It is submitted that earlier the industry was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. R14SASCTOW1993214 dated 15.10.2024 which was valid upto 30.06.2019 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. R14SASCTOA1993126 dated 15.10.2014 which was valid upto 30.06.2019 for Crushing of river bed material @4000 CFT/day subject to certain terms and conditions mentioned therein.
Now, the industry has applied for obtaining fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Crushing of river bed material @4000 CFT/day alongwith land use classification certificate dated 05.06.2024 and other requisite documents. The industry has applied for fresh as the online portal doesn’t given the opinion to submit the late fee/ penalty fee from 2019 onwards.
The industry has deposited Rs. 23200/- vide R. No. 168413446 dated 24.07.2024 & Rs. 23300/- vide R. No. 842457644 dated 30.07.2024 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 23200/- vide R. No. 545491177 dated 24.07.2024 & Rs. 23300/- vide R. No. 977461945 dated 30.07.2024 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the industry is adequate upto 30.06.2029 under both Acts against the total cost of the industry Rs. 47.06 lacs as per latest CA certificate submitted by the industry.
The industry has submitted compliance report of the conditions of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has submitted land use classification issued by District Town Planner, Punjab vide memo no. 837 dated 05.06.2024, in which, it has been mentioned that:
“ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਧੀਨ ਹਵਾਲੇ ਤਹਿਤ ਪ੍ਰਾਪਤ ਪੱਤਰ ਦੇ ਨਾਲ ਨੱਥੀ ਦਸਤਾਵੇਜ਼ਾਂ ਦੇ ਸਨਮੁਖ ਸੂਚਿਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਪਿੰਡ ਮੁਬਾਰਕਪੁਰ (ਰ.ਬ. ਨੰ. 357) ਤਹਿਸੀਲ ਪ੍ਰੀਤਕਪੁਰ, ਜਿਲ੍ਹਾ ਐਸ.ਏ.ਐਸ. ਨਗਰ ਵਿਖੇ ਪੈਂਦੇ ਖਸਰਾ ਨੰਬਰ 45//7/2(2-0), 14(2-8), 15 (8-0) ਅਤੇ 16 (8-0) ਕੁੱਲ ਰਕਬਾ 20 ਕਨਾਲ 8 ਮਚਲੇ (ਲੱਗਭਗ 2.55 ਏਕੜ) ਦਫਤਰੀ ਰਿਕਾਰਡ ਵਿੱਚ ਉਪਲੱਬਧ ਮਾਸਟਰ ਪਲੈਨ ਡੇਰਾਬੱਸੀ ਅਨੁਸਾਰ ਐਗਜਿਸਟਿੰਗ ਇੰਡਸਟਰੀਜ਼ ਅਤੇ ਇੰਡਸਟਰੀ ਮਿਕਸਡ ਜ਼ੋਨ ਪੈਂਦਾ ਹੈ। ਇਸ ਤੋਂ ਇਲਾਵਾ ਉਕਤ ਰਕਬਾ ਐਮ.ਸੀ. ਬਾਊਂਡਰੀ ਐਫ.ਈ.ਜ਼ੈੱਡ ਬਾਊਂਡਰੀ ਅਧੀਨ ਵੀੰ ਪੈਂਦਾ ਹੈ। ਕਿਉਂਜੋ ਆਪ ਦੀ ਸਾਈਟ ਐਮ.ਸੀ. ਲਿਮਟ ਅਧੀਨ ਪੈਂਦੀ ਹੈ, ਇਸ ਲਈ ਉਕਤ ਸਾਈਟ ਉੱਤੇ ਸਥਾਨਕ ਸਰਕਾਰ ਵਿਭਾਗ ਦੇ ਨਾਰਮਜ਼ ਐਪਲੀਕੇਬਲ ਹੋਣਗੇ। ਸਾਈਟ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਐਕਟੀਵਿਟੀ ਕਰਨ ਤੋਂ ਪਹਿਲਾਂ ਉਸ ਸਬੰਧੀ ਮਨਜ਼ੂਰੀ ਸਬੰਧਤ ਸਰਕਾਰੀ ਅਦਾਰਿਆਂ ਤੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਅਤੇ ਰਕਬੇ ਦੀ ਮਾਲਕੀ/ਕਬਜ਼ੇ ਸਬੰਧੀ ਵੱਖਰੇ ਤੌਰ ਤੇ ਮਾਲ ਵਿਭਾਗ ਪਾਸੋਂ ਤਸਦੀਕ ਕਰਵਾਉਣ ਦੇ ਆਪ ਪਾਬੰਦ ਹੋਵੇਗੇ। ਉਕਤ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਆਪ ਵੱਲੋਂ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜ਼ਾਂ ਦੇ ਸਨਮੁੱਖ ਜਾਰੀ ਕੀਤੀ ਗਈ ਹੈ।
ਇਸ ਪੱਤਰ ਨੂੰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਥ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਹੀ ਸਮਝਿਆ ਜਾਵੇ। ਇਸ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਨੂੰ ਸਾਈਟ ਦੀ ਮਾਲਕੀ ਦਾ ਸਬੂਤ, ਸੀ.ਐਲ.ਯੂ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾ ਕਿਸੇ ਕਿਸਮ ਦਾ ਐਨ.ਓ.ਸੀ. ਨਾ ਸਮਝਿਆ ਜਾਵੇ।”
The site of the industry was visited by the undersigned on 31.07.2024. During the visit, it was observed that the industry is a stone crusher and was in operation. The industry has adopted the code of practice framed by the Board for stone crushers/ screening plant, which is as under:-
Sr. Code of Practice Compliance made by the industry.
1. The dust emitting points namely jaw/roller crushers should be properly enclosed/covered The industry has provided proper enclosures over the jaw/roller crushers
2. The conveyor belts should be of proper quality material instead of used tyres. Proper quality belts provided Proper quality belts provided.
3. End of conveyor belts should be provided with conventional type Chute made of rubber sheet/flapper of minimum 5' height supported by mild steel angles in place of telescopic chute at the end of the conveyor belt Chutes have been provided
4. Regular water spray should be carried out at all dust emitting points and transfer points The industry was not in operation, provision of sprinkling has been provided.
5. Water spray should be done on the boundary as per requirement The industry has provided sprinkling system at the boundary wall through flexible pipe.
6. All the approach rods and ramp should be metalled. The industry has provided metalled ramp and area stabilized for the vehicular movement.
7. A green belt consisting of three rows of trees should be provided along the periphery The industry has planted adequate plants along the periphery of the unit. However, advise to provide increase plantation in the ongoing monsoon season.
8. The opening of the housing for the movement of the mechanical drives, conveyor belts etc. should be properly sealed with flexible rubber flaps Complying
9. The process waste i.e. fine material should be dumped along the road side and should be used for filling up the low lying area No fine material was lying in the premises
10. The water spray system should be interlocked with the main crushing operation Water spray system is interlocked with the main crushing operation has been provided.
In view of the above, may if approved, it is recommended that the consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 30.06.2029 subject to suitable conditions and following additional conditions that:
1. This consent is granted for Crushing of river bed material @4000 CFT/day.
2. The unit shall comply with the Environmental Guidelines for Stone Crusher issued by CPCB in July 2023 within 6 months.
3. The unit shall obtain carrying capacity certificate of the area/stone crusher from Department of Mines & Geology, Department of Water Resources and act on basis of such certificates as per the Board's office order issued vide no. 16536 dated 23.07.2021.
4. The unit shall obtain raw material from the Govt. approved mining sites only and shall not indulge itself into any kind of illegal mining. If at any stage the unit engaged itself in illegal mining, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 shall be revoked/cancelled without any opportunity of hearing.
5. The unit shall obtain raw material from the mining sites approved by the Water Sources-cum-Mining Department only.
6. The industry will comply with the guidelines/code of practice issued by the Govt. of Punjab, Department of Science, Technology and Environment Vide dated 17.03.1988, amended in 01.02.2006 and lastly amended vide no. 3/35/2013-STE(4)734 dated 30.07.2013 at all time.
7. The industry will comply with all the provisions under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
8. The unit shall maintain a stock register to justify the legitimate source of mining material, its availability, usage and sale etc.
9. The unit will submit half yearly return to this office duly verified by the Mining officer by 15th of July and 15th Jan of every year.
10. The issuance of this consent does not convey any property right in either real or personal property, or any exclusive privileges, nor it authorize any injury to private property or any invasion of personal rights, nor any infringement of Central, State or Local Laws or Regulations.
11. Nothing in this consent shall be deemed to preclude the institution of any legal action nor relieve the applicant from any responsibilities, liabilities or penalties to which the applicant is or may be subjected under this or any other Act.
12. The industry shall discharge only domestic effluent onto land for plantation after treatment it in the septic tank.
13. All underground water retaining structures shall be lined with an impervious layer so as to avoid seepage and contamination of sub-soil/water.
14. The industry shall ensure that no water pollution problem or public nuisance is created in the area due to discharge of effluents from its industrial premises.
15. The industry shall make proper disposal of the effluent so as to ensure that no stagnation occurs inside and outside the industrial premises during rainy season and no demand period.
16. That the industry shall submit a certificate yearly to the effect that no addition/ modification / expansion has been carried out during this consent period.
17. That the industry shall submit balance sheet yearly showing un-depreciated value of its fixed assets during previous financial year.
18. The industry will stick to the production capacity mentioned in this consent and will not increase the same without the prior written permission of the Board.
19. The industry shall get the annual health survey of the workers conducted and shall maintain a proper record of the same.
20. The industry shall put up display board indicating environment data as per performa prescribed by the Board at the main gate of the industry.
21. The Board reserves the right to revoke this ‘consent to operate’ granted to the industry in case the industry is found violating any of the conditions of this consent and/or the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as amended time to time.
22. The industry shall inform the Board in writing as and when any change is occurred in the Partnership Deed / Proprietorship / Memorandum of Article of Association, especially with regard to the name and address of the Partner / Proprietor / Director / Subscriber etc., and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed / Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken.
23. The industry shall ensure that there is no usage of single use plastic-thermocol disposable items such as water bottler/water pouches/water cups/cups, plates, glasses, forks, spoons, straw etc. And single use decorating materials made of plastic-thermocol or any other non-biodegradable material on its premises.
24. The industry shall not throw, burn or burry any solid wastes in open, outside premises or in drain / water bodies.
25. The industry shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities.
26. The industry shall properly handle and manage the solid wastes as per the provisions of the Solid Waste Management Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
27. The industry shall ensure to comply with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000.
