It is intimated that the project is a medium-scale red category housing project. The project proponent has obtained Environmental Clearance vide no SEIAA/2015/8235 dated 16.12.2015 for group housing project namely “Sun Enclave Apartment” at Village Shampura, Tehsil and District Rupnagar., in a total land area of 2.84 acres having built up area 23741.57 sqm and green area of 2017 sqm.
The total population of the project is proposed to be 990 persons. The total water requirement of the project will be 140 KLD, out of which 104 KLD will be met through ground water supply and remaining 36 KLD shall be obtained from treated wastewater which will be utilized for flushing purpose. 11 KLD of water is required for green area. The total wastewater generation shall be 112 KLD, which will be treated in the STP to be installed within the project premises. Thereafter, the project proponent has issued corrigendum to the Environmental Clearance vide no. SEIAA/625 dated 24.05.2018. The project details mentioned in the Environmental Clearance are as under: -
1. The total land area be read as 2.97 acres against 2.84 acres mentioned in the original environmental clearance letter.
2. The total built up area be read as 24199 sqm against 23741.57 sqm mentioned in the original environmental clearance letter.
3. The number of flats and shops be read as 198 against 206 flats mentioned in the original environmental clearance letter. Number of shops remains to be unchanged as 6.
Thereafter, the project proponent was granted “Consent to Establish” (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/RPN/2021/15108114 dated 27.04.2021 valid upto 31.03.2022 for establishment of residential Project consisting of 198 flats with subject to certain conditions and special condition as mentioned therein.
The project proponent was also granted partial consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/RPN/2021/15096239 dated 27.04.2021 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/RPN/2021/15092130 dated 09.04.2021, both having validity upto 31.03.2022 for development of 114 flats with subject to suitable conditions and special conditions mentioned therein.
Now, the project proponent has applied for obtaining varied Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for development of 198 flats and 6 shops alongwith requisite documents and fee.
The project proponent has deposited Rs. 5,76,000/- vide R. No. 362427998 dated 08.05.2024 under Water Act, 1974 and Rs. 5,76,000/- vide R. No.
563205506 dated 08.05.2024 under Air Act, 1981, against the total cost of project is Rs. 41.91 crores. The consent fee deposited by the project proponent is adequate upto 30.09.2027 under both acts after adjusting NOC fee and penalty fee.
The site of the project was visited by officer of this office on 23.07.2024 and it was observed as under: -
1. The site falls in Village Shampura Ropar, Roopnagar.
2. The project is a high-rise group housing society having 198 flats and construction work for the project is also complete.

4. The project proponent has provided STP of capacity 150 KLD based on MBBR technology for treatment of wastewater generated from the project.
5. The project proponent has submitted effluent analysis results from private lab on dated 22.03.2024 and results are as under: -
pH= 7.73, TDS= 428 mg/l, TSS= 16.6 mg/l, BOD= 28.2 mg/l, COD= 108.0 mg/l, O&G= 1.6 mg/l
As per analysis results all the parameters are found within the prescribed limits of the Board.
6. The project proponent has provided provisions for dual plumbing arrangements in its flats.
7. About 107 KLD of effluent will be treated in the STP at full occupancy. The treated water @ 45 KLD will be used for flushing purpose and about 11 KLD for irrigation of green area and the rest @ 51 KLD will be discharged into MC sewer in summer season. The details of the disposal arrangements are as under:

8. The treated water is re-used for flushing purposes through dual plumbing pipeline provided from treated water of STP outlet to the towers and green area @ 1900 sqm and plantation developed along the boundary walls.
9. The project proponent has provided 3 no. of Rain water harvesting pits inside the premises of the project.
10. The promoter company has provided mechanical composter of capacity 200 Kg for composting of wet waste in compliance to SWM Rules, 2016.
11. The project proponent has provided one no. DG set capacity of 82.5 KVA provided with canopy and stack of adequate height.
The promoter company has submitted the approved layout plan of the project from the MC, Rupnagar wherein the plot area has been mentioned as 2.97 acres. The location of the STP has been marked on the approved layout plan.
MC has also clarified that the project falls in residential zone as per master plan of Rupnagar and the project has been approved by the Govt. vide memo no. CTP (SS)- 11/1639 dated 23.12.2011.The project proponent has submitted letter from MC, Rupnagar vide no. 1691 dated 27.07.2015 wherein it has been mentioned that the project proponent can discharged its sewerage water to the tune of 140 KLD into the MC sewer line as the same is available in the area and after deposition of requisite charges. The project is complying with the conditions of previous consent to operate as well as environmental clearance granted to the project.
In view of the above, it is recommended that the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for 198 flats and 6 shops may be granted upto 30.09.2027 with subject to the suitable conditions and additional conditions that:-
1. The project proponent shall submit effluent analysis results from Boards lab within one month.
2. The project proponent shall operate its STP regularly & efficiently and shall maintain daily record regarding operational of the same.
3. The project proponent shall obtain permission from PWRDA for abstraction of ground water (if required) and shall comply with the guidelines issued by it from time to time.
4. The project proponent shall maintain separate record regarding treated water being generated from the project and being re-utilized in green area and flushing.
5. The project proponent shall provide flow meters at line carrying treated wastewater for flushing, gardening and into sewer, at all times and shall maintain a proper record of the readings of the same, at all times.
6. The promoter company shall comply with the provisions of the Environmental Clearance granted to it vide no. SEIAA/625 dated 24.05.2018.
7. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be collected.
8. The project proponent shall not discharge any treated/ untreated wastewater into sewer/ drain/ choe under any circumstances.
9. The promoter company shall ensure that there is no obstruction to natural flow of rainwater due to construction of boundary wall of the industrial park/ any industry
10. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
11. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
12. The project proponent shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received.
13. The Consent is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
14. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
15. The project proponent shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and / or any other environmental law applicable to the industry and Rules, Circulars & Directions issued by the Board from time to time, at all times.
