for production of Bricks and Tiles @ 30,000 Nos./Day in the name of Sh. Ashwani Kumar.  Now the industry has applied for obtaining fresh consent to operate under Air (Prevention &Control of Pollution) Act, 1981 and under Water (Prevention & Control of Pollution) Act, 1974 and along with requisite fees and documents without any increase in production capacity in the name of Sh. Vinod Kumar, Proprietor.  The brick kiln has attached documents regarding change of proprietorship, lease deed, CA certificate and authorized signatory having name of firm,.  Earlier, the brick kiln has 2 partners i.e. Sh. Ashwani Kumar s/o Sh. Surja Bhan and Sh. Vinod Kumar s/o Sh. Bhal Singh. Now, the brick kiln has attached the dissolution deed dated 20.01.2023 and special power of attorney dated 24.12.2022 stating that Sh. Vinod Kumar s/o Sh. Bhal Singh is the proprietor of the firm.  The brick kiln has attached the copy of lease deed dated 08.07.2019 for lease amount of Rs. 17000/- per month (2,04,000/- for one year) for the period of 01.07.2019 to 30.06.2034 having khasra nos. 95//5/2 (0-4), 6/1 (3-18), 14/2 (1-10), 15 (7-16), 16 (2-2), 17/1 (1-3) total 16 Kanal 13 marlas land.  The kiln has deposited consent fee of Rs. 42000/- (Rs. 11200/- vide online R. No. 000148950610 dated 14.06.2024, Rs. 10800/- (Rs. 7900/- vide online R.no. N197243152181851 dt. 15.07.2024 and Rs. 2900/- vide online R. No. CBINH24094973806 dated 03.04.2024) and Rs. 20,000/- (Rs. 10,000/- vide online R. No. N186243129810221 dated 04.07.2024 and Rs. 10,000/- vide online R. No. N186243129822051 dated 04.07.2024) under the Water Act, 1974 and Air Act, 1981 which is adequate upto 30.06.2029 as per the Board's office order dated 29.10.2018 against fixed assets of Rs. 55.64 lacs as per the CA certificate dated 26.07.2024 after adjusting the NOC regularization fee.  The brick kiln was visited by the AEE of this office on 24.07.2024 and it was observed as under: i. The kiln was not in operation during visit. ii. Any unauthorized fuel was not found during visit. iii. The kiln has provided a ladder and a plat form with the stack for collection of emission sample. iv. The kiln has stabilized the periphery road / movement area with kery/brick bats. v. The kiln has provided adequate plantation all along its boundary. vi. The industry does not generate any trade effluent and domestic effluent discharged onto land for plantation after treatment in septic tank.  From the above it is clear that the kiln is complying with the provisions of the Water Act, 1974 & Air Act, 1981.  In view of above, may if approved, fresh consent to operate under Water Act, 1974 and under Air Act, 1981 may be granted upto 30.06.2029 for production of Bricks and Tiles @ 30,000 Nos./day, subject to the suitable conditions and following special conditions: 1. The kiln shall ensure to use biomass pellet as a fuel as 20% replacement of the coal used by the kiln in compliance of Govt. of Punjab, Department of Science, Technology and Environment notification no. 10/574/2022-STE1/442 dated 04.11.2022. 2. The kiln shall increase the plantation along the boundaries in upcoming monsoon season. 3. This consent is granted subject to the orders passed by the Hon'ble High Court for the States of Punjab & Haryana/ Hon'ble National Green Tribunal or Other Judicial Authority in the case spending or being filed with regard to the operation of brick kilns in the State. 4. This consent is granted subject to the performance evaluation of new technology adopted by the brick kilns. 5. The BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacture of bricks and submit the same, within two months. 6. The industry shall comply with code of practice for brick kiln and shall achieve the prescribed standard notified by MOEF&CC. 7. The industry shall not generate/ discharge any trade effluent and shall discharge only domestic effluent onto land for plantation after passing through septic tank. 8. The industry shall not use agro waste / bio-mass residue (like tura, gauwara crop, mustard straw, almond/peanut peels and press mud from sugar industry) ‘in loose form’ till a proper study is conducted orsome-mechanism is developed by the technical providers for utilizing the same in loose form for zig-zag based induced draft brick kilns.
