• The proposed unit is a small scale orange category Rice Sheller unit.
• The project proponent has applied for obtaining Consent to Establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 to the Board through OCMMS of the Board for the establishment of a new unit at Village Masani, Tehsil Phillaur District Jalandhar for proposal to manufacturing of Raw Rice @ 4 MTD, Rice Bran @ 0.54 MTD, Rice Husk @ 1.08 MTD by using Paddy @ 6 MTD as raw material under Orange category.
• The industry has deposited Rs.10800/- & Rs. 500/- as form fee vide UTR/Reference No. SBIN224115187591 Dated 24.04.2024. Adequate for one year.
• To verify the facts, the site was visited by officer of this office on 31.07.2024 and it was observed as under: -
1. The site is located in the revenue estate of Village Masani, Tehsil Phillaur District Jalandhar.
2. The industry has not started construction work at site.
3. The industry has proposed to use 0.6 KLD of water for domestic use, thus only domestic effluent @ 0.5 KLD will be discharged onto land for plantation after passing through septic tank. There will be no generation of trade effluent at site.
4. The industry has proposed to install 1 no. of Dryer section, 1 no. of shelling section with cyclone separator as APCD.
5. The Project Proponent has submitted a Letter DTP vide no. 550 dated 29.05.2024, which is reproduced as under:-
1) ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਤੇ ਹਵਾਲੇ ਨਾਲ ਪ੍ਰਾਪਤ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਜ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਪਹਿਲਾਂ ਹੀ ਇਸ ਦਫਤਰ ਦੇ ਪੱਤਰ ਨੰ. 115. ਸਿਤੀ 22.01.2024 ਰਾਹੀਂ ਜਾਰੀ ਕੀਤਾ ਗਿਆ ਹੈ, ਸਾਈਟ ਦਾ ਕੁੱਲ ਰਕਬਾ 5.00 ਏਕੜ ਹੈ। ਪ੍ਰਾਰਥੀ ਵਲੋਂ ਆਨਲਾਈਨ ਪ੍ਰਾਪਤ ਦਸਤਾਵੇਜ਼ਾਂ ਅਨੁਸਾਰ ਸਾਈਟ ਵਿੱਚ (Rice Sheller) ਦੀ ਸਥਾਪਨਾ ਕੀਤੀ ਜਾਣੀ ਹੈ । ਮੌਕਾ ਰਿਪੋਰਟ ਅਨੁਸਾਰ ਸਾਈਟ ਖਾਲੀ ਹੈ।
2) ਇਹ ਸਾਈਟ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ ਅਪਰਾ ਵਿੱਚ ਪੈਂਦੀ ਹੈ, ਜੋ ਕਿ ਅਜੇ ਨੋਟੀਫਾਈਡ ਨਹੀਂ ਹੋਇਆ ਹੈ। ਮਾਸਟਰ ਪਲੈਨ ਅਪਰਾ ਨੋਟੀਫਾਈਡ ਹੋਣ ਉਪਰੰਤ ਜੇਕਰ ਆਪ ਦੀ ਇਕਾਈ Non confirming Land use Zone ਵਿੱਚ ਆਉਂਦੀ ਹੈ ਤਾਂ ਆਪ “Punjab Regional and Town Planning and Development Act, 1995” ਦੇ Section-79 ਅਤੇ ਬਾਕੀ ਦੇ ਸਾਰੇ ਉਪਬੰਧਾ ਨੂੰ ਮੰਨਣ ਦੇ ਪਾਬੰਦ ਹੋਣ ਬਾਰੇ ਪ੍ਰਾਰਥੀ ਨੂੰ ਜਾਣੂ/ਸ਼ਰਤ ਲਗਾਉਈ ਬਣਦੀ ਹੈ।
3) ਸਾਈਟ ਨੂੰ ਅਪਰੋਚ ਰੈਵੀਨਿਊ ਦਸਤਾਵੇਜ਼ ਅਤੇ ਮੌਕਾ ਰਿਪੋਰਟ ਅਨੁਸਾਰ 19'-2'' ( 4 ਕਰਮ) ਚੌੜੀ ਲਿੰਕ ਰੋਡ ਤੋਂ ਲਈ ਗਈ ਹੈ। ਯੂਨੀਫਾਈਡ ਜ਼ੋਨਿੰਗ ਰੈਗੂਲੇਸ਼ਨ ਅਨੁਸਾਰ 19'-2'' ਚੌੜੀ ਲਿੰਕ ਰੋਡ ਨੂੰ 60 ਫੁੱਟ ਚੌੜਾ ਕਰਨ ਲਈ ਬਾਕੀ ਸਬੰਧਿਤ ਵਿਭਾਗਾਂ ਪਾਸੋਂ ਐਨਓਸੀ ਲੈਣ ਉਪਰੰਤ ਪ੍ਰਾਰਥੀ ਆਪਣੇ ਰਕਬੇ ਵਿਚੋਂ ਸਰਕਾਰ ਦੇ ਹੁਕਮਾਂ ਅਨੁਸਾਰ ਬਿਨਾ ਕਲੇਮ ਲਏ 20'-6" ਦੀ ਰੈਡ ਵਾਈਡਨਿੰਗ ਸਟਰਿੱਪ ਛੱਡਣ ਉਪਰੰਤ ਹੀ ਮੌਕੇ ਤੇ ਉਸਾਰੀ ਕਰਨ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ। ਸਾਈਟ ਦਾ ਫਰੰਟੇਜ਼ (201'-3'') ਅਤੇ ਰਕਬਾ (5 ਏਕੜ) ਵਿਭਾਗੀ ਗਾਈਡਲਾਈਨਾਂ ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਦਾ ਹੈ।
4) ਪੰਜਾਬ ਪ੍ਰਦੂਸ਼ਣ ਕੰਟਰੋਲ ਬੋਰਡ ਵਿਭਾਗ ਵੱਲੋਂ CONSENT TO ESTABLISH ਸਬੰਧੀ ਐਨ.ਓ.ਸੀ. ਲੈਣ ਉਪਰੰਤ ਪ੍ਰਾਰਥੀ ਸਰਕਾਰ ਦੀ ਨੋਟੀਫਿਕੇਸ਼ਨ ਨੰ. 13/41/2021-6HG2/2684 ਮਿਤੀ 19.10.2022 ਰਾਹੀਂ ਬਿਲਡਿੰਗ ਪਲੈਨ ਅਤੇ ਕੰਪਲੀਸ਼ਨ ਸਰਟੀਫਿਕੇਟ ਦੀ ਪ੍ਰਵਾਨਗੀ ਕੰਪੀਟੈਂਟ ਅਥਾਰਟੀ ਡਾਇਰੈਕਟਰ, ਫੈਕਟਰੀਜ਼ ਪੰਜਾਬ ਪਾਸੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਪਾਬੰਦ ਹੇਵੇਗੇ।
6. The industry has submitted a detailed report from revenue authority w.r.t. siting guidelines as per the report signed by the Tehsildar, Phillaur dated 25.07.2024, which is reproduced as under:-
ਬੇਨਤੀ ਹੈ ਕਿ ਮੁਤਾਬਕ ਆਮਦਾ ਹੁਕਲ ਮੌਕਾ ਅਤੇ ਸਾਲ ਰਿਕਾਰਡ ਦਾ ਮੁਲਹਾਜਾ ਕੀਤਾ ਗਿਆ ਨੰਬਰ ਖਸਰਾ 5210/536(8-3), 5211/538(4-13), 5212/537(12-1), 5218/542(3-0), 5219/542(12-2) ਕੁੱਲ ਰਕਬਾ 39 ਕ- 19 ਮ ਦੀ ਮਾਲਕੀ ਰਮਨਪ੍ਰੀਤ ਸਿੰਘ ਪੱਤਰ ਸੁਰਜੀਤ ਸਿੰਘ ਪੁਤਰ ਰਾਮ ਲਾਲ ਦੀ
ਹੈ । ਮੰਗੀ ਗਈ ਰਿਪੋਰਟ ਨਿਮਨ ਅਨੁਸਾਰ ਹੈ:-
1. ਇਹ ਰਕਬਾ ਕਿਸੇ ਵੀ ਪਿੰਡ ਦੀ ਲਾਲ ਲਕੀਰ ਤੋਂ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਨਹੀਂ ਪੈਂਦਾ।
2. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਕੋਈ ਜੰਗਲੀ ਜੀਵ ਅਸਥਾਨ ਨਹੀਂ ਹੈ।
3. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿਚ ਕੋਈ ਚਿੜੀਆਘਰ ਅਤੇ ਜੰਗਲ ਨਹੀਂ ਪੈਂਦਾ।
4. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕੋਈ ਵਿਦਿਅਕ ਅਦਾਰਾ ਨਹੀਂ ਹੈ।
5. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕੋਈ ਇਤਿਹਾਸਿਕ ਸਥਾਨ ਨਹੀਂ ਹੈ।
6. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕੋਈ ਪ੍ਰਾਚੀਨ ਧਾਰਮਿਕ ਅਸਥਾਨ ਨਹੀਂ ਹੈ।
7. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕੋਈ ਪ੍ਰੋਟੈਕਟਿਡ ਮੋਨੋਮੈਂਟਸ ਨਹੀਂ ਹੈ।
8. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਅੰਦਰ ਕੋਈ ਪੰਜਾਬ ਅਰਬਨ ਪਲੈਨਿੰਗ/ ਡਿਵੇਲਪਸੈਂਟ ਅਥਾਰਿਟੀ/ ਪੁੱਡਾ ਮਿਊਂਸੀਪਲ ਕਾਰਪੋਰੇਸ਼ਨ/ ਮਿਊਂਸੀਪਲ ਕੌਂਸਲ/ ਇੰਪਰੂਵਮੈਂਟ ਟਰੱਸਟ ਅਤੇ ਅਥਾਰਟੀ ਅਜੰਸੀ ਦੀ ਏਰਿਆ ਨਹੀਂ ਹੈ ।
9. ਇਸ ਰਕਬੇ ਦੇ 500 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ 15 ਘਰ ਪੱਕੇ ਘਰ ਨਹੀਂ ਹਨ।
From the above, it is clear that the proposed site of the industry is meeting with the specific siting guidelines prescribed by the Board for the establishment of a rice sheller, as per order dated 13.09.2006 as amended on 15.10.2013 and further amended on 05.08.2021.
Keeping in view of above, it is recommended that the consent to establish (NOC) for setting up of rice sheller unit at its proposed site located in revenue estate of Village Masani Tehsil Phillaur, District Jalandhar for proposed to manufacturing of Raw Rice @ 4 T/Hour, Rice Bran @ 0.54 T/Hour, Rice Husk @ 1.08 T/Hour and Paddy @ 6 T/Hour as raw material under Orange category may be granted to the industry for one year with usual suitable conditions as per policy of the Board and special condition that: -
1. CTE/NOC has been granted on the basis of documents submitted by the project proponent and he shall obtain permission from Director of Factories regarding establishment of said unit in compliance of Govt. of Punjab notification no. 13/41/2021-6Hg2/2684 dated 19.10.2022.
2. The project proponent shall install adequate and appropriate pollution control devices, ensure compliance of Code of Practices prescribed for such units and obtain prior Consent to Operate from the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 before the commencement of operation of the rice sheller.
3. The industry will be bound to comply with the zoning regulation of the master plan in force and the grant of consent by the Board will not vest any right on the industry w.r.t. other stipulations by any authority or the zoning regulations of the master plan.
4. The Consent to Establish (NOC) has been granted on the basis of documents/report submitted by the project proponent, from the Tehsildar, Phillaur and DTP Jalandhar, In future, if any document/information submitted is found wrong or the industry is found creating nuisance in its vicinity due to its operation, the Board reserves the right or to revoke/cancel the Consent to Establish (NOC) without giving any notice/opportunity to the project proponent.
5. The project proponent shall install its rice sheller unit in the Khasra No. 5210/536(8-3), 5211/538(4-13), 5212/537(12-1), 5218/542(3-0), 5219/542(12-2) Total land 32 karnal 19 Marla as mentioned in the letter issued by Tehsildar Phillaur.
