Earlier the industry was granted consent to establish for expansion under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Exp/LDH3/2023/20854688 dated 10.03.2023 valid upto 09.03.2024………………The said consent to establish was granted subject to certain condition along with following special conditions:
1. This NOC is granted subject to the condition that the industry shall obtain Environmental Clearance as per EIA Notification, 2006.
2. The industry shall strictly operate on ZLD and shall obtain revised ZLD certificate from CPPRI, Saharanpur after successful commissioning of the trail project.
3. The industry shall not carry out any physical activity or any construction with respect to expansion unit till it obtains Environmental Clearance from SEIAA Punjab…………………………..
As per the note, the said CTE was granted due to addition in raw material i.e. rice / wheat straw and for installation of co-gen plant of capacity 5 MW with a boiler of 30 TPH capacity………………….
As per the report submitted by the Regional Office, the project proponent has installed and is operating co-gen plant of 5 MW capacity………………………Thus, the industry has installed the turbine without obtaining Environmental Clearance from SEIAA, Punjab in non-compliance of special condition as mentioned above……………………..
Further as per note of Regional Office the industry has installed 01 boiler of 12 TPH capacity at the place of 3 TPH capacity already installed by it without prior permission of the Board………………………..
The matter was discussed with your good self and If approved Regional Office be requested to clarify the following, please:
1. What was the process before the industry applied for obtaining NOC for expansion.
2. Whether the said process was covered under the ambit of EIA notification 14.09.2006, please comment as per category 5(i) of the Schedule appended to the said notification.
3. Why the industry applied for expansion and what was the change in process on the basis of which it was suggested to obtain clarification from SEIAA as to requirement of EC for the expansion project.
4. Whether the industry has made all the changes / modifications / additions as per the CTE obtained by it.
5. Whether the industry is complying with all the conditions for which consent to establish (Expansion) was granted.
6. Further the industry is a Large Scale industry as per the CA certificate, however, it has applied under the Small Scale Industry. Thus, Regional Office shall get the profile of the industry changed as per Large Scale Industry……...
As per the note the industry is using paddy straw in its boiler and thus making contribution in handling the paddy straw problem of the State………….
Thus, Regional Office be asked to submit the reply / do the needful, immediately, please. |
