File Note: It is submitted that the industry is a small scale orange category brick kiln unit. Earlier, the brick kiln was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/LDH4/2023/21203039, dated 24/03/2023, upto 23/03/2024 for production of Bricks/Tiles @ 30000 Numbers/Day and by products of Roara @ 5000 Numbers/day and for discharge of domestic effluent @ 01 KLD onto land for plantation after treatment through septic tank with certain conditions. Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 was granted vide no. CTOA/Renewal/LDH4/2023/21202896 dated 20/03/2023, upto 19/03/2024 for using coal as fuel in its brick kiln with induced draft zig -zag technology as per design of PSCST with certain conditions and special conditions that: a. The brick kiln to submit final completion certificate from PSCST within one month. b. The brick kiln shall not use/stored any unauthorized fuel at the kiln site. c. The Brick Kiln may also develop the vermin-composting/ composting to manage the biodegradable solid waste. PP shall not throw, burn or bury any solid wastes in open, outside premises or in drain/water bodies. d. The Brick kiln shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities. e. The Brick kiln shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises. f. The Brick kiln shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner. Now, the brick kiln has applied for varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS on 22.07.2024. The brick kiln has already deposited consent fee of Rs. 29,000/- vide R.No. N05923234878206 dated 28.02.2023 under the Air Act, 1981 and Rs. 5,800/- vide R.No. N079242941745922 dated 19.03.2024 under the Water Act, 1974 against the gross block of fixed assets of Rs. 61.88 Lacs as on 30.03.2024. The consent fee under Air Act, 1981 is adequate upto 30.09.2031 and consent fee under Water Act, 1974 is adequate upto 30.09.2025. The brick kiln has submitted copy of land use pattern from DTP Ludhiana vide its memo no. 3034 dated 11.10.2013 stating that the site of the industry falls agriculture zone as per Master Plan, Ludhiana (2007-2021). The brick kiln has submitted copy of provisional certificate from PSCST, Chandigarh vide its letter no. PSPCT/CC/919 dated 10.01.2019 stating that the kiln has constructed induced draft brick kiln with zig-zag technology as the length of Central Island is 281'9" which is more than 245'. The earlier consent was granted in-line with the decisions taken by the Competent Authority of the Board during the meeting dated 22.10.2019 regarding that the PSCST and CBRI shall continue to issue provision certificate to brick kilns having central island length more than 245 feet. In such cases Board will grant consent shorter period for one year with condition that the brick kiln owner will make necessary technological modification suggested by the technical provider in a time bound manner as decided by the Board and a third party monitoring for at least 3 days to check the Board and a third party monitoring for at least 3 days to check the efficiency of both long and restricted size brick kilns. Further, it is informed that the Board vide its letter endst no. 12949-63 dated 07.06.2021 has conveyed the following decisions for brick kilns having length of central island more than 245’ as under:- 1. Consents to such brick kiln having length of central island more than 245’ shall be extended further for a period of one year/ till study/monitoring by Technical Providers is completed (whichever is earlier) and further decision shall be finalized in the matter. 2. SEE, Zonal Office, Bathinda shall coordinate with both the technical providers to carryout monitoring in 3-4 brick kiln in Bathinda and Faridkot of varying length (more than 245’). The final completion certificate from PSCST, Chandigarh w.r.t. induced draft brick kiln with zig-zag technology as the length of Central Island is 281'9" which is more than 245' is yet to be submitted by brick kiln. The brick kiln was visited by the undersigned on 31.07.2024 and it was observed that:- 1. The brick kiln was not in operation during visit. 2. The brick kiln has adopted induced draft zig-zag technology as per the provisional completion drawing submitted by it. 3. The length of the central island of the brick kiln is 281'9". 4. Height of the chimney of the brick kiln is about 165 ft. 5. The brick kiln has stabilized the periphery road / movement area with brick on edge. 6. No unauthorized fuel was found within kiln periphery. Only coal was stored as fuel. 7. The brick kiln has provided plantation around its periphery. 8. Domestic effluent was being discharged onto land for plantation after septic tank. 9. The brick kiln is complying with the provisions of the Air Act, 1981 and code of practice for such type of units. In view of above, it is recommended that consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the Brick Kiln up to 30.09.2025 with suitable conditions as per policy of the Board and with the special conditions that :- 1. The brick kiln to submit final completion certificate from PSCST within one month 2. The industry shall not use any other fuel in the brick kiln for burning purpose, except, pulverized coal. 3. The industry shall no use any illegal fuel at any stage of firing of the brick kiln. 4. The industry shall operate the brick kiln on induced draft technology with zig-zag brick setting and shall not operate it on natural draft in any case. 5. The industry shall implement the procedure regarding feeding, combustion and operation as recommended by technology provider. 6. The industry shall provide more plantations around the Brick kiln 7. The industry shall not use any illegal fuel at any stage of firing of the brick kiln. 8. The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana / Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. 9. The consent is subject to the performance evaluation of new technology adopted by the brick kilns. 10. The brick kiln shall shift to the designated area as per the provisions laid down under the notified Master Plan of Ludhiana or when asked by the Government/ Punjab Pollution Control Board. 11. The brick kiln shall comply with direction issued u/s 5 of the Environment (Protection) Act, 1986 issued by Govt. of Punjab, Department of STE vide notification no. 10/574/2022-STE1/443 dated 04.11.2022 and replace at least 20% coal with paddy straw pellets. 12. The consent is granted based on the document submitted by the brick kiln if at any later stage, any discrepancy is found in the documents submitted by the brick kiln then Board shall be at liberty to take action against brick kiln as per law. The competency to decide the application lies with Environmental Engineer, Regional Office, Ludhiana.
